Abstract

Sebuah negara dikatakan berdemokrasi ketika dijalankannya sistem pemilihan umum. Begitupun dengan Indonesia yang sepanjang perjalanan pasca kemerdekaan telah menjalankan sistem pemilihan umum baik legislatif juga eksekutif dengan beragam formula dan perubahannya. Indonesia kemudian mulai berbenah sistem ketatanegaraan dengan didahului pada amandemen konstitusi yakni pada masa refromasi tahun 1998. Dalam perubahan konstitusi konstruksi pemilihan umum khususnya pada pemilihan presiden dan wakil presiden mengalami perubahan yang cukup signifikan. Hal ini dapat dilihat dari masa jabatan presiden, sistem pemilihan, asal presiden sampai pada proses pemberhentian. Sayangnya, perubahan konstitusi tidak berbanding lurus pada pelaksanaan undang-undang pemilu. Undang-undang pemilihan umum khususnya untuk presiden dan wakil presiden kian hari mengalami pasang surut nilai demokrasi. Lantas bagaimana melihat pasang surut demokrasi dalam pemilihan umum presiden dan wakil presiden di Indonesia. Metode penulisan ini adalah yuridis normatif dengan teknik pengumpulan dengan data kepustakaan. Jenis data yang digunakan adalah data sekunder yang kemudian dianalisa secara deksriptif kualitatif. Pasang surut demokrasi dalam pemilihan presiden dan wakil presiden di Indonesia ini kemudian penulis kaji menggunakan tiga kategori sebagai pisau Analisa, dengan hasil dan kesimpulan sebagai berikut. Pertama ambang batas pemilihan umum presiden dan wakil presiden untuk menjadi pintu masuk dalam penyederhanaan partai politik demi penguatan system presidensial menjadi tidak tepat. Kedua; terkait konstruksi parpol Indonesia. Bahwa penyederhanaan partai politik harus memperhatikan alasan-alasan fundamental yang tidak dapat terlepas dari. Ketiga; terkait dengan produk hukum pemilihan umum, maka undang-undang pemilihan umum dari masa ke masa mengalami proses kemunduran demokrasi.

Abstract

This study aims to analyze the legal protection afforded to fixed-term employment contract workers under Law Number 6 of 2023, which introduces significant changes to the legal framework governing fixed-term employment in Indonesia. Focusing on working conditions and compensation, this research employs a normative legal research method with a statute approach and utilizes qualitative analysis with a content analysis approach. The findings reveal that Law Number 6 of 2023 establishes a new paradigm in protecting fixed-term employment contract workers by affirming their right to wages during probationary periods, providing flexibility in contract renewals, and regulating the provision of compensation. However, implementing this Omnibus Law also presents new dynamics and challenges, such as the potential for job insecurity due to excessive flexibility in contract extensions. A case simulation further exposes the gap between legal norms and the reality on the ground, where some companies still neglect their obligation to compensate fixed-term employment contract workers. These findings underscore the urgent need for commitment and active participation from all stakeholders, including the government, companies, and workers, in realizing harmonious, productive, and equitable industrial relations.

Abstract

This study aims to analyze the authority of debt collectors from a civil law perspective, focusing on a case study of PT Mega Central Finance Bagan Batu. To achieve this objective, this study employs a mixed method of field research and normative legal research, where the collected data is analyzed qualitatively to describe the problems and answer the research objectives. The results show that the problem of bad credit encourages financing companies to use debt collectors’ services to optimize the collection process. Meanwhile, debt collectors must have competency certification and act based on an extraordinary power of attorney from the financing company, as regulated in Financial Services Authority Regulation Number 35/POJK.05/2018 and Article 1795 of the Civil Code. Despite having compiled a standard operating procedure for collection, PT Mega Central Finance Bagan Batu still encounters deviant debt collector practices that harm debtors, such as intimidation, threats, and seizure of collateral without legal procedures. These actions violate the rights of debtors and legal principles. The legal consequences and implications cover criminal law, civil law, consumer protection law, and administrative sanctions from the Financial Services Authority.

Abstract

We often hear and see a series of cases related to the sale of Expired Products in the Market on television, almost all of which report on fraud committed by business actors in trade to deceive consumers as buyers of goods. This is not impossible to add to the series of similar cases, if the government does not take part in overcoming the circulation of expired products. The objectives of this study include: wanting to know how business actors are responsible for the circulation/sale of Expired Food and Beverage products and how to protect consumers against expired food and beverage products circulating in the market and consumed by consumers based on Law Number 8 of 1999 concerning Consumer Protection. The type of research used is normative research, while the approach uses a statutory approach. This study uses primary and secondary legal materials. Research Results and Discussion: First, the responsibility of business actors for dishonest trade towards consumers is through compensation with a refund of an amount of money according to the nominal traded, if the consumer has not yet consumed it, if they have consumed the consumer goods, and it has a bad effect on the consumer's health such as poisoning, or causes health problems, then the responsibility of the business actor will be greater, namely health recovery. according to Article 19 paragraph (2) of Law Number 8 of 1999. Second, Legal Protection for consumers has not been fully realized as stated in Law Number 8 of 1999 concerning consumer protection. This can be seen from the many business actors found in the market who are still distributing expired food and beverage products without supervision from the government and related agencies. The application of criminal penalties which is still not complete, of course, will not provide a deterrent effect for dishonest and fraudulent business actors.
