Abstract

The circulation of narcotics and illegal drugs in Indonesia has disturbed the majority of the public, and almost every day the media shows arrests of illicit traffic of narcotics and other criminal acts. In carrying out their duties as law enforcers the police are guided by the code of ethics as a guideline for daily implementation. Regulations related to the police code of ethics can be seen from Law Number 2 of 2002 concerning the Indonesian National Police, Regulations of the Chief of Police of the Republic of Indonesia Number 8 of 2006 and Number 7 of 2006 Each of them is binding on the implementation of the police's daily duties. This study analyzes law enforcement by the police in Narcotics Crimes committed by members of the National Police and criminal sanctions against members of the National Police who commit Narcotics Crimes. This study uses a normative juridical type, namely by carrying out legal research by looking at the laws and regulations related to Law no. 35 of 2009 concerning Narcotics. After the research material is obtained and collected, the material is then processed and analyzed with legal arguments based on deductive-inductive (general-specific) legal logic. The author can conclude that cases of narcotics settlement carried out by the police are the same as that of the community in general, namely through general courts.

Abstract

Judges are often referred to as God's representatives in the world, this is because of the extraordinary role of judges in overseeing the law and upholding justice, including in eradicating criminal acts of corruption. As time goes by, the disease of corruption has not only infected ordinary officials, but even officials tasked with law enforcement, in this case judges, have also been caught in cases of criminal acts of corruption. Of course, this is not a trivial problem, where a judge who is supposed to uphold legal norms in order to achieve justice and peace in society, instead commits a criminal act of corruption. The criminal act of corruption is a criminal act that falls into the category of extra ordinary crime, this is because the impact of this criminal act of corruption is very large and systematic. Therefore, the state, in this case represented by the government, must make special breakthroughs in responding to judges who commit criminal acts of corruption, of course one of which is by using criminal law instruments which contain penalties. The punishment of criminals whose status is an ordinary person should not be equated with those whose status is a state official, in this case a judge. In this legal matter, the state must really show its teeth to prove to the public that law enforcement in Indonesia is not only sharp downwards but also sharp upwards. In this research the author will discuss criminal responsibility in criminal acts of corruption committed by judges.

Abstract

This study aims to explore the urgency of the presence of kyai as a speaker in the walimah al-‘ursy (wedding reception) and its impact on the formation of a sakinah family. The research method used is qualitative with a descriptive-analytical approach. Primary data were obtained through interviews with kyai, religious figures, and the bride and groom, as well as secondary data from literature studies and fiqh books. Data analysis was carried out qualitatively to identify the role of kyai in providing advice and guidance during the wedding walimah. The results of the study indicate that the presence of kyai in the walimah al-‘ursy plays a significant role in strengthening the spiritual dimension of marriage. Kyai provides valuable advice on the nature of marriage according to Islamic teachings, such as the importance of loyalty, mutual respect, and responsibility in the family. This advice is not only beneficial for the bride and groom, but also provides guidance for guests about household life according to sharia. Kyai also helps create a peaceful and harmonious atmosphere, and strengthens social ties among family members and the community. The significance of this study lies in the understanding that the presence of a kyai not only enriches the spiritual meaning of marriage but also serves as a link between customs and religious teachings, and strengthens social solidarity. Although not explicitly required in the Shari'a, this tradition is considered to provide great benefits for the bride and groom, their families, and society as a whole, making it an important element in wedding celebrations in Muslim communities.

Abstract

Divorce in Indonesia continues to show an increasing trend each year, leaving unresolved psychological, social, and spiritual impacts even after legal proceedings are finalized. Post-divorce conflicts, such as child custody disputes, property division, and fractured extended family relations, often persist and escalate. This study aims to formulate an Islamic Forgiveness Therapy mechanism as an alternative approach for addressing post-divorce conflicts holistically. This research employs a qualitative approach using a library research method, critically analyzing Western psychological theories, Islamic teachings on forgiveness, and empirical divorce data in Indonesia. The findings indicate that Islamic Forgiveness Therapy can be practically applied through three key components: personal forgiveness, which fosters individual spiritual connection with God; social forgiveness, which restores harmony among extended families; and spiritual reframing, which encourages individuals to perceive conflict as a life test that brings wisdom and spiritual growth. This study confirms that integrating Islamic forgiveness values with modern psychotherapy principles offers a more comprehensive and contextual conflict resolution model. The results imply significant potential for application in educational counseling programs, family court mediation services, and the development of online counseling platforms for Muslim families. Thus, Islamic Forgiveness Therapy is expected to shift the paradigm of post-divorce conflict resolution from mere legal settlement to a sustainable healing process for the heart and soul.

