Abstract

This study aims to analyze the causes of disparities in court rulings on petitions for the annulment of child adoption decrees and to examine the legal implications regarding the rights and obligations of parents towards their children in such annulment cases. This research employs a normative juridical approach, referring to legal norms through a literature study to obtain secondary data in the form of primary, secondary, and tertiary legal materials relevant to the issue under investigation. The study adopts a descriptive approach, with data collection conducted through a literature review of relevant regulations and legal materials. The data analysis method used is qualitative. The findings reveal that the disparities in court rulings on the annulment of child adoption decrees in Decision No. 130/Pdt.G/2017/PN.Jkt.Tim, Decision No. 83/PDT/2018/PT.DKI, and Decision No. 1210 K/Pdt/2019 are due to the absence of specific regulations governing the annulment of child adoption. Consequently, judges base their legal considerations on their respective interpretations, leading to inconsistencies in rulings for similar cases. This inconsistency indicates a lack of clear benchmarks in adjudicating child adoption annulment cases. Regarding the legal implications for parental rights and obligations in cases where the annulment of child adoption is rejected by the court, this study finds that the legal relationship between both parties remains unchanged from before the annulment petition was filed. The study concludes that adoptive parents seeking to annul an adoption decree may pursue legal remedies through the judiciary, provided they present legally justifiable reasons. Therefore, the establishment of specific regulations on the annulment of child adoption is necessary to provide judges with a clear legal framework for adjudicating similar cases in the future.

Abstract

With high deforestation rates, reforestation is important to restore the ecosystem. Forest Smoothie, an international beverage company with the concept of "buying a smoothie equals planting a tree", faced the problem of lack of brand awareness on Instagram. Observation shows that their Instagram feed is monotonous and inconsistent in design, typography, and colour. This research aims to redesign Forest Smoothie's social media promotion with a modern and attractive design, using bright colours, consistent typography, and illustrations that reflect the brand's character. Using the design sprint method, this research went through the understand, diverge, decide, prototype, and validate stages. The result is an Instagram feed template that effectively attracts audience engagement. Validation through questionnaires showed positive responses regarding the recognizable concept, colour, typography readability, consistency, and interaction.

Abstract

Permasalahan yang diangkat dalam penelitian ini adalah mengapa terjadi konsinyasi ganti kerugian dalam pengadaan tanah untuk pembangunan jalan tol ruas Sigli-Banda Aceh, bagaimana prosedur pelaksanaan konsinyasi ganti kerugian dalam pengadaan tanah untuk pembangunan jalan tol ruas Sigli-Banda Aceh, apa saja faktor-faktor yang menjadi penghambat dalam pelaksanaan konsinyasi ganti rugi pengadaan tanah untuk pembangunan jalan tol ruas Sigli-Banda Aceh. Metode yang digunakan dalam penelitian tesis ini menggunakan penelitian yuridis empiris yang bersifat deskriptif. Data yang digunakan untuk menjawab permasalahan dalam penelitian ini adalah data sekunder dan data primer yang berasal dari penelitian kepustakaan dan penelitian lapangan. Hasil dari penelitian ini adalah terjadinya konsinyasi dalam pelaksanaan pembangunan jalan tol ruas Sigli-Banda Aceh karena masyarakat atau pihak yang berhak menolak nilai ganti rugi yang ditetapkan oleh KJPP, terjadinya konsinyasi juga karena banyak tanah milik masyarakat yang akan dibebaskan untuk pembangunan jalan tol bersengketa di Pengadilan, dan alasan konsinyasi lainnya karena pihak yang berhak tidak diketahui keberadaannya. Kemudian prosedur pelaksanaan konsinyasi ganti kerugian dalam pelaksanaan jalan tol ruas Sigli-Banda Aceh terjadi ketika pihak yang berhak menolak nilai ganti rugi namun tidak mengajukan keberatan ke Pengadilan Negeri, sengketa tanah, dan tidak diketahui keberadaannya, maka oleh Pelaksana Pengadaan Tanah Kanwil BPN Aceh melalui Pejabat Pembuat Komitmen Kementrian PUPR mengkonsinyasikan tanah pihak yang berhak ke Pengadilan Negeri. Selanjutnya faktor penghambat dalam pelaksanaan konsinyasi ganti kerugian untuk pembangunan jalan tol ruas Sigli-Banda Aceh, terhadap tanah yang bersengketa pihak yang berhak hanya menyanggah secara lisan sehingga tidak adanya bukti tertulis menyebabkan perkara konsinyasi tidak bisa didaftar di Pengadilan Negeri, faktor penghambat lainnya pada masa itu terdapat kekosongan hukum karena belum adanya pengaturan yang jelas seperti yang diatur dalam Pasal 114 angka. 6 huruf D Peraturan Menteri ART/KBPN Nomor 19 Tahun 2021 Tentang Penyelenggaraan Pengadaan Tanah.

Abstract

Legal protection is defined as the recognition of the dignity, honour and human rights of legal subjects based on applicable legal provisions, covering both preventive and repressive aspects. This study specifically highlights the scope of legal protection for domestic workers, especially those working abroad. The crucial issue is the absence of specific laws that regulate and protect domestic workers, both at home and abroad, which results in domestic workers being vulnerable to exploitation and human rights violations. The research method used in this thesis is normative juridical. The main approach is the statute approach, reinforced by a conceptual and comparative approach. Data was collected through document/library studies (books, regulations, journals) and supported by interviews at BP2MI and PT. Wira Usaha Kreasi. This research is descriptive and analytical, linking existing regulations with relevant legal theories. The results of the study confirm that although domestic workers are much needed, they do not have adequate legal protection due to the absence of specific laws governing them, especially migrant domestic workers. This study emphasises the importance of government support in protecting the rights of domestic workers. The main recommendation is to pass the Draft Law (RUU) on Domestic Workers in accordance with the spirit of ILO Convention No. 189 on Decent Work. The government is encouraged to provide comprehensive social security and legal protection, as well as to impose strict sanctions on P3MI (Indonesian Migrant Worker Placement Companies) that neglect their responsibilities towards migrant domestic workers.
