Abstract

The need for humans to remain intertwined with other humans to meet their needs, which cannot be fulfilled alone, is why cooperation in the agricultural sector is held. Production sharing cooperation in the management of rice fields in Sumberpakem Village has existed for a long time. However, the implementation is still not in accordance with sharia law. The purpose of this research is to find out the practice of profit sharing with the bettonan system in terms of sharia economic law. the method used in this research uses qualitative research with descriptive qualitative research. data collection techniques use observation, interviews and documentation, with data analysis using the Milles and Hubberman method. the results of this study show that the process of managing rice fields in Suberpakem Village, Sumberjambe District, Jember Regency consists of two types, paroan and bettonan, which in Islamic law is included in the muzara'ah contract. The management of rice fields with the bettonan system is that the landowner gives his rice fields to the tenant farmers by providing seeds, fertilizers, and plowing tools, and the management process is borne by the tenant farmers, but in practice the owner of the rice fields does not determine the period of management and in the division of the results the owners of the rice fields vary in determining the division of the harvest with the bettonan system there are those who use 4: 1, 5: 1 and some set aside first then the results are divided 5: 1.

Abstract

One of the Islamic economic discourses that is often claimed to be the consensus of scholars (ijma') is the prohibition of bank interest, as evidenced by several statements and writings of contemporary Islamic economic experts. However, it is also a fact that there are many differing opinions among scholars regarding the law on bank interest. This raises several questions: Is the claim of ijma' on the prohibition of bank interest in accordance with the theory of ushul fiqh? Can it be considered ijma' when some scholars have different opinions? These questions can only be answered through an ushul fiqh approach by researching and understanding the normative study on the concept of ijma', which is extensively explained in ushul fiqh books. The conclusion derived from this study is that the ijma' on the prohibition of bank interest does not align with the principles of ushul fiqh. Therefore, it is more prudent not to dismiss the opinions of some scholars who justify bank interest. In other words, we can say that the prohibition of bank interest is the opinion of the majority of scholars, but it is not an ijma' as many people believe.

Abstract

Every human being is created in pairs between a man and a woman, thus forming a marital relationship. But navigating the marriage ship will not go the way you want it to, with divorce sometimes being a shortcut in the marital relationship. Divorce in marriage will have many repercussions, including raising children after divorce. As child support is often overlooked by heirs to their rights and obligations, Islamic law and civil law provide for alimony during marriage or after marriage (divorce). The methodology of this research uses a normative juridical approach and the type of research is library research. Then the primary data sources used are Islamic Family Law and Civil Law. The secondary data sources used are books related to problem formulation and discussion. The data validity testing technique in this research uses data source triangulation. The result of this study is that child maintenance after divorce according to Islamic family law is fully borne by the father, but this obligation can be reduced, if the father cannot work for a living (paralyzed, etc.) and does not have a trump card to give. Meanwhile, child maintenance after divorce according to the provisions of civil law is the responsibility of both parents.

Abstract

Early marriage is one of the issues that contributes to the high rate of stunting in children in Indonesia, especially in rural areas. In Baletbaru Village, Sukowono, Jember, early marriage is still a common phenomenon, so preventive measures are needed to reduce the risk of stunting through education and counselling. The purpose of this assistance is to increase public knowledge and awareness, especially among adolescents, regarding the negative impacts of early marriage and the importance of nutrition in preventing stunting. The method used is Participatory Rural Appraisal (PRA), which directly involves the community in every stage of assistance, from identifying problems to formulating solutions. The results of the assistance showed a significant increase in participants' understanding of the negative impacts of early marriage, with 85% of participants feeling they understood the issue better. In addition, 90% of participants were committed to sharing information with their environment. The implications of this assistance indicate that ongoing counselling is urgently needed, and further collaboration with the government and health institutions is recommended to expand the reach of education and intensive assistance for at-risk communities.

Abstract

This research aims to measure the economic resilience of families involved in early marriage in Mayang Village, Jember Regency. Using a mixed methods approach that combines quantitative and qualitative methods, data was collected through observation, interviews, documentation, and surveys of 50 respondents who met the criteria. Data analysis using multiple linear regression shows that family income, mother's education level, and access to social assistance programs significantly affect family economic resilience. The data processing in this research uses Descriptive Statistical Analysis to describe the economic characteristics of families, such as income, expenditure, and welfare indicators. The results of this study indicate that early marriage has a significant impact on the economic resilience of families in Mayang Village, as reflected in decreased income and increased health burdens. These findings also highlight the importance of women's economic empowerment programs and improved access to education as efforts to enhance the welfare of families involved in early marriage. Interventions targeting education, health, and changes in social norms are crucial for improving the economic resilience of families in Mayang Village.

