Abstract

This article examines the perspectives of Islamic law and positive law regarding the age limit for marriage. Age is generally seen as an indicator of maturity, though it is not always a reliable measure. The aim of this study is to explore the views of both Islamic law and positive law on the marriage age limit and its relevance in today's context. The research employs a normative juridical method, focusing on the applicable legal regulations. The findings reveal that Islamic law does not specify a particular age limit for marriage; rather, it relates to the stages of baligh (maturity) and rushd (wisdom). In contrast, positive law sets the marriage age limit for both men and women at 19 years.

Abstract

This study explores the Islamic perspective on Human Rights (HR) through a qualitative approach based on literature review. It emphasizes that the principles of human rights are not foreign to Islamic teachings, but are inherently embedded in the values of Sharia derived from the Qur'an and Hadith. Islam upholds justice, freedom of religion, equality, the right to life, and social and economic welfare. The article also examines contemporary challenges faced by Muslim societies in implementing human rights, such as gender inequality, restrictions on religious freedom, and the marginalization of vulnerable groups, including the LGBT community. The findings reveal that the tensions between Islamic principles and international human rights standards often stem from differing normative foundations and interpretations of individual freedom. Therefore, a contextual reinterpretation (ijtihad) is necessary to ensure that Islamic values remain relevant and responsive to modern global challenges. The study concludes that, when applied wisely and aligned with universal humanitarian values, Islamic teachings hold significant potential to contribute to the development of a just, inclusive, and dignified society.

Abstract

Artikel ini mengkaji Qiraah Mubadalah sebagai metode tafsir yang ditujukan untuk mengoreksi bias patriarkal dalam penafsiran teks keagamaan. Selama ini, sebagian tafsir Al-Qur’an dan hadis cenderung memosisikan perempuan secara subordinat, padahal Islam berlandaskan keadilan, kesalingan, dan penghormatan martabat manusia. Penelitian ini menggunakan metode kepustakaan dengan pendekatan hermeneutis untuk menelaah konsep dasar Mubadalah, landasan teologisnya dalam tauhid, serta penerapannya pada ayat dan hadis yang berkaitan dengan relasi gender. Hasil kajian menunjukkan bahwa Mubadalah menempatkan laki-laki dan perempuan sebagai subjek moral yang setara, dengan prinsip bahwa nilai etis dalam teks berlaku timbal balik selama tidak ada dalil khusus yang membatasinya. Pendekatan ini menghasilkan pembacaan yang lebih kontekstual dan adil, sekaligus menawarkan paradigma kemitraan dalam keluarga dan masyarakat. Dengan demikian, Qiraah Mubadalah relevan sebagai alternatif metode tafsir yang mendukung keadilan gender dalam kerangka syariat.

Abstract

Understanding Islamic family law is an important aspect in Islamic law education, especially for students of the Islamic Family Law Study Program. However, in practice, various problems are still found that originate from the dominance of the textual approach, the gap between classical fiqh and social reality, and the complex relationship between Islamic law and state law. This research aims to analyze the problems of understanding Islamic family law in S1 students of Islamic Family Law in Mandailing Natal by highlighting the tension between normative texts, social practices, and modern legal dynamics. This research uses a qualitative approach with a field study method (field study), through observation and analysis of empirical data associated with normative and sociological studies. The research results show that students' understanding of Islamic family law still tends to be normative-textual and not completely contextual. The maqaṣid al-syari'ah approach is offered as a methodological solution to bridge the gap, because it is able to integrate the purpose of Islamic law with the demands of social justice and protection for vulnerable groups. This research emphasizes the importance of updating the Islamic family law education approach to be more responsive to social development and modern law.
