Abstract

The detention of diplomas is carried out under the pretext that employees do not resign before the contract period ends. However, this action raises legal problems because it has the potential to violate the basic rights of workers, especially the right to private property and freedom of work. This is because every individual has the constitutional right to maintain ownership of the assets he or she legally acquires, including the results of work or income that are part of his or her personal property. If the policies or actions of the company, the government, or other parties limit or even confiscate part of the property without a clear and fair legal basis, then this can be considered a violation of the principle of non-deprivation of property without due process. This study aims to examine the practice of diploma retention from the perspective of employment law based on Law Number 13 of 2003 concerning Manpower, as well as examine its legal implications for companies and workers. The research method used is normative juridical, with a legislative approach. The results of the study show that there is no strict provision in Law Number 13 of 2003 that allows the retention of diplomas by companies. On the contrary, the practice is contrary to the principle of protection of workers' rights regulated in the law and contrary to the principles of legal certainty and justice. Workers have the right to be actively involved in the process of drafting employment agreements through joint deliberation with employers, as stipulated in Article 52 of the Manpower Law. Diploma detention can be categorized as a form of violation of the law and the company can be subject to administrative or criminal sanctions if proven to be detrimental to workers. To overcome this, stronger and integrated law enforcement mechanisms are also needed, such as increasing the capacity and authority of labor supervisors, the establishment of special units to deal with violations of workers' rights, and the application of strict administrative and criminal sanctions against violating companies.

Abstract

The rapid development of society, driven by globalization and modernization, poses significant challenges to the preservation of local culture and identity. This study addresses a critical legal issue: the absence of village customary institutions across most villages in Bojonegoro Regency, despite their legal basis under Article 95 Paragraph (1) of Law Number 6 of 2014 on Villages. The research aims to explore the legal urgency and practical necessity of establishing village customary institutions as institutional mechanisms to safeguard cultural heritage and customary law within rural communities. Using an empirical legal research approach, this study investigates real-world legal practices through structured interviews with village authorities in Trucuk Village—currently the only village in Bojonegoro Regency with a formally established village customary institutions. The data were analyzed using qualitative descriptive methods to assess the institutional, legal, and sociocultural implications. Findings reveal that the village customary institutions in Trucuk Village functions not only as a legal instrument for preserving cultural values and indigenous traditions but also as a mediator in local dispute resolution, a protector of communal rights, and a catalyst for community-based cultural and economic development. The absence of such institutions in 418 other villages signals a significant gap in the implementation of village autonomy and cultural protection policies. This research highlights the urgent need for local governments to align with national legal mandates by promoting the establishment of village customary institutions  as legally recognized entities. Doing so will reinforce local identity, strengthen community governance, and serve as a legal bulwark against cultural erosion. The study calls for policy-level awareness and coordinated action to replicate Trucuk’s model throughout the region.

Abstract

Pada era modern saat ini banyak hal yang dengan mudahnya diakes melalui internet, salah satunya yaitu arisan online. Arisan online dilakukan tanpa bertemu secara langsung dengan pengelola arisan, transaksi pembayaran uang arisannya dapat melalui Automated Teller Machine (ATM), cara pengundiannya dilakukan secara otomatis melalui media elektronik tersebut, sehingga diperlukan sikap kepercayaan dalam melakukan bisnis ini. Penipuan arisan online biasanya dilakukan dengan cara menawarkan imbalan yang menggiurkan kepada peserta, yang sering kali tidak menyadai bahwa mereka telah terlibat dalam skema piramida yang tidak berkelanjutan. Metode dalam kegiatan pengabdian kepada masyarakat yang dilakukan ini dengan metode penyuluhan, dengan diberikannya materi terkait faktor dari penipuan arisan online. Hasil dari pengabdian yaitu peserta memahami materi yang disampaikan oleh tim pengabdian kepada masyarakat dengan melihat respon dan antusiasme para peserta untuk bertanya dan berdiskusi pada tim sosialisasi, serta terdapat suatu himbauan kepada peserta dapat membentengi diri terhadap beberapa faktor penipuan arisan online dan masyarakat agar lebih berhati-hati dalam memilihi, agar tidak terjerumus dalam penipuan arisan online.