Abstract

For family problems, people are more likely to use non-litigation mediation processes to resolve their disputes rather than litigation. This is caused by many factors, including high costs, a long process, community obedience to kiai and community leaders, and long distances. The aim of this research is to find out how effective village kiai are as non-litigation mediators in resolving syiqaq and nusyuz conflicts and how Islamic law reviews village kiai's non-litigation mediation practices in resolving family problems. This study conducted descriptive qualitative research. The results show that the village kiai was chosen as a non-litigation mediator based on community beliefs. In practice, he provides direction and helps close deals. Furthermore, the principles of Islamic law state that it does not conflict with Islamic law, and even qualifies as a hakam.

Abstract

This study analyzes the success factors of sharia financing at BMT NU Jambesari, based on the significance of sharia financing in empowering MSMEs as pillars of the Islamic economy. The study addresses gaps by emphasizing sharia compliance and risk management strategies as key elements of success. The research aims to analyze the factors that determine the success of sharia financing in empowering MSMEs. This research employs a descriptive qualitative method with data collected through interviews, observations, and documentation. The findings reveal that the success of financing relies on strong sharia compliance, adaptive risk management strategies, empowerment through training, and a community-based local approach that strengthens long-term relationships with clients.

Abstract

This research explores the psychological impact of interfaith marriages on children in the Tapal Kuda area of East Java. Children from interfaith marriages only have multicultural awareness. However, it also has an impact on children's psychology. In this context, children often feel trapped between two different belief systems resulting from interfaith marriages, which can cause confusion and stress. Different beliefs and beliefs give children choices, which, of course, make children psychologically stressed by following one of them's beliefs. Pressure to choose one religion over another or to meet the expectations of both parents can cause significant internal conflict. This study uses a qualitative approach with case studies. The results show that these children show strong multicultural awareness but also experience significant challenges related to religious identity and mental health. Social pressure and confusion regarding religious identity often trigger their emotional instability, leading to feelings of anxiety, stress, and lack of self-confidence, ultimately affecting their mental health. Therefore, an inclusive approach is needed from families, communities, and educational institutions to support their mental health. This view is consistent with the principles of Maqashid al-Syari’ah, especially regarding protecting one's nasab (hifz an-nasl), protecting the soul (hifz al-nafs), and protecting religion (hifz al-din).

Abstract

This study aims to understand the challenges and constraints in the evolution of Islamic bonds and explore the challenges that have been identified. aims to provide insights into the dynamics of sukuk and identify key challenges. The research method used in this study is a qualitative case study approach. This study uses purposely selected informants. Data were collected through observation, in-depth interviews and documentation to gain an in-depth understanding of this phenomenon. The data was analyzed using the Miles and Huberman data analysis technique, which includes data reduction, data display, and verification, resulting in a comprehensive conclusion about the challenges and future prospects of sukuk (Islamic bonds). The research results in this study produce several causes of challenges and obstacles to the evolution of sukuk (Islamic bonds) in the form of non-uniformity of sharia principles that must be used as guidelines and the complexity of the transaction structure. The study concludes that the evolution of sukuk (Islamic bonds) is faced with significant challenges such as public perception and regulatory complexity, which affect the development of this financial instrument. Nonetheless, the future prospects of sukuk remain promising with increased understanding of Shariah principles and efforts to improve the regulatory infrastructure. To achieve the full potential of sukuk, strong collaboration between market participants, regulators and the public is required to overcome these challenges and capitalize on opportunities to support inclusive and sustainable economic growth.

Abstract

Kesadaran para pelaku UMKM di Indonesia terhadap pentingnya legalitas usaha semakin tinggi, namun hingga hari ini banyak pelaku UMKM termasuk Industri Kerupuk Mawar THR Barokah di Desa Wonosuko masih mengalami kesulitan dalam proses pemenuhan persyaratan. Kegiatan pendampingan legalitas usaha dan penerbitan sertifikat halal oleh tim pengabdian pada masyarakat Sekolah Tinggi Ilmu Syariah Nurul Qarnain Jember ini memiliki tujuan untuk membantu memudahkan para pelaku UMKM dalam memenuhi regulasi yang berlaku. metode pelaksanaan kegiatan ini terbagi ke dalam beberapa langkah, yakni observasi, sosialisasi, melaksanakan pendampingan dan evaluasi. Dengan adanya kegiatan ini para pelaku usaha dapat terbantu dengan mudah untuk mendapatkan NIB dan sertifikat halal, sehingga meningkatkan daya saing dan keberlanjutan usaha mereka. Hasil kegiatan ini menunjukkan bahwa adanya dukungan yang berkelanjutan sangat penting untuk membantu UMKM mengatasi segala tantangan dan meningkatkan posisi mereka di pasar global.
