Abstract

The article is about the political movement of Islam before and after the 20th century, and its relation to the development of democracy in Indonesia. Before the 20th century, the pattern of Islam political movement was still communal in character. This social solidarity developed in social structure of agrarian society and, usually centred among charismatic leaders. The struggles against colonial government were led mostly by the local prominent figures such as in Aceh, in Central Java, and Padri War in West Sumatra. At the turn of the-20 century, the trait of Islamic movement began to change from communal form into associational and organic solidarity. Their leaders were not necessarily from local elites but they came from urban middle class. They applied modern organization practices. When in the past the relationship between the leaders and their followers was based on paternalistic type, then in the 20th century it changed in a more rational kind. The movement which was based on associational pattern made its activities expanded and left behind its former local model. In making each decision they mostly relied on democratic and deliberation ways. Hence the tradition of democracy and participation is eventually formed.

Abstract

This article focuses on the study of the government's political will in Program Keluarga Harapan (PKH) policy. The purpose of this study is trying to understand the form of political will of the central government in poverty alleviation through PKH policies. This research method uses descriptive qualitative research methods that take research objects at the district level. The findings of this study can be classified into the following: First, poverty alleviation policies through PKH correlate with improvements in the standard of living of people in terms of education, economics, and health. Second, the implementation of PKH which aims to improve the socio-economic welfare of Very Poor Households is still loaded with political interests. Third, the government's political will is still limited to aspects of policy and not yet optimal in aspects of its implementation. This study concludes that the government's political will is not correlated with increasing the welfare of beneficiaries from very poor households.

Abstract

The development of Islam in Indonesia has been integrated within social, legal, politics, and economicvalues, which is framed in any social changes. This study will be focused on the relationship betweennational political configuration and the regulation of sharia economic compilation. Based on thisassumption, I would like to propose the question, is it existence resulted by the Muslim aspiration andIslamic political party supports or more influenced by global economic changes? This study is part ofpolitical law as well as sharia economic of political law. The institutionalization of sharia economic lawis a necessity because of several reasons: First, the highly awareness of muslim to implement shariavalues in a life that are popular and socialized; Second, the growth of sharia financial institutions, bothsharia banking and non-banking institutions, and Third, the existence of sharia regional provisions(Perda Syariah).There is highly significant correlation at national and international political changestowards sharia economic law institutionalized as well as the existence of Islamic political parties orpolitical parties based on Muslims. Finnaly, the institutionalization of sharia economic law can not beseparated from the existence of Indonesia Muamalat Bank (BMI) in 1991 that regulated under the Lawof Banking Number 7 of 1992 and the Goverment Regulation Number 72 of 1992. These regulationsare introducing the principle of profit and loss-sharing in sharia bank. In refomulation period, theGoverment has amanded that Law Number 21 of 2008. Because of these regulations, sharia bank ismore improve and implements many principles such as Sharia Insurance, Rahn, Mutual Funds, CapitalMarkets, Financial Corporates based on sharia principles, etc.

Abstract

Tulisan ini akan menjelaskan tentang polemik tentang sistem pemerintahan yang beragam mulai dari masa Rasulullah SAW. yang hingga masa sekarang. dalam konteks siyasah/politik Islam muncul pula tarik-menarik pemikiran konsep kekuasaan yang mengkutubkan antara hak Allah dan Hak manusia. Pemi­kiran politik Islam yang direduksi dari konsep kesejarahan dan penafsiran terhadap teks-teks wahyu syarat dengan multi tafsir dan perdebatan, sehingga berujung pada tipologi paradigma ilmu politik Islam. Oleh karena itu, tulisan ini secara ringkas akan memaparkan bagaimana dinamika pemikiran tentang politik Islam dalam ranah fiqih al-syasah.

Abstract

AbstrakUndang-Undang Dasar 1945 berkomitmen melindungi warga Negara, termasuk anak-anak, sebagaimana ditegaskan Pembukaan UUD 1945, selanjutnya dijabar­kan dalam pasal-pasal Batang Tubuh., Pasal 28 B ayat (2) Secara eksplisit tentang penyelenggaraan hak anak. Dimulai dari Deklarasi Jenewa pada tahun 1924 kemudian dicantumkan dalam Piagam PBB 1948 perlindungan anak dalam hukum Islam di kenal dengan hadanah atau pemeliharaan anak sebagaimana Kompilasi Hukum Islam (KHI), Orang  tua wajib memelihara dan mendidik anak, jika melalaikan kewajiban terhadap anak maka kekuasaannya atas seorang anak atau lebih untuk dapat dicabut. Penelitian ini merupakan penelitian kepustakaan (Library Research) dengan pendekatan kualitatif. Metode yang digunakan dalam penelitian ini adalah meode deskriptif analisis, dalam bentuk analisis isi (content analysis). Amanah berarti jujur atau dapat dipercaya. Ibn Al-Araby menyatakan segala sesuatu yang diambil dengan izin pemiliknya. Amanah dalam hukum keluarga sebagai faktor utama terciptanya kesejahteraan dengan amanah semua komponen bangsa akan berlaku jujur, tanggung jawab dan disiplin dalam setiap aktifitas kehidupan. Eksistensi anak sebagai pelanjut pengembangan misi agama dan misi negara perlu dikawal dengan penegakan aturan  yang melindunginya, sebab anak-anak termasuk kelompok lemah dan rawan dari perlakuan eksploitatif kaum dewasa. Penerapan dan transformasi hakikat amanah, konsep dan prinsip-prinsip perlindungan anak dalam perundang-undangan perlindungan anak belum terumus secara jelas Realitas Pelaksanaan dan penegakan hukum perlindungan anak, "keluarga" diartikan dengan sanak saudara; kaum kerabat Masa remaja merupakan periode transisi dari anak menuju dewasa. Pada usia ini kerap ditemukan perilaku berisiko yang bisa jadi mengarah ke tindakan kriminal. Kenakalan remaja merupakan perilaku menyimpang yang dilakukan sesearang usia 14-19 tahun yang menimbulkan masalah atau keonaran dalam masyarakat yang disebabkan orang tua tidak amanah.

