Abstract

There are different points of view that cause unrest in the community related to the certainty of law enforcement of palm oil theft in Indonesia. The weak law enforcement against palm oil theft is due to the issuance of Supreme Court Regulation Number 2 of 2012 concerning the Adjustment of the Limits for Minor Crimes which translates the value of currency in article 364 of the Criminal Code and others which was originally IDR 250 read into IDR 2,500,000. Laws, Theft, Plantations. This has become a polemic in the community because it has implications for the many acts of palm oil theft whose loss value is not more than the provisions mentioned above so that it does not entangle the perpetrators and does not provide a deterrent effect to the perpetrators of palm oil theft. On the other hand, this Supreme Court Regulation can be overridden by Law Number 39 of 2014 concerning Plantations which can ensnare perpetrators of oil palm theft if the perpetrators harm the Legal Entity Plantation. It is reviewed in several decisions of the Rantauprapat District Court, that there is a verdict against the perpetrators of palm oil theft whose loss value is not more than Rp 2,500,000, but the verdict is sentenced to 6 months in prison. This consideration refers to article 107 letter d of Law Number 39 of 2014 concerning Plantations.Keywords: Law Application, Theft, Plantation

Abstract

The disparity in the application of the law against perpetrators of theft of plantation products is a law enforcement problem that must be resolved in order to create a sense of justice, certainty and legal benefits. The purpose of this research is to be a reference for law enforcers in applying fair, certain and useful rules. This research is an analytical descriptive research with a type of qualitative research that examines and analyzes references to journals, books, laws and regulations, and considerations of judges' decisions. The clear conclusion is that there is a disparity in the perspective of judges in imposing legal decisions on perpetrators of theft of plantation products. The disparity in judges' decisions in plantation theft cases reflects various challenges in the justice system. Factors such as variations in evidence, differences in legal interpretation, local social influences, and the quality of law enforcement play an important role in creating uncertainty. To achieve better justice and consistency in decisions, reforms in the justice system are needed, including improving the quality of law enforcement, especially judges. Thus, it is hoped that justice for victims can be achieved, and the justice system can be more trusted by the community.Keywords: Disparity; Plantation Products; Theft;

Abstract

Abstrak Penelitian ini bertujuan untuk menganalisis faktor-faktor yang mempengaruhi keberlanjutan UMKM di Kabupaten Labuhanbatu, dengan fokus pada kepatuhan hukum perizinan, promosi melalui media sosial, dan persepsi nilai konsumen. Data dikumpulkan dari 150 pelaku UMKM di daerah tersebut, dan analisis dilakukan menggunakan regresi linier untuk menguji pengaruh variabel-variabel tersebut. Hasil penelitian menunjukkan bahwa ketiga variabel memiliki pengaruh signifikan terhadap keberlanjutan UMKM, dengan promosi media sosial memiliki pengaruh paling besar. Hasil uji simultan juga menunjukkan bahwa ketiga variabel berkontribusi secara bersama-sama dalam mendukung keberlanjutan usaha UMKM. Penelitian ini menyarankan agar pelaku UMKM meningkatkan kepatuhan terhadap regulasi hukum, memanfaatkan media sosial untuk promosi, serta meningkatkan persepsi nilai produk untuk mempertahankan daya saing dan keberlanjutan usaha mereka. Kata Kunci: Kepatuhan Hukum Perizinan, Promosi Media Sosial, Persepsi Nilai, Keberlanjutan UMKM AbstractThis study aims to analyze the factors influencing the sustainability of SMEs in Labuhanbatu Regency, focusing on legal compliance, social media promotion, and consumer value perception. Data was collected from 150 SME owners in the region, and analysis was conducted using linear regression to examine the impact of these variables. The results show that all three variables have a significant influence on SME sustainability, with social media promotion having the most substantial impact. The simultaneous test results also indicate that these three variables collectively contribute to the sustainability of SMEs. This study suggests that SME owners should enhance legal compliance, leverage social media for promotion, and improve consumer value perception to maintain competitiveness and ensure long-term business sustainability. Keywords: Sustainability, Legal Compliance, Social Media Promotion, Consumer Value Perception, Business Continuity, Labuhanbatu Regency.

Abstract

Termination of Employment is a legal action that may be undertaken by an employer against an employee under certain conditions, including violations of workplace discipline. One controversial case involves the dismissal of an employee found consuming tuak (a traditional alcoholic beverage). This study aims to analyze the legal aspects of such termination based on Indonesian labor regulations and contributes to a broader understanding of cultural context in the enforcement of labor law in Indonesia. The research employs a normative juridical approach, using literature review and case analysis. The findings indicate that termination of employment due to the consumption of tuak can only be legally justified if the act occurred during working hours, within the workplace, or demonstrably affected job performance and workplace safety. Termination is deemed unlawful if it does not follow the prescribed procedures or lacks sufficient evidence of serious misconduct as stipulated in the company's internal regulations. Therefore, any termination decision must take into account the principles of fairness, proportionality, and legal certainty for both parties.Keywords: Tuak; Company; Termination of Employment

Abstract

The rapid growth of digital banking in Indonesia has necessitated robust legal frameworks to protect digital bank users. This study examines the legal protection available to digital bank customers, focusing on the confidentiality of personal data and the responsibilities of banks under Indonesian law. Utilizing a normative juridical research method, the study relies on library research and an analysis of relevant laws and regulations. The findings reveal that the current legal framework for safeguarding the confidentiality of bank customer data in Indonesia is fragmented and lacks a unified regulatory approach. Legal protection remains incomplete, as it relies on the interplay of multiple regulations without offering comprehensive safeguards. Moreover, the existing mechanisms for addressing breaches of data confidentiality place responsibility primarily on banks, with criminal and administrative liabilities serving as the main avenues for recourse. The novelty of this research lies in its critical evaluation of the gaps in Indonesia's regulatory landscape concerning digital banking, highlighting the need for a cohesive legal framework to ensure stronger protections for customer data. This study contributes to the discourse on digital banking regulation by providing a nuanced understanding of the challenges in safeguarding customer data in Indonesia. It offers valuable insights for policymakers, legal practitioners, and financial institutions in enhancing data protection measures and fostering trust in digital banking.
