Abstract

Sektor pertambangan mineral dan batubara masih menjadi lokomotif pemasukan negara, sehingga rezim perizinan tambang terus disederhanakan demi menarik investasi baru. Digitalisasi perizinan melalui Online Single Submission Risk‑Based Approach (OSS RBA) diharapkan mempercepat layanan publik, tetapi justru berpotensi mengurangi ruang keberatan masyarakat jika tidak disertai mekanisme verifikasi hak ulayat. Penelitian bertujuan untuk menguji simplifikasi prosedur perizinan benar‑benar meningkatkan efisiensi tanpa mengorbankan keadilan agrarian tau justru memperdalam ketimpangan struktur penguasaan sumber daya alam. Penelitian ini berkaitan tentang hukum normatif dengan pendekatan konseptual dan perbandingan pustaka, yang bertujuan untuk mengkaji secara mendalam ketidakharmonisan regulasi antara Undang-Undang Nomor 4 Tahun 2009 tentang Pertambangan Mineral dan Batubara (UU Minerba) dan Undang-Undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria (UUPA), Sistem OSS RBA sebagai instrumen digital perizinan membutuhkan reformulasi mendasar agar dapat memenuhi prinsip-prinsip good governance secara substantif. OSS harus dibangun di atas prinsip keadilan sosial dan agraria, bukan sekadar efisiensi administratif. Jika tidak, sistem ini akan terus menjadi alat legal-formal yang melegitimasi ketimpangan dan memperparah konflik di daerah-daerah yang kaya sumber daya, tetapi miskin pengakuan hak rakyat seperti Wawonii dan daerah lainnya di Indonesia.

Abstract

Food security reflects the extent to which a country or region is capable of providing sufficient, safe, and nutritious food for its entire population. Efforts to strengthen food security are of vital importance in realizing a safe, healthy, and prosperous society. In the context of national development, food security has become one of the main priorities, which undoubtedly requires active support from local governments. This is closely related to the fulfilment of the right to food, which is a fundamental right of every citizen. The issue addressed in this study concerns the forms of food governance implemented by local governments to support food security at the local level. To address this issue, a normative legal research method is employed to examine the policy directions of local governments in ensuring the availability of food that is both adequate and accessible to the community. In ensuring the sustainable fulfilment of food needs, local governments play a strategic role in managing the food system within their regions. This role is realized through policy formulation, regulatory development, and the implementation of programs based on local potential. Thus, local governments can serve as key actors in promoting equitable and sustainable national food security.
