Abstract

Private lecturers in Indonesia play a crucial role in higher education; however, they face significant welfare issues, particularly concerning salaries that often fall below the Regional Minimum Wage (UMK). This study aims to identify the challenges faced by private lecturers in West Java related to inadequate salaries and offer recommendations for improvement. Using a qualitative research approach, the study interviews private lecturers and analyzes employment agreements from several private universities. It also examines relevant laws and regulations, including Law Number 14 of 2005 on Teachers and Lecturers, Government Regulation Number 37 of 2009 on Lecturers, Law Number 30 of 2014 on Government Administration, and Law Number 13 of 2003 on Manpower. The findings reveal that, despite formal employment agreements, many lecturers earn less than the UMK, negatively impacting their welfare. Contributing factors include a lengthy certification process, inadequate social security, and the lack of academic ranks for many permanent lecturers. Many private lecturers are not registered with the social security program (BPJS). This study concludes that salaries below the UMK create injustice and undermine the teaching profession. Strengthening employment contracts, clarifying rights and obligations, and raising awareness about lecturers' rights are essential for improving their welfare.

Abstract

This study aims to analyze how the state regulates the administration of unregistered marriages (nikah sirri) in Muslim minority communities in Jayapura City, with a focus on the practice of mass weddings organized to facilitate the registration of marriages. Unregistered marriages, which are not recorded by the state, are still found among Muslim minorities in Jayapura. Factors influencing the practice of unregistered marriages include economic limitations, lack of awareness about administrative procedures, and difficulty in accessing official marriage registration services. To address these issues, the Jayapura City government, through the Religious Affairs Office (KUA), the Religious Court (PA), and the Directorate General of Population and Civil Registration (DUKCAPIL), has initiated a mass wedding program aimed at simplifying the legalization process for couples who have not yet registered their marriages. This research uses a qualitative approach with interviews and observations of couples participating in the mass wedding program. The findings indicate that this program is effective in raising public awareness about the importance of marriage registration. However, challenges remain in terms of legal understanding and the readiness of couples to comply with the applicable administrative procedures. The study suggests the need for increased education about the importance of marriage administration and strengthening access to marriage registration services to reduce the practice of unregistered marriages. With the mass wedding program, it is hoped that all marriages in Jayapura City can be legally registered according to state law, providing optimal legal protection for married couples

Abstract

The MUI fatwa related to interreligious greetings has created polemics in Indonesian society, particularly in the context of Islamic moderation. This fatwa prohibits interreligious greetings which are considered to damage the purity of Islamic teachings that affect social relations, especially in families that have different beliefs. This article aims to analyse the impact of the MUI fatwa on the dynamics of family law in Indonesia, especially on families who have different beliefs and their relevance to the principles of Islamic moderation in the context of family law. This article uses a qualitative approach with an analysis of the content of the MUI fatwa related to greetings in family law, and interviews with family law experts and religious leaders who understand the implications of the fatwa on family relations in interfaith Indonesian society. This article shows that the MUI Fatwa causes tension in families of different beliefs regarding interfaith greetings. This fatwa also shows the tension between maintaining religious identity and maintaining family harmony. In the context of family law, this fatwa affects basic principles such as respect for religious differences and the values of inclusivity in families of different religions. This article offers a new perspective that connects the MUI fatwa related to interfaith greetings with family law in Indonesia.

Abstract

This research analyzes the implementation of the istishlahi (public benefit) principle in the DSN-MUI fatwa concerning Musyarakah Mutanaqishah (Diminishing Partnership) and its application within Indonesia's multicultural context. Employing a qualitative approach with content analysis and systematic literature review, this study examines primary sources, including DSN-MUI Fatwa No.73/DSN-MUI/XI/2008, and secondary sources from academic literature spanning 2015-2024. The findings demonstrate that the implementation of the istishlahi principle in the DSN-MUI fatwa successfully integrates nine fundamental principles (al-’adl, al-maslahah, al-yusr, al-barakah, al-yaqin, al-muwazah, al-istiqraar, al-taysir, and al-amanah) within an adaptive regulatory framework. Comparative analysis of implementation across various regions in Indonesia reveals significant variations in success rates and challenges encountered, with key factors including structural and operational adaptations according to local contexts. Case studies in Aceh, East Java, Makassar, and Sorong highlight the importance of integration with local value systems and active community involvement in successful implementation. This research provides theoretical contributions in developing a new understanding of the istishlahi principle's function as a bridge between Shariah compliance and the practical needs of a multicultural society, as well as practical implications for developing more inclusive and adaptive Islamic financial products.

Abstract

In today's digital era, online fraud and smartphone hacking have become widespread threats, compromising personal security and privacy. This article explores the concept of Hifdzul Mal (protection of wealth) in Islamic law and its relevance in safeguarding personal data and assets from cybercrimes. The purpose of this study is to examine various online fraud schemes, such as WhatsApp scams and fake job offers, and to identify the signs of smartphone hacking, while analyzing these issues within the framework of Islamic legal principles. Using a descriptive methodology, the article outlines preventive measures to protect against these risks. The findings emphasize that Islamic teachings strongly advocate for the preservation of wealth and personal information, prohibiting fraud and theft. This study contributes to understanding how the principle of Hifdzul Mal can be applied to modern digital threats, encouraging ethical behavior and ensuring personal security in the virtual world. [Di era digital saat ini, penipuan online dan peretasan smartphone semakin marak dan menjadi ancaman serius terhadap keamanan serta privasi pribadi. Artikel ini membahas konsep Hifdzul Mal (perlindungan harta) dalam hukum Islam dan bagaimana prinsip ini relevan untuk melindungi data pribadi dan aset dari kejahatan dunia maya. Penelitian ini bertujuan untuk mengeksplorasi berbagai jenis penipuan online, seperti penipuan WhatsApp dan tawaran pekerjaan palsu, serta mengenali tanda-tanda peretasan smartphone. Semua ini dianalisis dengan perspektif hukum Islam. Artikel ini menggunakan pendekatan deskriptif untuk menyarankan langkah-langkah pencegahan yang dapat diambil untuk melindungi diri dari ancaman tersebut. Temuan menunjukkan bahwa ajaran Islam sangat menekankan pentingnya melindungi harta dan informasi pribadi, serta melarang segala bentuk penipuan dan pencurian. Penelitian ini memberikan wawasan tentang bagaimana prinsip Hifdzul Mal dapat diterapkan dalam menghadapi ancaman digital modern, dan mendorong perilaku etis serta menjaga keamanan pribadi di dunia maya].

