Abstract

The introduction of "Muhammadan's Law Eactment" No. 1 around 1911 AD was the first step towards family law reform in Brunei Darussalam. While in Southeast Asia, the country that first made efforts to reform family law was Malaysia, with the creation of the Mohammaden Marriage Ordinance, No. V Year 1880 in the Straits countries. So that this research will further discuss the enactment and development of Islamic family law in these two countries. This research is a type of normative research or document study with a comparative approach. Primary data sources are taken from the family law laws of Brunei Darussalam and Malaysia. Secondary data sources come from books, journals, websites, and other sources. Data collection techniques using literature study and data analysis with descriptive analysis method. The results show that Brunei and Britain were once under British rule so that the application of family law was limited. However, the development of family law continues to grow to be more comprehensive. One of them, Brunei and Malaysia both apply fines and prison sanctions to people who have violated family law.

Abstract

Setiap negara memiliki konstitusi dan sistem hukum masing-masing dalam mengatur negara dan penduduknya. Negara-negara yang mayoritas penduduknya beragama Islam sudah mulai melakukan pembenahan terhadap sistem hukum negaranya masing-masing, baik hukum pidana maupun hukum perdata. Tidak lepas dari sorotan perubahan ini adalah hukum keluarga yang mengatur tentang perkawinan, pengasuhan anak, pewarisan dan lain-lain. Penelitian dalam artikel ini merupakan penelitian kualitatif dengan metode studi kepustakaan. Pendekatan yang digunakan dalam penelitian ini adalah pendekatan historis dan pendekatan komparatif. Sumber data dalam penelitian ini adalah website resmi pemerintah Lebanon dan Suriah yang memuat pasal-pasal hukum keluarga Lebanon dan Suriah. Sumber lainnya adalah buku dan jurnal ilmiah yang relevan. Tujuan dari penelitian ini adalah untuk mengetahui pasal-pasal yang mengatur tentang hukum keluarga di Lebanon dan Suriah. Selain itu, penelitian ini juga bertujuan untuk mengetahui dasar atau landasan hukum keluarga di Lebanon dan Suriah. Penelitian dalam artikel ini menemukan bahwa Secara garis besar, hukum keluarga di Lebanon dan Suriah mengikuti mazhab Hanafi yang merupakan mazhab resmi di Lebanon dan Suriah. Abstract

Abstract: Underage marriage is still a phenomenon in Indonesia. Law Number 16 of 2019 has determined that the minimum marriage limit for women and men is 19 years, providing a way for early marriage to apply for marriage dispensation. However, there are still many underage marriages performed under the hands without going through marriage dispensation and then asking for marriage itsbath to the Religious Court. According to the author, this is a legal smuggling to legalise early marriage. The number of judges who still grant this case is undoubtedly the focus of research. This research is empirical juridical by looking at phenomena in society associated with existing regulations and theories of legal smuggling, as well as methods of collecting data through observation and from documents obtained. The results of this study found that underage marriage problems seem to need to be taken seriously because they are prone to legal smuggling, considering that initially, itsbath nikah was only intended for the community for the reasons mentioned in article 7 paragraph (3) of the Compilation of Islamic Law. So judges, especially in religious courts, must start improving. If the judge can reduce the number of itsbath applications against underage marriage, then they have been able to contribute substantive justice to provide welfare for the community. This certainly makes a benchmark for the community not to carry out underage marriages without court permission and, at the same time, an effort to close the faucet of underage marriage in Indonesia. Thus, it is hoped that early marriage can be suppressed. In the future, the government will be able to produce regulations to provide criminal sanctions for perpetrators of early marriage, along with the change in the minimum age of marriage.

