Abstract

Rape is one of the crimes that may embody stereotype gender, likewise in Indonesian Criminal Code. However there is development conception concerning crimes of rape put forward in The Draft of Criminal Code. This study aims to determine the different provision of crimes of rape in Criminal Code and The Draft Criminal Code. The result of this study concluded that the provision of rape in the Draft Criminal Code have more advance than the provision of rape in Criminal Code. The Draft Criminal Code has renounce crime of rape base on gender by not showing woman as the only victim of rape. Furthermore the provisions of rape in the draft criminal code have asserted method of rape that not only by intercourse. Therefore the provision of crime of rape in the draft criminal code can include rape whose victim are boys or men.

Abstract

The purpose of the research is to analyze the development of interpretation against treason/Makar offense on the Penal Code in the law enforcement in Indonesia. This study is a normative legal research which refers to the foundherentism theory and the interpretation of judges theory against enforcement, the supreme court‘s Verdict No. 574 K / Pid /2012, Verdict number 38 / pid.B /2011/PN.Wmn, verdict No. 07/Pid/2015/PT.AMB. The results of the research finds out that Makar offense has various meanings, Penal Code itself does not on strictly define what Makar offense is. It results in vague norms. Therefore, the interpretation against the article 106 of the penal Code relies on the development of the interpretation of the verdict about Makar offense. So far, various verdict interprets or connect Makar offense -as stipulated in article 106 of Penal Code- with subversion, independence, separatism (martial law i.e. terrorism and armed rebellion). Conducting an independence ceremony which is not an Indonesian independence ceremony, sticking a flag other than the Indonesian flag, an oration which increase the sense of nationality other than a sense of nationality towards the Indonesian state, producing a banner to commemorate the anniversary of independence instead of the Indonesian state.

Abstract

Disahkannya Undang-Undang Nomor 27 Tahun 2022 tentang Perlindungan Data Pribadi bertujuan untuk memberikan perlindungan yang lebih komprehensif terhadap data pribadi konsumen. Perlindungan hukum terhadap data pribadi konsumen merupakan suatu rangkaian yang panjang yang dimulai dari edukasi kepada konsumen melalui sosialisasi Undang-Undang Nomor 27 Tahun 2022 tentang Perlindungan Data Pribadi, pelaksanaan transaksi digital, pengawasan terhadap lembaga keuangan seperti bank dan financial technology, hingga penegakan hukum dan penerapan sanksi kepada pelaku penyalahgunaan data pribadi konsumen. Otoritas Jasa Keuangan dan Kementerian Komunikasi dan Digital dapat memperkuat pengawasannya dengan berkoordinasi dengan Kepolisian Republik Indonesia untuk memastikan data pribadi konsumen dapat terlindungi. Tanggung jawab pelaku penyalahgunaan data pribadi konsumen dapat dijatuhkan dalam bentuk sanksi pidana, baik pidana penjara maupun pidana denda, untuk memberikan keadilan kepada konsumen yang telah dirugikan akibat penyalahgunaan data pribadi.

Abstract

This study explores the position of the statute of limitations in criminal prosecution within the legal systems of Indonesia and Malaysia, focusing on the tension between legal certainty and justice. The statute of limitations limits the time within which the state can prosecute a criminal offender. In Indonesia, including its 2023 Penal Code, there is still a time limit of up to 20 years even for serious crimes like murder. Conversely, Malaysia adopting the common law system does not impose any time limitation on the prosecution of criminal offenses, including murder. This comparison reveals fundamental differences between the civil law and common law traditions. Using a normative juridical method with statutory, comparative, and conceptual approaches, the study finds that limiting prosecution time may lead to injustice for victims of serious crimes. Therefore, it is recommended that Indonesia eliminate the statute of limitations for severe crimes, as a form of commitment to human rights protection and substantive justice. Such a move is also supported by advancements in forensic and digital evidence that allow for fair adjudication of older cases. Eliminating time limits in prosecuting serious crimes better aligns the law with the fundamental right to life and justice. Abstract

Penelitian ini bertujuan menganalisis determinasi pertimbangan hakim dalam menjatuhkan putusan terhadap anak pelaku tindak pidana narkotika di Pengadilan Negeri Mataram. Metode yang digunakan adalah yuridis normatif dengan pendekatan kasus, melalui analisis terhadap lima putusan pengadilan. Hasil penelitian menunjukkan bahwa hakim mempertimbangkan aspek yuridis, filosofis, sosiologis, psikologis, kriminologis, dan non-yuridis. Secara yuridis, anak dinyatakan bersalah tanpa alasan pembenar atau pemaaf, namun tetap dilindungi berdasarkan prinsip the best interest of the child dalam undang-undang SPPA. Pertimbangan filosofis dan psikologis menekankan pembinaan dan rehabilitasi, sedangkan faktor sosiologis dan kriminologis mencakup pengaruh lingkungan serta lemahnya pengawasan orang tua. Faktor non-yuridis seperti penyesalan, usia muda, dan dukungan keluarga turut memperkuat orientasi pembinaan. Kebaruan penelitian ini terletak pada pendekatan multidimensional yang menegaskan pentingnya keadilan korektif dan rehabilitatif dalam sistem pemidanaan anak di Indonesia.

