Abstract

Conflict cases are cases that involve civilian and military elements simultaneously, which raises jurisdictional issues between general courts and military courts. Military courts are often perceived as closed institutions, which triggers public doubts about transparency and justice in the law enforcement process against soldiers. In addition, there is an assumption that military court decisions tend to impose lenient sanctions. Based on the Criminal Procedure Code (KUHAP), the determination of jurisdiction in koneksitas cases is made through joint research between the (civilian) prosecutor and the military prosecutor. If the impact of the criminal act is more detrimental to the public interest, the case is tried in the general court; conversely, if it is more detrimental to the military interest, it is tried in the military court. However, changes in military criminal procedure law in Indonesia still do not fully address the needs of the general court, especially in the investigation process of TNI soldiers suspected of committing general crimes

Abstract

Globalisation and technological advancement present contemporary challenges for Indonesia's Sharia Financial Institutions (LKS) in maintaining competitiveness and innovating. This study examines these challenges, including the acceleration of financial technology (fintech), regulatory changes, and rising consumer expectations for inclusive and efficient services. LKS is required to continuously innovate and create products that meet the needs of a dynamic market while still following the principles of Sharia economic law. This research discusses how LKS integrates fintech and Islamic financial technology in their operations. This research uses a qualitative method with a descriptive-analytical approach. Data were collected through a literature study and document analysis related to government regulations and policies regarding Sharia Financial Institutions. The literature study and document analysis also included laws and regulations related to Islamic finance, Islamic economic law regulations, academic articles (journals), and books that discuss product innovation and competitiveness challenges of Sharia Financial Institutions. This study found that regulations such as the Financial Services Authority Regulation (POJK) and the fatwa of the National Sharia Council of the Indonesian Ulema Council (DSN-MUI) provide a legal basis to support such innovation. However, LKS still faces challenges such as competition with conventional financial institutions, regulatory changes, and technological disruption. To remain competitive, LKS must adjust innovations such as Sharia fintech and crowdfunding following Sharia principles. In addition, public education on Sharia products is also important to increase financial inclusion. Through innovations such as factoring, bespoke financing, and solutions for online businesses, LKS can improve efficiency and empower small businesses while contributing to sustainable economic growth.

Abstract

The abuse of illegal drugs is a serious challenge faced by the Indonesian people, including the abuse of Komix cough medicine containing dextromethorphan. The absence of laws regulating the prohibition of consuming and selling komix cough medicine, as well as the lack of public understanding of the classification of narcotics, leads to the erroneous assumption that only substances such as shabu, marijuana, and ecstasy are included in narcotics, so this phenomenon is interesting to review in Islamic criminal law. This study aims to identify the factors of Komix cough medicine abuse in Teluk Payo Village and review the case from the perspective of Islamic criminal law. This research is an empirical juridical research that manages and analyzes qualitative data obtained from interviews and literature studies, then the data is described in a qualitative descriptive manner so as to obtain conclusions that can be understood by the reader. The results of the study showed that Komix abuse was influenced by internal factors (personality and family) as well as external factors (environment and association). From the perspective of Islamic criminal law, the use of Komix for intoxicating purposes is equated with khamr which is prohibited because it can damage reason and health, so that the perpetrator can be subject to hudud sanctions in the form of dera.

Abstract

Kepala desa memiliki kewenangan strategis dalam penyelenggaraan pemerintahan desa, termasuk kewenangan mengangkat dan memberhentikan perangkat desa sebagaimana diatur dalam Undang-Undang Nomor 6 Tahun2014 tentang Desa yang telah diubah dengan Undang-Undang Nomor 3Tahun2024. Namun, dalam praktiknya kewenangan tersebut sering dijalankan secara diskriminatif dan tidak objektif. Artikel ini bertujuan untuk menganalisis tugas dan kewenangan kepala desa yang bersifat diskriminatif terhadap perangkat desa berdasarkan Pasal 26 huruf b, Pasal 49 ayat (2), dan Pasal 53 UU Desa, ditinjau dari perspektif hukum tata negara dan fiqih siyasah. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil kajian menunjukkan bahwa tindakan diskriminatif kepala desa merupakan bentuk penyalahgunaan kewenangan yang bertentangan dengan prinsip negara hukum berdasarkan demokrasi Pancasila serta nilai keadilan dan amanah dalam fiqih siyasah.
