Abstract

This research aims to analyze the concept of substitute heirs in Article 185 of the Compilation of Islamic Law (KHI) and its implications for the inheritance system in Indonesia. This research uses a normative juridical method with a legal political approach. This approach is used to explore the legal and policy background behind the arrangement of substitute heirs in KHI. The results show that although classical Islamic law, especially the Syafi'i school, does not recognize the concept of substitute heirs, KHI adopts a more inclusive approach. Article 185 of the KHI grants inheritance rights to descendants of heirs who have died before the testator, which is a political legal effort to achieve social justice in the context of Indonesian inheritance. Although this arrangement aims to create social justice, findings show that there are challenges in its acceptance in the community. Many Indonesians still hold strong customs and traditional understandings in the inheritance system. Therefore, more intensive socialization is needed to bridge the gap between the positive law and the local community's understanding of the prevailing inheritance system.

Abstract

The rising trend of divorce has brought significant attention to the protection of women’s rights after marital dissolution. This study explores and compares how Islamic Law, Anglo-Saxon Law, and Continental European Law regulate post-divorce rights such as maintenance during ‘iddah, mut’ah compensation, joint property division, and child custody. Employing a normative-juridical and comparative approach through library research, the study examines primary and secondary legal sources. The findings reveal that Islamic Law emphasizes spiritual and social justice grounded in maqāṣid al-sharī’ah; the Anglo-Saxon system relies on judicial discretion to adapt to individual circumstances; while the Continental European system focuses on legal certainty through codified statutes. Each system presents unique strengths and challenges in ensuring protection for divorced women, particularly in addressing patriarchal practices, legal access disparities, and emotional needs. The study advocates for an interdisciplinary and integrative approach that synthesizes the strengths of all three systems to foster a more equitable, gender-sensitive, and contextually relevant legal framework for post-divorce women’s rights.

Abstract

This research is motivated by the rapid advancement of digitalization, which has significantly impacted the resilience of Muslim families in Indonesia. Issues such as online infidelity, gadget addiction, and declining communication quality within households pose serious challenges to the values of sakinah, mawaddah, and rahmah as taught in Islam. Based on these problems, this study seeks to examine the ideal concept of sakinah, mawaddah, rahmah from the perspective of Islamic law, analyze the implications of digitalization on Muslim family resilience, and formulate strategies to safeguard family values in accordance with Islamic principles. The research employs a qualitative library-based approach, analyzing classical Islamic literature, legal regulations, national legislation, and contemporary social phenomena. The findings reveal that the concept of sakinah, mawaddah, rahmah requires contextual actualization in the digital era, while digitalization indeed poses serious implications for family stability. Effective strategies include strengthening communication, enhancing digital literacy, reinforcing religiosity, and adopting selective adaptation toward technology. Furthermore, the study contributes to the renewal of family law in Indonesia, ensuring its responsiveness to modern challenges.
