Abstract

The digital era presents both challenges and opportunities for the oversight function of the Indonesian House of Representatives (DPR RI). The complexity of government and increasing data volumes demand innovation in oversight mechanisms. This qualitative research, based on secondary data analysis from academic journals, government reports, international organization publications, and other relevant sources, explores the potential for utilizing Artificial Intelligence (AI) to optimize the legislative oversight function and improve the transparency and accountability of the Indonesian government. The results of the analysis show that AI can be applied in various areas of oversight, such as budget analysis, monitoring the implementation of laws and policies, and managing public aspirations, through technologies such as Natural Language Processing and Machine Learning. The use of AI has the potential to strengthen the DPR's analytical capacity, encourage evidence-based accountability, and improve access to information. However, its implementation faces significant challenges, including the risk of algorithmic bias, data privacy and security issues, issues of transparency (explainability) and accountability of algorithms, and capacity and infrastructure gaps. A comprehensive AI regulatory and governance framework, infrastructure and capacity investment, and an ethical and responsible implementation approach are needed, while still ensuring the central role of humans in the oversight process.

Abstract

This article proposes a new conceptual paradigm for understanding justice for crime victims by emphasizing two fundamental dimensions of human existence: agency and communion. The background of the problem indicates that despite normative progress, traditional justice approaches—retributive, restorative, and procedural—have yet to fully address the victim's need to simultaneously restore these two existential dimensions, creating a gap between the ideal of holistic justice and the fragmented reality of practice. This study aims to address the specific problem of formulating a justice framework that integrates the restoration of the victim's agency (sense of control and autonomy) and communion (social connectedness). The methodology employed is qualitative with a theoretical-conceptual research design, utilizing an in-depth literature review of social psychology theories, victimology, and legal philosophy. Data analysis techniques include content analysis and conceptual synthesis to construct an integrative model. The study results in a "Rehabilitative Justice" framework that integrates elements of traditional paradigms to simultaneously restore victims' agency and communion. The discussion reveals that this approach provides a theoretical foundation for reforming the Indonesian criminal justice system to be more humanistic and victim-centered. In conclusion, justice for victims must be understood as an existential rehabilitation process that restores dignity and social bonds. Recommendations include a philosophical reorientation of criminal law, a procedural reconstruction towards meaningful participation, and an institutional transformation of victim protection agencies towards comprehensive psychosocial and existential support.

Abstract

Keamanan nasional merupakan fungsi fundamental negara hukum dalam menjamin keberlangsungan negara, perlindungan warga negara, serta stabilitas sosial dan politik. Namun, implementasi penegakan keamanan nasional sangat dipengaruhi oleh politik hukum yang dianut masing-masing negara. Indonesia dan Singapura meskipun berada dalam kawasan geografis yang sama, menunjukkan perbedaan mendasar dalam pendekatan politik hukum penegakan keamanan nasional. Indonesia mengembangkan kebijakan keamanan nasional dalam kerangka negara hukum demokratis yang menempatkan konstitusi, perlindungan hak asasi manusia, serta mekanisme checks and balances sebagai prinsip utama. Sebaliknya, Singapura menerapkan pendekatan keamanan nasional yang bersifat preventif dan legalistik dengan penekanan kuat pada stabilitas dan ketertiban sebagai prasyarat utama pembangunan nasional. Penelitian ini bertujuan untuk menganalisis dan membandingkan politik hukum penegakan keamanan nasional antara Indonesia dan Singapura dalam perspektif negara hukum. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perbandingan hukum (comparative law approach), melalui kajian terhadap peraturan perundang-undangan, doktrin hukum, dan kebijakan keamanan nasional kedua negara. Hasil penelitian menunjukkan bahwa Indonesia cenderung mengedepankan model penegakan keamanan nasional yang demokratis-konstitusional dan berorientasi pada hak asasi manusia, sedangkan Singapura mengadopsi model keamanan nasional yang bersifat preventif, security-oriented, dan memberikan ruang dominan bagi kekuasaan eksekutif. Perbedaan politik hukum tersebut mencerminkan variasi implementasi konsep negara hukum modern dalam merespons tantangan keamanan nasional.