Abstract

Penelitian ini membahas revitalisasi implementasi Bimbingan Perkawinan (Bimwin) sebagai strategi inovatif dalam mewujudkan keluarga sakinah di era digital. Tingginya angka perceraian di Indonesia menunjukkan rendahnya kesiapan pasangan dalam membangun rumah tangga. Sebagai respon, Kementerian Agama meluncurkan program Bimwin, termasuk inovasi digital melalui Simkah Web dan E-Bimwin. Tujuan penelitian adalah menganalisis efektivitas program tersebut serta merumuskan strategi revitalisasi yang adaptif dengan kebutuhan generasi digital native.Metode penelitian menggunakan pendekatan kualitatif deskriptif melalui studi literatur, analisis kebijakan, dan telaah implementasi layanan digital perkawinan, dengan sumber dari dokumen resmi, statistik nasional, serta penelitian terdahulu.Hasil penelitian menunjukkan perlunya revitalisasi pada aspek metodologi pembelajaran, aksesibilitas, dan keterlibatan stakeholder. Inovasi digital melalui modul interaktif dan aplikasi mobile terbukti meningkatkan efektivitas serta inklusivitas layanan. Dari perspektif normatif Islam, konsep keluarga sakinah tidak hanya bersifat sosiologis tetapi berakar pada Al-Qur’an, seperti QS. Ar-Rum [30]:21 tentang sakinah, mawaddah, wa rahmah, hadis Nabi tentang pernikahan sebagai sunnah, serta prinsip mitsaqan ghaliza dalam akad nikah. Analisis menunjukkan bahwa inovasi digital Bimwin selaras dengan tujuan maqashid al-syariah dalam menjaga agama (hifz al-din), keturunan (hifz al-nasl), dan keluarga, serta relevan dengan Kompilasi Hukum Islam yang menekankan kesiapan lahir batin dan tanggung jawab suami-istri. Penelitian ini memberikan kontribusi teoretis dan praktis bagi pengembangan kebijakan Bimwin berbasis digital sekaligus menegaskan digitalisasi sebagai instrumen strategis untuk memperkuat ketahanan keluarga dan mewujudkan keluarga sakinah di Indonesia

Abstract

Cigarette excise crimes are a form of economic crime that significantly impact state revenues, national economic stability, and the market balance of the tobacco industry. This phenomenon not only causes material losses to the state but also has implications for social justice and the economic order of society. This study aims to analyze in depth the characteristics, causes, and implications of cigarette excise crimes from the perspective of economic criminal law and criminology. The research method used is a juridical-normative approach combined with criminological analysis to identify the relationship between social, economic, and legal factors in cigarette excise violations. The results indicate that these crimes are driven by economic motives, regulatory imbalances, weak law enforcement, and low public awareness of excise obligations. Through this analysis, the study emphasizes the need for synergy between criminal law policy, economic oversight, and a criminological approach to create an effective and equitable excise control system in Indonesia.