Abstract

Underage ithbāt nikāḥ creates a legal loophole in Indonesia's Islamic marriage system. Child marriages that should require a dispensation are often legalized through ithbāt nikāḥ without such approval. This practice is prevalent in the Religious Courts of Madura, where most judges tend to grant petitions despite recognizing its contradiction with efforts to prevent child marriage. This study adopts a juridical-sociological approach through case analysis and in-depth interviews with judges. The findings show that rejection of underage ithbāt nikāḥ is rare, as judges prioritize protecting children's civil rights, such as birth certificates and legal family status. However, this generates a dilemma: granting applications risks legitimizing child marriage, while rejecting them may be seen as denying legal certainty for the community. As a middle path, some judges suggest alternatives, including recognition of children born out of wedlock, determination of child origin, and civil registration without marriage certificates. The study highlights the urgent need for clear legal guidelines to prevent misuse of ithbāt nikāḥ while ensuring child protection.

Abstract

ABSTRAKArtikel ini membahas mengenai pelaksanaan tanggung jawab sosial perusahaan dalam bisnis Islam. Dengan metode pendekatan deskriptif kualitatif, mengkaji dari studi pustaka dari literasi pemikiran sebelumnya, penulis mengambil contoh dari beberapa studi kasus yang terjadi. Dalam bisnis Islam, konteks tanggung jawab sosial perusahaan adalah bagaimana konsep tersebut didasarkan pada beberapa sifat terpuji Rasulullah dalam berbisnis. CSR berfokus pada pembahasan etika dalam bisnis Islam sesuai dengan ajaran etika Islam. Permasalahan seperti bagaimana memproduksi sebuah barang atau jasa yang halal, tidak merugikan konsumen, pertanggungjawaban polusi akibat dampak dari produksi dan lain sebagainya adalah hal-hal yang dibahas dalam pelaksanaan etika.ABSTRACTThis article discusses the implementation of corporate social responsibility in Islamic business. Using a qualitative descriptive approach, reviewing literature from previous thought literacy, the author takes examples from several case studies that have occurred. In Islamic business, the context of corporate social responsibility is how the concept is based on some of the praiseworthy qualities of the Prophet in doing business. CSR focuses on discussing ethics in Islamic business in accordance with Islamic ethical teachings. Issues such as how to produce goods or services that are lawful, not detrimental to consumers, liability for pollution due to the impact of production and so on are matters discussed in the implementation of ethics.

Abstract

Perkawinan dapat diputuskan melalui Pengadilan maupun di luar Pengadilan, namun yang dibenarkan bahwa Perceraian hanya dapat dilakukan di depan sidang Pengadilan Agama sesuai dengan Pasal 39 Ayat (1) Undang-undang Nomor 1 Tahun 1974 tentang Perkawinan. Perceraian pun dapat dilakukan apabila sudah cukup alasan Perceraian. Namun dalam kenyataannya masih banyak ditemukan proses perceraian di luar jalur pengadilan, maka keadaan tersebut banyak menimbulkan persepsi yang berbeda antara hukum agama, hukum adat dan Undang-undang Perkawinan. Hakikat perkawinan adalah mewujudkan kesejahteraan lahir dan batin atau kesejahteraan materiil bagi setiap anggota keluarga yang terdiri dari suami, istri, anak dan segenap keluarga besar suami istri.

Abstract

Islamic inheritance law is a provision for the transfer of property from a deceased person to the person left behind. Islamic inheritance law in Indonesia has been regulated in KHI in accordance with Presidential Instruction Number 1 of 1991. The purpose of this study aims to determine the position and fair rights attached to both male and female heirs in receiving inheritance, especially in cases of kalalah and radd. The method used in this research is normative juridical, namely by conducting searches of library materials, laws and other literature. Kalalah is a person who dies without leaving a father and children. Debate arises regarding the determination of the meaning of walad which is a requirement for siblings to obtain inheritance. KHI in article 182 seems to globalize the word walad. KHI takes the opinion of Ibn Abbas ra. that the word walad includes boys and girls in order to create gender justice. The radd is the excess of inheritance after being distributed to the heirs and there are no 'asabah heirs. In this radd issue, KHI follows the opinion of Uthman bin Affan that the excess is returned to all heirs as stated in article 193.
