Abstract

Kegiatan pengabdian masyarakat yang dilaksanakan bertujuan untuk memberikan Penyuluhan hukum tentang perlindungan hukum bagi hak cipta karya seni dalam era digital di Indonesia bagi pekerja seni kota medan di dinas pariwisata kota medan . Permasalahan yang dihadapi adalah banyaknya karya seni dalam era digital yang kurang dalam pengawasan oleh dinas pariwisata kota medan. Dalam hal perlindungan hukum bagi pelaku karya seni dalam era digital perlu sekali dilakukan untuk menghindari permasalahan dikemudian hari. Hasil dari kegiatan ini, peserta dapat mengetahui dan memahami peran pelaku karya seni dalam era digital secara baik dan benar. Adanya rasa kesadaran hukum dan pemahaman hukum peserta dalam perlindungan hukum bagi pekerja karya seni dalam hal memberi kenyamanan kepada pekerja seni dalam era digital di Indonesia khususnya untuk diwilayah Kota Medan.

Abstract

The acceleration of globalization and advances in information technology have brought about significant changes in the economic field. In this context, collaboration between individuals is a key element in forming business groups that aim to achieve economic benefits. These business groups can take the form of informal businesses that do not yet have legality, as well as legal entities known as corporations. When individuals join a corporation, this also strengthens the corporation's position as a legal subject in economic activities. A legal subject (subject tumjuris) is an entity that can have and exercise rights and obligations. This situation can trigger abuse of power by corporations against the public interest, which is then known as corporate crime. Such crimes are usually committed for the sake of the company's business interests and fall into the category of white collar. crime. One form of corporate crime that is rampant is the violation of the economic rights of creators and copyright owners

Abstract

Law enforcement is an effort to realize the ideals of law to create justice, benefit and legal certainty in reality. The crime of online fraud based on scammers is a cyber crime, the regulation is regulated in Article 378 of the Criminal Code. From year to year the number of scammer-based online fraud crimes is increasing as evidenced by community reports every year and even every week there must be victims of fraud crimes committed in cyberspace, but the number of settlements is very small, this indicates a problem, both internally and externally, so that law enforcement which is the benchmark for the effectiveness of Law Number 1 of 2024 concerning the Second Amendment to Law Number 11 of 2008 concerning Electronic Information and Transactions, The author is interested in conducting a qualitative research method, to find various reading literature related to the application of law to criminal acts of fraud committed online or can be referred to as scammers, this research aims to find legal certainty and benefits for people who feel harmed.

Abstract

This study aims to analyze the criminal liability of a biological mother who commits the murder of her child, as well as to compare the regulation and sentencing approaches between the former Criminal Code (KUHP) and the new KUHP under Law No. 1 of 2023. The research questions include: first, how criminal liability for a biological mother who kills her child is assessed from the elements of fault (mens rea) and capacity for responsibility (toerekeningsvatbaarheid) under Indonesian criminal law; and second, what are the differences in regulation and sentencing approaches for the crime of child murder by a biological mother in the former and new KUHP. The research method used is normative legal research with a comparative approach, through the study of statutory regulations, legal literature, and jurisprudence. The results show that the criminal liability of a biological mother who commits child murder is highly influenced by the analysis of the elements of fault and capacity for responsibility, including considerations of psychological disorders and social factors. The new KUHP under Law No. 1 of 2023 provides significant changes in the classification of offenses, sentencing limits, and a restorative justice approach that emphasizes the protection of children and victim recovery, compared to the former KUHP, which is more formalistic and retributive. Thus, this study emphasizes the need for a comprehensive understanding of the psychological aspects of the perpetrator and the harmonization of the application of criminal law in the context of child protection in Indonesia.
