Abstract

This research analyzes the application of justice principles in the resolution of civil disputes at Indonesian district courts. Employing a qualitative approach, the study examines 15 civil case decisions from five major district courts between 2020 and 2024, complemented by interviews with judges, lawyers, and litigants. The findings reveal that the pursuit of procedural certainty often overrides substantive justice, with strict adherence to procedural rules sometimes resulting in the dismissal of valid claims. Cultural factors, such as the integration of adat (customary law), further complicate the consistency of judicial decisions, particularly in inheritance and land disputes. Additionally, external pressures—including corruption and political influence—pose significant challenges to impartial adjudication. These complexities highlight a persistent tension between legal certainty and fairness in Indonesia’s civil justice system. The study recommends targeted judicial training focused on balancing procedural and substantive justice, enhanced oversight by the Judicial Commission, and reforms to allow greater judicial discretion in procedural matters. By providing an in-depth examination of district court practices, this research contributes to a better understanding of the systemic barriers to achieving justice in Indonesian civil litigation and offers practical recommendations for reform. The findings underscore the importance of aligning legal procedures with the fundamental goal of delivering fair and equitable outcomes for all parties involved.

Abstract

Existing business law regulations are still based on conventional models, so they are not fully relevant to digital dynamics. MSMEs have a strategic role in the Indonesian economy. However, the great potential of these MSMEs is often hampered by various factors, one of which is the weak legal support of businesses that can protect and empower them in the digital era. Competition between MSMEs and large companies has become increasingly sharp in this era. The problems in this study are formulated as follows: how the current non-conformity of business law regulations affects the competitiveness of MSMEs in the digital era, and what are the main challenges faced by MSMEs in accessing legal protection, access to capital, and digital market opportunities?, what are new regulatory models that can be designed to support the strengthening of business laws for MSMEs in the digital era, so that they can increase their competitiveness effectively and sustainably? The research will use an analytical descriptive research method approach to obtain comprehensive results. Primary data was collected through a survey of 100 Business Actors and in-depth interviews with 10-15 selected participants (Consumers). Normative-empirical Legal Approach. Normative approach: ustaka study on the Job Creation Law, ITE Law, Ministerial Regulation related to MSMEs and digitalization, academic literature and legal journals. Empirical approach: Interviews with MSME actors, local governments, MSME Associations, and business law experts. Field observation on MSME digital business practices, and filling out questionnaires. This research shows that there is a discrepancy between the current business law regulations and the real needs of MSMEs in the digital era, especially in North Sulawesi. The applicable regulations have not been able to provide adaptive, inclusive, and applicable legal protection in facing the challenges of digital transformation. Digitized MSMEs face obstacles in the form of legal uncertainty, limited access to regulatory information, and lack of legal support from local governments. To answer these problems, a new regulatory model is needed that is modular, adaptive to technology, and based on sectoral needs. This model must be developed through a participatory approach, which combines legal doctrinal studies with direct input from MSME actors as the main subject. The implementation of this new regulation must also be accompanied by strengthening digital legal literacy and providing access to easy, cheap, and digital-based legal assistance.

Abstract

Tujuan penelitian ini adalah menggali dan memahami dinamika kebebasan beragama di Indonesia, yang terikat erat dalam kerangka konstitusional dan politik hukum, serta pengaruhnya terhadap kestabilan sosial. Penelitian ini menggunakan metode hukum normatif dengan pendekatan filosofis dan analitika untuk mengkaji peraturan perundang-undangan dan praktik penegakan hukum yang berlaku. Analisis meliputi penggunaan isu agama dalam politik populisme dan implikasinya pada kebebasan beragama, serta peran pemerintah dan lembaga hukum dalam menjaga keseimbangan antara kebebasan beragama dan stabilitas sosial. Hasil penelitian menunjukkan bahwa politik identitas dan narasi politik populisme sering kali menciptakan polarisasi dalam masyarakat, yang dapat mengancam prinsip-prinsip demokrasi dan keharmonisan sosial. Upaya-upaya penguatan lembaga demokrasi dan hukum, serta pendidikan pluralisme, diperlukan untuk memastikan bahwa kebebasan beragama tidak berubah menjadi sumber konflik.

Abstract

Di masa pandemi Covid-19 menimbulkan kejahatan baru yaitu pemalsuan surat Polymerase Chaim Reaction (PCR) negatif Covid-19. Tindakan ini dilakukan untuk mencari keuntungan dari berbagai pihak. Tindakan pemalsuan surat PCR negatif Covid-19 ini dapat dikenakan sanksi atau hukuman yangmana telah tertuang dalam Pasal 263 sampai dengan 268 KUHP. Tujuan dari penulisan artikel ini adalah untuk menganalisis penegakan hukum terhadap oknum yang melakukan pemalsuan surat PCR negatif Covid-19 di masa pandemi. Metode yang digunakan dalam penelitian ini adalah normatif yuridis. Data yang digunakan dalam penelitian ini merupakan data yang diambil dari studi kepustakaan dan dianalisis secara kualitatif serta dijabarkan dengan penjelasan deskriptif. Hasil dari penelitian ini adalah pemalsuan surat PCR negatif Covid-19 merupakan tindakan kejahatan yang merugikan. Dimana kejahatan tersebut diperlukan adanya tindak pidana yang diatur dalam Pasal 263 KUHP dengan hukuman pidana 6 tahun penjara. Serta bagi tenaga medis yang diketahui melakukan pemalsuan surat PCR negatif Covid 19 akan dikenakan sanksi Pasal 267 KUHP dengan hukuman pidana penjara selama 4 tahun dan sanksi kode etik kedokteran berupa sanksi administratif yang diberikan berdasarkan berat pelanggaran yang dilakukan. Selanjutnya bagi orang yang diketahui menggunakan surat PCR negatif Covid-19 palsu dari dokter akan dikenakan hukuman pidana selama 4 tahun berdasarkan Pasal 268 KUHP.
