Abstract

Penerapan metode Omnibus Law dalam Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan bertujuan untuk menyederhanakan regulasi yang tumpang tindih dan meningkatkan efisiensi hukum di sektor kesehatan. Penelitian ini mengangkat dua permasalahan yakni Bagaimana Bentuk Penyederhanaan Regulasi Melalui Metode Omnibus Law Dalam Undang-Undang Nomor 17 Tahun 2023 Tentang Kesehatan? Dan Bagaimana Konsep Penyederhanaan Regulasi Dalam Pembentukan Peraturan Perundang-Undangan di Masa Mendatang? Dengan menggunakan Teori Negara Hukum dan Teori Perundang-undangan. Metode penelitian menggunakan jenis penelitian Yuridis-normatif, dengan pendekatan perundang-undangan, pendekatan kasus, pendekatan konseptual dan pendekatan analitis yang diambil dari sumber bahan hukum primer, sekunder dan tersier. Sedang Teknik Pengumpulan bahan-bahan hukum dilakukan dengan cara mengidentifikasi dan menginventarisasi aturan hukum positif dengan Teknik analisis bahan hukum yang digunakan dalam penelitian ini Penafsiran gramatikal dan sistematis. Hasil Penelitian ini bahwa dalam Penerapan Metode Omnibus Law sebagai Penyederhanaan Regulasi, Metode Omnibus Law dalam Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan merupakan perwujudan dari konsep penyederhanaan regulasi yang sesuai dengan Undang-Undang Nomor 13 Tahun 2022. Metode ini memungkinkan penyusunan peraturan dengan menggabungkan, mengubah, atau mencabut beberapa regulasi dalam satu undang-undang guna menciptakan sistem hukum yang lebih terpadu dan efisien dan dalam Asas Legalitas dan Implikasi dalam Sistem Hukum Indonesia, Penggunaan Omnibus Law dalam UU Kesehatan telah memenuhi asas legalitas yang menjadi dasar penyelenggaraan administrasi pemerintahan. Namun, penerapannya lebih umum di negara dengan sistem Common Law, sedangkan Indonesia yang menganut Civil Law lebih dikenal dengan kodifikasi dan unifikasi hukum. Oleh karena itu, Omnibus Law dapat berfungsi sebagai Undang-Undang Payung (Umbrella Act) untuk menciptakan keselarasan hukum dan mencegah tumpang tindih regulasi.

Abstract

Article 6A paragraph (5) of the 1945 Constitution of Indonesia affirms the principle of open legal policy by stipulating that the procedures for the election of the President and Vice President must be regulated by law. This provides space for the legislature to regulate various provisions related to elections, while the Constitutional Court acts as an interpreter of the constitution. This study aims to analyze the application and suitability of the concept of open legal policy in the Constitutional Court Decision Number 90/PUU-XXI/2023 concerning the age limit of candidates for President and Vice President. The study employs normative legal research techniques with a qualitative juridical analysis perspective, utilizing secondary data, tertiary legal resources, and primary data for reinforcement. The theory of authority and trias politica (division of powers) is used to analyze the examined decision. The results showed that the Constitutional Court in Decision No. 90/PUU-XXI/2023 was inconsistent in deciding cases, even though the articles tested were the same and the legal considerations and rulings were similar. Therefore, it is recommended that the Constitutional Court be more consistent in issuing decisions, especially those related to open legal policies. Strengthening the capacity of Constitutional Court judges is also needed to better understand the authority and division of powers within the framework of the 1945 Constitution of the Republic of Indonesia. In conclusion, the application of the concept of open legal policy needs to be implemented consistently and wisely to maintain legal stability in Indonesia.

Abstract

   ABSTRAKTulisan ini mengkaji gagasan dan peluang pembentukan peraturan perundang-undangan berupa undang-undang tentang sistem peradilan keluarga di Indonesia. Meskipun Indonesia telah mengundangkan Undang-Undang Nomor 23 Tahun 2004 tentang Penghapusan Kekerasan Dalam Rumah Tangga, berbagai studi menunjukkan bahwa perempuan dan anak dalam keluarga masih menghadapi berbagai kendala dalam memperoleh keadilan. Landasan teori yang digunakan dalam kajian ini adalah teori dan praktik hukum feminis atau yurisprudensi feminis atau kajian hukum feminis atau hukum berperspektif feminis sebagai alat analisa kritik terhadap norma dan praktik hukum menyangkut keluarga terkait perempuan dan anak di Indonesia; hukum hak asasi manusia khususnya sebagaimana diatur dalam The Convention on the Elimination of all Forms of Discrimination Against Women (CEDAW) sebagai konvensi internasional hak asasi bagi perempuan; serta teori perundang-undangan termasuk norma perundang-undangan yang saat ini berlaku di Indonesia, yaitu Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-Undangan dalam kaitan mendorong gagasan pembentukan undang-undang tentang sistem peradilan keluarga.  Kata Kunci: pembentukan peraturan perundang-undangan, hak asasi perempuan, CEDAW. ABSTRACTThis paper examines the idea and chance of establishing legislation in the form of a Law concerning Family Court in Indonesia. Studies show that despite the enactment of Law Number 23 Year 2004 concerning The Elimination of Domestic Violence, women and children in the family are still facing difficulties and challenges in accesing justice. The analysis of this paper uses feminist legal theory and practices or feminist jurisprudence or feminist legal studies as basis for analyzing criticism of legal norms and practices concerning marriage and family in Indonesia; human rights law in particular The Convention on the Elimination of all Forms of Discrimination Against Women (CEDAW) as an international bill of rights for women; and theory of legislation including law regulates the formulation of regulations (Law Number 12 Year 2011 concerning The Establishment of Legislation) as the basis to promote the formulation of Law concerning Family Court in Indonesia. Keywords: formation of legislation, women's human rights, CEDAW.

Abstract

The current development of information technology has certainly had a huge influence on social life in Indonesia. With such rapid progress in the field of technology and information, it is like a double-edged sword because apart from having a positive impact, it can also have a negative impact, one of which is the emergence of cybercrime online dissemination of personal data. The research method used is a normative juridical research method, while technical data analysis uses a statutory approach and a case approach, as well as using legal protection theory and punishment theory. The problem formulation taken is how to regulate cybercrime victims disseminating personal data online in Indonesia and what legal protection there is for cybercrime victims disseminating personal data online in Indonesia. The research results showed that legal protection for cybercrime victims of online dissemination of personal data in Indonesia has been regulated based on Law no. 1 of 2024 concerning the Second Amendment to Law Number 11 of 2008 concerning Information and Electronic Transactions (ITE Law), whose criminal sanctions prioritize punishment for the perpetrator only to provide a deterrent effect, and have not provided a direct impact or benefit for the victim. And in order to provide human rights protection for cybercrime victims of online distribution of personal data in Indonesia, apart from being subject to imprisonment and/or fines, perpetrators may also be subject to additional penalties in the form of confiscation of profits and/or assets obtained or proceeds from criminal acts. , and payment of compensation for victims, such as additional criminal sanctions for confiscation of profits and/or assets obtained or proceeds from criminal acts and payment of compensation for victims. Thus, to realize the Integrated Criminal Justice System, law enforcers not only impose prison sanctions and/or fines on perpetrators, but can also impose additional criminal sanctions which can have a direct impact or benefit for victims. And the House of Representatives and the President need to revise the ITE Law, especially by adding additional criminal provisions in the form of confiscation of profits and/or assets obtained or proceeds from criminal acts and payment of compensation. So that this law can really provide better legal protection and can also be felt directly by victims of cybercrime spreading personal data online in Indonesia