Abstract

Purpose - This research aims to analyze the application of Maqāṣid al-Sharīʿah principles according to al-Shatibi in the context of the halal lifestyle in the digital era. The main focus of this research is how digital technology, such as halal e-commerce platforms and digital halal marker applications, can facilitate access and transparency of halal products. In addition, this study examines the relevance of Maqāṣid al-Sharīʿah principles in the contemporary Islamic legal framework in facing the challenges of regulation and validity of halal information. Methods - This research uses a qualitative method with a literature review approach and case analysis. Data is collected through literature studies related to digital halal regulations and studies on technology implementation in supporting halal lifestyles. Findings - The results show that digital technology plays a role in strengthening halal lifestyles through innovations that increase accessibility and transparency. However, challenges such as unverified information, evolving regulations, and potential deviations from Shariah principles must be addressed. Collaboration between government, industry, and society is key to overcoming these challenges. Contribution/Limitation - This research contributes to understanding the relationship between Maqāṣid al-Sharīʿah, digital technology, and contemporary Islamic law in supporting halal lifestyle. However, this research is still limited to literature analysis and does not include empirical research on halal technology users in Indonesia. Originality/Value - This research offers new insights into the integration of technology in the principles of Maqāṣid al-Sharīʿah in contemporary Islamic law.

Abstract

This study aims to analyze the economic impact of the 2025 Los Angeles wildfires through the lens of Islamic law, focusing on its application for disaster management, social justice, and supporting Sustainable Development Goals (SDGs), particularly SDG 13 (Climate Action) and SDG 8 (Decent Work and Economic Growth). Using Islamic legal principles such as maslahah (public interest), adl (justice), tawhid (unity), and takaful (mutual protection), the research explores their role in disaster recovery and economic redistribution. A qualitative approach is adopted, employing a case study of the 2025 wildfires, with an analysis of Islamic legal documents, expert interviews, and post-disaster policy reviews. The study finds that Islamic law offers practical instruments such as zakat (charity), qard al-hasan (interest-free loans), and takaful to aid recovery, while emphasizing collective responsibility in rebuilding after disasters. The research highlights how these Islamic principles can guide disaster recovery, promoting fair and sustainable practices in line with the SDGs. By integrating Islamic law into disaster management, the study offers unique solutions for equitable recovery efforts post-disaster. This research provides valuable insights into using Islamic law to create a more just and sustainable economic recovery framework in the face of natural disasters.

Abstract

This study examines the welfare issues of private university lecturers in Indonesia who receive substandard wages, by analyzing them through the perspectives of Islamic law and positive law. The objective of this paper is to explore the alignment between the principles of wage justice in Islamic law and the wage regulations within the national legal framework, especially concerning employment in the private higher education sector. The methodology employed is normative juridical with a qualitative analysis of legal documents and Islamic legal literature. The findings indicate that private lecturers are employed under contractual agreements subject to labor regulations, which often fail to provide adequate welfare guarantees. On the other hand, Islamic law emphasizes justice, fairness, and certainty in wage distribution as part of workers' rights protection. The main novelty of this study lies in identifying the gap between the normative ideals of Islamic law and the practical enforcement of positive law in the higher education context. The impact of this research is to propose an integrative legal approach that incorporates Islamic ethical values into wage regulation policies, aiming to improve the socio-economic well-being of academic professionals in Indonesia. Abstrak: Penelitian ini mengkaji permasalahan kesejahteraan dosen perguruan tinggi swasta (PTS) di Indonesia yang menerima upah di bawah standar, dengan meninjau dari perspektif hukum Islam dan hukum positif. Tujuan dari studi ini adalah untuk menggali kesesuaian prinsip-prinsip keadilan upah dalam hukum Islam dengan pengaturan pengupahan dalam sistem hukum nasional, khususnya terhadap tenaga kerja di sektor pendidikan tinggi swasta. Metodologi yang digunakan dalam penelitian ini adalah pendekatan yuridis normatif dengan analisis kualitatif terhadap dokumen hukum dan literatur keislaman. Hasil kajian menunjukkan bahwa dosen PTS memiliki status hubungan kerja berdasarkan perjanjian kerja yang tunduk pada aturan ketenagakerjaan, yang dalam praktiknya belum memberikan jaminan kesejahteraan yang memadai. Sementara itu, hukum Islam menekankan keadilan, kelayakan, dan kepastian dalam pemberian upah sebagai bagian dari perlindungan hak pekerja. Temuan utama dari penelitian ini menunjukkan adanya kesenjangan antara idealisme hukum Islam dan implementasi hukum positif di sektor pendidikan tinggi. Studi ini memberikan kontribusi dengan menawarkan pendekatan integratif antara hukum Islam dan hukum ketenagakerjaan untuk mendorong formulasi kebijakan pengupahan yang lebih adil dan berorientasi pada kesejahteraan akademisi di Indonesia.
