Abstract

Abstrak Penelitian ini bertujuan untuk mengetahui aplikasi qawa’ide fiqhiyyah dalam fatwa kontemporer serta tantangan penerapannya dalam konteks lintas budaya dan hukum negara. Metode kualitatif digunakan sebagai metode penelitian, dengan menggunakan pendekatan studi Pustaka dan pendekatan deskriptif analisis. Studi pustaka merupakan penelitian dengan data premier dan data sekunder yang diperoleh dari sumber kepustakaan, dan sumber tersebut berupa jurnal, buku, artikel, berita yang dapat dijadikan sebagai data untuk melakukan penelitian. Adapun teknik pengumpulan data yaitu dengan cara mengumpulkan kitab dan jurnal mengenai qawaid fiqhiyyah dan juga artikel terkait dengan implementasi qawaid fiqhiyyah dalam fatwa kontemporer. Hasil penelitian ini adalah bahwa qawa’id fiqhiyyah diaplikasikan dalam fatwa kontemporer, contohnya dalam keuangan Islam ada fintech dan ijarah muntahiyah bi at-tamlik, di teknologi ada rekayasa genetika dan blockchain serta di bioetika ada transplantasi organ dan euthanasia. Beberapa tantangan penerapannya dalam konteks lintas budaya dan hukum negara yaitu; qawa’id fiqhiyyah perbandingan mazhab, contoh-contoh yang kurang berkembang, otoritas qawaid fiqhiyyah, qaidah fiqhiyyah dan problem kepastian hukum. Kata Kunci: Qawa’id Fiqhiyyah, Aplikasi Qawa’id Fiqhiyyah, Fatwa Kontemporer   Abstract This research aims to find out the application of qawa'ide fiqhiyyah in contemporary fatwas as well as the challenges of its application in the context of cross-cultural and state law. The qualitative method is used as a research method, using a literature study approach and a descriptive analysis approach. Literature study is research with primary data and secondary data obtained from library sources, and these sources are in the form of journals, books, articles, news that can be used as data to conduct research. The data collection technique is by collecting books and journals about qawaid fiqhiyyah and also articles related to the implementation of qawaid fiqhiyyah in contemporary fatwas. The result of this research is that qawa'id fiqhiyyah is applied in contemporary fatwas, for example in Islamic finance there is fintech and ijarah muntahiyah bi at-tamlik, in technology there is genetic engineering and blockchain and in bioethics there is organ transplantation and euthanasia. Some of the challenges of its application in the context of cross-cultural and state law are; qawa'id fiqhiyyah mazhab comparison, less developed examples, qawa'id fiqhiyyah authority, qaidah fiqhiyyah and legal certainty problems. Abstract

Sharia arbitration as an alternative to sharia economic dispute resolution is still considered ineffective. In fact, when referring to the term “sharia” attached to sharia arbitration and Basyarnas-MUI, this institution should be a solution in accordance with the principles of Islamic law. This research aims to analyze the procedures and mechanisms of sharia arbitration by Basyarnas-MUI as well as the implementation of tahkim contracts in its implementation. This research uses a qualitative method with a literature study approach and a descriptive-analytical method based on the theory of tahkim contracts. The results show that there are six stages in the mechanism of sharia arbitration by Basyarnas, namely: (1) application registration, (2) arbitrator determination, (3) examination and trial process, (4) peace mediation, (5) decision making, and (6) execution and annulment of the decision. This study found that the implementation of the tahkim contract by Basyarnas has been carried out in principle, but not fully maximized, especially in the aspects of arbitrator competence and the validity of the object of dispute. Therefore, it can be concluded that the implementation of the tahkim contract in the sharia arbitration mechanism by Basyarnas-MUI still requires strengthening so that it can run in accordance with the principles of Islamic law and become an effective solution in resolving sharia economic disputes.

Abstract

This research aims to analyze the role of friendship activities and giving gifts in strengthening community solidarity and togetherness in Bontoboddia Hamlet, Lempangang Village, Bajeng District, Gowa Regency, in the context of celebrating Independence Day on August 17. Descriptive design. Data was obtained through in-depth interviews, participant observation, and documentation. The research subjects included the activity committee, community leaders, and residents involved in the celebration, namely the Lempangang village community consisting of three hamlets: Bontoboddia, Bontomanai, and Tamalalang hamlets. The research results show that friendship activities contribute greatly to creating positive social interactions between residents, increasing the sense of family, and strengthening the spirit of cooperation. Apart from being a form of appreciation, giving gifts is also a motivation for individuals to be more active in participating in competitions and joint activities. However, this study also found several challenges, such as the lack of involvement of the younger generation and budget constraints, which affected the smooth implementation of activities.
