Abstract

Perlindungan hukum terhadap konsumen dalam bisnis start up di Indonesia yang dapat dilakukan di era modern saat ini, banyak bermunculan pengusaha muda di Indonesia yang terkenal dengan usaha star up di Indonesia saat ini rata-rata mendapat investasi dari penanaman modal asing. Di balik investasi yang di berikan oleh penanaman modal asing pada perusahaan start up, timbul pertanyaan mengenai perlindungan terhadap teknologi yang dikembangkan tersebut. Karya tulis ini bertujuan untuk mengerti bentuk perlindungan hukum terhadap teknologi yang dikembangkan oleh perusahaan start up di Indonesia yang mendapat investasi dari penanaman modal asing, kemudian memahami terjadinya suatu pengalihan teknologi kekayaan intelektual. Dalam penelitian ini digunakan metode penelitian normatif dengan menggunakan Pendekatan PerUndang-Undangan dan Pendekatan Konsep Hukum.

Abstract

Penelitian ini bertujuan untuk mengetahhui bagaimana perlindungan hukum yang didapatkan Investor Terhadap investasi bodong, serta mengetahui bagaimana tahapan proses perlindungan yang di dapatkan dalam aturan hukum yang ada di indonesia. Metode yang di gunakan dalam penelitian ini adalah metode penelitian hukum normatif yaitu metode penelitian yang dilakukan dengan mencari bahan hukum primer, sekunder, dan tersier. Hasil dari penelitian ini menyebutkan bahwa terdapat 2 macam mekanisme perlindungan hukum utama yaitu perlindungan secara preventif dan perlindungan secara represif. dalam proses perlindungan secara preventif, Investor mendapatkan perlindungan berupa sosialisasi, edukasi, literasi dan lain sebagainya. sedangkan perlindungan secara represif investor mendapatkan perlindungan hukum berupa, Restetusi, kompensansi, perlindungan kepolisian. Perbedaan dari kedua perlindungan hukum Preventif dan Represif  yaitu preventif perlindunganya di lakukan sebelum terjadinya kasus investasi bodong sedang perlindungan represif di lakukan lapabila telah ada terjadi kasus investasi bodong. Pengertia perlindungan preventif adalah bentuk perlindungan hukum yang di berikan pemerintah yang berwenanng dalam melakukan perlindungan secara literasi dan lain sebagainya sedangkan perlindungan hukum Represif perlindungan hukum berupa denda, penjara, hukuman tambahan. Dasar perlindungan hukum terhadap investor sendiri terdapat pada Undang-undang Nomor 25 Tahun 2007 Tentang Penanaman Modal.

Abstract

Digital transformation in higher education requires learning innovations that are adaptive to the characteristics of the millennial generation, especially in complex courses such as State Administration Law (HAN). At FHISIP University of Mataram, conventional lecture methods still dominate, causing boredom and low understanding of students to abstract concepts such as the principle of legality and discretion of public officials. Responding to these challenges, this service project developed VIP-HAN (Innovative Video of Learning Law of State Administration) as an interactive and easily accessible technology-based learning media. The implementation method consists of six stages: consultation with mentors, coordination with the Head of the Constitutional Law Section, collection of materials, video production using CapCut and Canva applications, socialization in class, and evaluation through Google Form questionnaires. The video material is compiled based on RPS and academic literature, with a storytelling approach and infographic animation to make it easier to understand. The evaluation showed that 85% of students found it helpful to understand abstract concepts, and 78% of lecturers appreciated the efficiency of teaching time. The discussion included technical challenges, adaptive strategies, and cross-disciplinary collaboration in content development. The project also sparked further innovations in the faculty environment, such as the development of podcasts and digital simulations by other study programs. In conclusion, VIP-HAN has proven to be effective as a hybrid learning solution that supports the digitization of legal education. Institutional support and strengthening of lecturer capacity are the key to the sustainability of this innovation in the future.

Abstract

Illegal investments in Indonesia cause substantial public losses and threaten financial system stability. This study analyzes legal threats against illegal investment operators and evaluates the effectiveness of Law No. 4 of 2023 on Financial Sector Development and Strengthening (P2SK Law) in protecting the public. Using a normative legal method with statute and conceptual approaches, the study examines legislation, legal literature, and official publications from the Financial Services Authority (OJK). Findings show that the P2SK Law explicitly prohibits unauthorized fundraising (Article 237) and imposes strict sanctions, including 5-10 years imprisonment and fines up to IDR 1 trillion (Article 305). OJK Regulations 22/2023 and 14/2024 strengthen preventive and enforcement mechanisms through integrated supervision and Satgas PASTI. The study concludes that P2SK significantly enhances legal protection and deterrence against illegal investments. Strengthening financial literacy, optimizing Satgas PASTI, and consistent law enforcement are essential for effective public protection and sustainable financial stability.