Abstract

Correct understanding of the basic elements in Islamic political economy is a necessity for its development. This writing attempts to trace the conceptual understanding of the basic elements of science, including the views and epistemology of Islamic economic politics in a country. His position in constructing the methodology of Islamic political economy to become the main topic. So that there are differences in the aims of epistemology and the framework of the methodology of Islamic political economy with the West. The consequences of these differences lead to differences in science. At the practical level, this gives rise to differences in determining policies. Meanwhile, logic, coherence and consistency are important prerequisites for a scientific approach. Islamic economic politics must be studied through its own epistemological view. However, on the other hand, we cannot deny the role and position of political science and economics today in the process of developing Islamic political economy. The study of political-economic epistemology covers the role of the state in the economy, especially in terms of public policy. Keywords: Epistemology, Islamic Political Economy, State Economy

Abstract

This research analyzes international trade through the Heckscher-Ohlin political model towards national economic interests from an Islamic economic law perspective. This research uses qualitative methods with a text analysis approach. The data used is secondary, regarding the relationship between international trade, economic policy and national economic welfare. The research results show that the Heckscher-Ohlin (HO) theory is the main basis for studying the economics of international trade. This theory emphasizes differences in the scarcity of production factors between countries as the main factor influencing trade patterns. The main production factors in this theory are labor and capital. This difference in the scarcity of production factors encourages specialization in production, which helps increase the efficiency of resource allocation. Comparative advantage is basic in HO theory, where countries focus on producing goods they are able to produce at lower costs. This analysis also carries the HO Theory with Islamic economic law, which emphasizes the fairness of wealth distribution, business ethics, integrity, social welfare, balance and social justice, as well as individual moral responsibility in international trade. By combining these two approaches, international trade can provide sustainable economic and social benefits and is in accordance with Islamic ethical values.

Abstract

This research starts from the fact that shows the high divorce rate in Indonesia, this is evidence of the absence of household harmony that is not sufficient before entering into marriage, so the State is responsible as ordered by law, for the welfare of its people, making their households happy and eternal, that is where the State must be present and act to realize the households of its people happy and prosperous, one of which is by establishing premarital education early on as a concrete step to reduce the high divorce rate in Indonesia. The purpose of this study is to determine and analyze the optimal function of BP4 in tackling the divorce rate, the divorce rate in the PTA Bandung area 2017 to 2022, the function of BP4 in relation to the competence of judges, and BP4's efforts to reduce the divorce rate in the PTA Bandung area. The results of this study indicate that, First, Optimizing the Function of the Marriage Counseling, Guidance, Preservation Agency in relation to the high divorce rate in the Bandung PTA area, including: enhancing and improving the quality of marriage and happy families, preventing underage marriage, preventing unhealthy polygamy, and providing information advice in guidance to those concerned about Nikah, Talak and Rujuk (NTR) issues, especially for broken home households.

Abstract

The legal system in economics related to the national consensus on welfare is quite complex due to the existence of various legal and political analyses. This research focuses on economic and legal domains related to Indonesia's economic challenges. One thing that is important in politics is the importance of ethics and morality. Ethical considerations of government tend to operate more efficiently. When government officials have strong moral convictions, they take action and defend their integrity. This undermines honesty, integrity, and good judgment when performing government functions. In order to realize the goals of the country, professional and ethical state administrators are needed in order to carry out their functions and duties efficiently and effectively. To realize a professional state administrator, each state administrator must meet the requirements as a state administrator as specified in laws and regulations, while to realize an ethical state administrator, it is necessary to regulate ethics in laws and regulations. The arrangement must be general in nature so that it applies to every state administrator.

Abstract

This study aims to investigate the relevance of the principles of Islamic economic law in shaping social justice through equitable economic distribution. In the midst of global economic change, reducing economic inequality and social injustice is very important. Islamic economic law, as a framework rooted in Islamic values, offers a unique view of economic distribution that focuses on the principle of justice. By conducting an in-depth literature review and analysis, this study explores the concept of Islamic economic law, the principles contained in it, and its relevance to the goal of achieving social justice. We identify the important role of zakat, infaq, and waqf in creating equitable distribution and fueling inclusive economic growth. The results of this study show that the principles of Islamic economic law have great potential to influence economic and social policies in Islamic societies, ultimately encouraging the creation of a more just and inclusive economic environment. However, we also identified some obstacles to the implementation of these principles. This research makes an important contribution to our understanding of how the principles of Islamic economic law can be applied in the current context to promote social justice as well as more equitable economic distribution. The policy recommendations that emerge from the results of this study can guide decision-makers in their efforts to achieve social justice in Islamic societies.