Abstract

ABSTRACT This study examines the legitimacy of child marriage within the framework of ijbar rights according to the Syafi’i school and Indonesian national law. The research seeks to identify a point of harmony between classical Islamic jurisprudence, which grants authority to the wali mujbir, and modern legal principles emphasizing child protection and mutual consent in marriage. Using a normative legal research method with conceptual, statutory, and comparative approaches, the findings reveal that the Syafi’i school permits ijbar under strict conditions such as the absence of hostility between guardian and child, equality between spouses, and a fair dowry. However, such practice is deemed makruh or invalid when it causes harm to the child. In contrast, Indonesia’s positive law does not recognize ijbar, as the validity of marriage requires the consent of both parties under Article 6(1) of Law No. 16 of 2019. The establishment of a minimum marriage age of 19 reflects the alignment between national law and maqāṣid al-syarī‘ah principles, particularly the protection of life and lineage. The study recommends that marriage dispensations be granted only after thorough psychological and social assessments, along with enhanced public legal awareness regarding the risks Keywords: child marriage, ijbar right, Syafi’i school, national law. ABSTRAK Penelitian ini bertujuan menelaah keabsahan praktik pernikahan anak dalam bingkai hak ijbar menurut pandangan Mazhab Syafi’i dan ketentuan hukum nasional Indonesia. Fokus kajian diarahkan untuk menemukan titik temu antara ajaran fikih klasik yang memberikan otoritas kepada wali mujbir dan regulasi modern yang menekankan perlindungan hak anak serta prinsip persetujuan dalam perkawinan. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan konseptual, perundang-undangan, dan komparatif. Hasil penelitian menunjukkan bahwa Mazhab Syafi’i memperbolehkan pelaksanaan ijbar oleh wali dengan sejumlah syarat ketat, antara lain tidak adanya permusuhan antara wali dan anak, kesepadanan calon pasangan, serta pemberian mahar yang sesuai. Namun, praktik tersebut dapat menjadi makruh bahkan tidak sah apabila menimbulkan kemudaratan bagi anak. Sementara itu, hukum positif Indonesia tidak mengenal hak ijbar, sebab sahnya perkawinan mensyaratkan persetujuan kedua calon mempelai sebagaimana diatur dalam Pasal 6 ayat (1) Undang-Undang Nomor 16 Tahun 2019. Penetapan usia minimal 19 tahun bagi calon suami dan istri mencerminkan sinkronisasi antara hukum nasional dan prinsip maqāṣid al-syarī‘ah, khususnya perlindungan jiwa dan keturunan. Penelitian ini merekomendasikan agar pemberian dispensasi nikah dilakukan secara selektif melalui asesmen psikologis dan sosial yang mendalam serta peningkatan literasi hukum masyarakat terhadap dampak pernikahan anak. Abstract

ABSTRACT. The Rokat Pandhebeh tradition is one of the customary ceremonies of the Randuagung Village community, Sumberjambe District, Jember Regency, conducted prior to marriage. This tradition embodies the meaning of purifying the bride and groom both physically and spiritually from all elements believed to bring misfortune or negativity, with the hope that they may enter married life in a state of purity and receive blessings. This study aims to examine the implementation of the Rokat Pandhebeh tradition before marriage and to analyze it from the perspective of ‘Urf (custom) in Randuagung Village. The research employs a qualitative method with a case study approach. Data were collected through observation, interviews, and documentation in Randuagung Village. The research findings show that the Rokat Pandhebeh tradition is carried out through several stages, namely the preparation of ritual materials, the recitation of prayers, the sprinkling of flower water as a symbol of purification, and the distribution of food alms to the community. This tradition holds both social and spiritual functions, such as strengthening kinship, maintaining harmony, and preserving local culture. Based on the perspective of ‘urf, the implementation of Rokat Pandhebeh is categorized as ‘urf shahih (valid custom) because it does not contradict Islamic law. Tradisi Rokat Pandhebeh merupakan salah satu upacara adat masyarakat Desa Randuagung, Kecamatan Sumberjambe, Kabupaten Jember, yang dilaksanakan menjelang pernikahan. Tradisi ini mengandung makna pembersihan diri lahir dan batin calon pengantin dari segala unsur yang dianggap membawa keburukan atau kesialan, baik secara fisik maupun spiritual, dengan harapan dapat memasuki kehidupan rumah tangga dalam keadaan suci dan memperoleh keberkahan. Penelitian ini bertujuan untuk mengetahui pelaksanaan tradisi Rokat Pandhebeh menjelang pernikahan dan Tinjauan Urf terhadap tradisi Rokat Pandhebeh menjelang pernikahan di Desa Randuagung. Metode yang digunakan adalah penelitian kualitatif dengan pendekatan studi kasus. Data diperoleh melalui observasi, wawancara, dan dokumentasi di Desa Randuagung, Hasil penelitian menunjukkan bahwa tradisi Rokat Pandhebeh dilaksanakan melalui beberapa tahapan, yakni persiapan perlengkapan, pembacaan doa, siraman air kembang sebagai simbol penyucian, serta pembagian sedekah makanan kepada masyarakat. Tradisi ini memiliki fungsi sosial dan spiritual, yaitu mempererat kekerabatan, menjaga keharmonisan, dan melestarikan budaya lokal. Berdasarkan tinjauan ‘urf, pelaksanaan Rokat Pandhebeh termasuk kategori ‘urf shahih (adat yang sah) karena tidak bertentangan dengan syariat Islam. Kata kunci: Rokat Pandhebeh, Urf, Pernikahan.
