Abstract

Pembangunan Ibu Kota Nusantara (IKN) mengalami penolakan yang dapat menimbulkan perubahan alih fungsi lahan secara drastis. Penelitian ini merupakan penelitian yuridis normatif dengan pendekatran perundang-undangan dan teoritis, sumber data yang diperoleh dalam penelitian ini ialah data sekunder, pengumpulamn data diperoleh melalui studi kepustakaan. Hasil penelitian ini menunjukkan bahwa (1) Pembangunan Ibu Kota Nusantara (IKN) menimbulkan distorsi yang diakibatkan karena tidak optimalnya pemanfaatan dan pengelolaan hutan. Undang-Undang Nomor 3 Tahun 2022 tentang Ibu Kota Negara menerangkan mengenai tujuan pembangunan IKN. Namun, walaupun demikian LSM bidang Lingkungan Hidup mengatakan bahwa proyek besar pembangunan IKN akan memperparah kondisi ekologis IKN. (2) Perlindungan secara preventif atas Pembangunan IKN telah diatur dalam beberapa peraturan perundang-undangan seperti Undang-Undang Nomor 5 Tahun 1960 tentang Pokok-Pokok Agraria (UUPA) dan diatur dalam Peraturan Daerah Provinsi Kalimantan Timur. Akan tetapi, sampai saat ini pembangunan IKN tetap dilanjutkaan padahal secara jelas dapat berdampak langsung pada rusaknya ekosistem lokal. Mesikupun adanya regulasi yang mengatur mengenai perlindungan lingkungan dalam rencana pembangunan perlu mengupayakan mitigasi yang efektif dan berkelanjutan.

Abstract

The phenomenon of dupe culture—the trend of purchasing imitation products—has emerged as a growing consumer behaviour, particularly among younger, urban popular­tions seeking access to premium lifestyles at affordable prices. While economically viewed as a form of market inclusivity, this practice presents complex legal dilemmas, especially in the realm of Intellectual Property Rights (IPR) and trademark protection. This article critically examines how dupe culture operates within the blurred lines between inspired innovation and trademark infringement, and how Indonesian regulations respond to this challenge. Employing a normative and comparative legal approach, the study analyses regulatory gaps in trademark law and evaluates potential solutions, including ethical dupe certification, industry licensing collaborations, and consumer education. The findings suggest that an adaptive, participatory legal framework grounded in public literacy is essential to restructure duplicative practices in a way that safeguards creators' rights without stifling market dynamics. Consequently, dupe culture should not be viewed solely as a threat, but as an opportunity for IPR reform and the strengthening of the national creative industry ecosystem.

Abstract

The development of Micro, Small, and Medium Enterprises (MSMEs) in rural areas plays a strategic role in promoting local economic growth and strengthening community empowerment. This study aims to examine the contribution of MSMEs to community empowerment and to identify local potentials that can be optimized to enhance business sustainability in Cibatu Village, Garut Regency. The research adopts a qualitative descriptive approach, with data collected through field observations, in-depth interviews, and documentation. The findings indicate that MSMEs in Cibatu Village have grown by utilizing local natural resources and cultural heritage as the foundation for developing distinctive products, including traditional handicrafts and local food processing. The presence of MSMEs has contributed to increased household income, job creation, and the strengthening of local socio-economic capacity. However, several challenges remain, such as limited access to capital, low levels of digital literacy, and weak marketing networks. These constraints hinder MSMEs from expanding their market reach and improving competitiveness. Therefore, collaborative support from village governments, educational institutions, and the private sector is essential, particularly in the form of entrepreneurship training, business management assistance, and the adoption of digital technologies for marketing and distribution. The study concludes that strengthening MSMEs based on local potential can serve as a key driver of sustainable rural economic development, provided it is supported by structured, participatory, and continuous empowerment strategies.