Abstract

The Draft Criminal Procedure Code of 2025 "reverts" to using the institution of Pretrial as an instrument that implements the function of judicial scrutiny. Previously, the values of accountability were realized in the institution of Commissioner Judges and Preliminary Examining Judges. The institution of pretrial itself has been criticized from both normative and implementation aspects in the 1981 Criminal Procedure Code. This article aims to analyze the formulation of pre-trial in the Draft Criminal Procedure Code 2025. By using doctrinal research, this article argues that the pretrial formulation in the Draft Criminal Procedure Code 2025 has not comprehensively implemented the values of accountability as the crystallization of the principle of judicial scrutiny. Despite some progressive provisions, normatively, the Bill characterizes pretrial as an institution that acts post-factum and is limited to administrative functions. The formulation of pretrial still maintains a reactive function where its work is based solely on requests. In addition, the scope of pretrial proceedings formulated in the definition tends to be degraded by subsequent operational articles.

Abstract

Kitab Undang-Undang Hukum Pidana (KUHP) di Indonesia saat ini masih menggunakan warisan hukum kolonial Belanda yang tidak sepenuhnya sesuai dengan nilai dan falsafah bangsa Indonesia. Pembaharuan KUHP telah dilakukan dan KUHP Nasional baru resmi diberlakukan pada tahun 2026. Dalam konteks tindak pidana keamanan negara, KUHP lama membedakan antara makar dan pemberontakan, sedangkan KUHP baru mengintegrasikan pemberontakan ke dalam tindak pidana makar. Studi ini membandingkan pengaturan makar dan pemberontakan antara KUHP lama dan KUHP baru, menganalisis pergeseran konsep dan unsur, serta implikasinya terhadap ketentuan hukum, termasuk pengaturan niat dan tindakan kolektif. Penelitian normatif komparatif ini juga mencermati dampak pembaruan KUHP terhadap perlindungan hak asasi dan demokrasi. Hasil analisis menunjukkan KUHP baru membawa penegasan dan modernisasi konseptual makar sebagai kejahatan politik dan tindak pidana terhadap kedaulatan negara, sekaligus menimbulkan tantangan terkait kepastian hukum dan kebebasan berekspresi. Abstract

The phenomenon of infanticide involving children born out of wedlock reflects not merely individual conduct but a complex interplay of psychological pressure, social stigma, and gender inequality. This study aims to analyze the regulation of infanticide under the Indonesian Criminal Code, examine the ambiguity of the phrase “fear of being discovered by others,” and assess criminal liability from a feminist legal perspective, including the role of the biological father. This research employs a normative legal method with statutory and conceptual approaches. The findings indicate that Article 460 constitutes a delictum proprium that designates the mother as the offender based on biological conditions. However, its formulation remains partial and fails to address underlying structural factors. The phrase “fear of being discovered by others” is vague and may lead to interpretative disparities. From a feminist legal perspective, the provision reproduces gender inequality by concentrating liability on women, while the role of the biological father remains insufficiently addressed. Accordingly, reconstructing criminal liability to incorporate the role of the biological father and broader social factors is necessary to achieve gender-sensitive substantive justice.

Abstract

Coastal reclamation is a development policy intended to support economic growth, urban expansion, and investment. However, its implementation frequently causes environmental degradation, spatial conflicts, and social impacts on coastal communities, raising concerns regarding its consistency with sustainable development principles. This study aims to analyse Indonesia’s coastal reclamation policy from the perspective of sustainable development by examining the balance between investment interests and the protection of coastal ecosystems. The research employs a normative legal method using statute and conceptual approaches, supported by qualitative analysis of legislation, scholarly literature, and relevant legal documents. The findings indicate that Indonesia’s regulatory framework has formally incorporated sustainable development principles through provisions on environmental protection, licensing, and coastal management. Nevertheless, implementation remains constrained by the predominance of economic interests, weak environmental compliance monitoring, inadequate regulatory harmonisation, and limited public participation in decision-making. These challenges hinder the achievement of an appropriate balance between economic development, ecological sustainability, and the protection of coastal communities’ rights. The study concludes that coastal reclamation policies require reform by strengthening environmental oversight, improving regulatory coherence, and ensuring meaningful public participation alongside the application of the precautionary principle. Such measures are essential to align reclamation practices with sustainable development objectives and to promote environmentally sound and socially equitable coastal development.

Abstract

Penelitian ini membahas perbandingan sistem sanksi pidana antara KUHP Lama, KUHP Nasional 2023 Indonesia, dan Criminal Code Romania 2017. Tujuan makalah ini adalah untuk mengkaji perbedaan dan persamaan filosofi, struktur, serta mekanisme pemidanaan pada masing-masing sistem hukum, serta dampaknya terhadap penegakan hukum pidana di Indonesia. Metode yang digunakan adalah penelitian hukum normatif-komparatif dengan pendekatan mazhab hukum dan analisis pasal-pasal yang berlaku di ketiga kode pidana tersebut. Hasil penelitian menunjukkan bahwa KUHP Lama masih berorientasi pada keadilan retributif klasik dengan dominasi pidana penjara dan pidana mati, sedangkan KUHP 2023 mengusung paradigma utilitarian dan restoratif dengan perluasan jenis pidana dan penguatan prinsip proporsionalitas. Criminal Code Romania 2017 menampilkan sistem yang lebih modern dan humanis, menghapus pidana mati, mengedepankan individualisasi hukuman, serta mengadopsi mekanisme pengawasan dan denda yang lebih adil. Pembaruan KUHP 2023 menempatkan Indonesia pada jalur harmonisasi dengan standar global dan sekaligus mempertahankan karakteristik lokal dalam sistem pemidanaan nasional.
