Abstract

Cyber crime is increasingly prevalent with various modes, one of which is fraud under the guise of lottery prizes. This crime not only causes financial losses but also complicates law enforcement officials in terms of jurisdiction, especially if the perpetrators and victims are located in different regions, even across countries. This research aims to analyze how jurisdiction is enforced in dealing with cyber-based fraud crimes and examine the effectiveness of national legal instruments against the digital fraud mode. The research method used is a normative juridical approach with secondary data analyzed descriptively-analytically. The results show that jurisdictional enforcement in this case still faces technical and legal challenges, especially in the aspect of inter-state coordination and the limitations of domestic legal instruments in reaching cross-border perpetrators. Strengthening international cooperation and updating national regulations are needed to anticipate the dynamics of cybercrime.

Abstract

The phenomenon of money laundering crimes committed by corporations shows an increasingly complex and organized trend. Law enforcement against corporate offenders often faces obstacles in terms of regulations and weaknesses of the criminal justice system. In this context, the consistency of law enforcement becomes crucial to ensure legal certainty and justice. This research aims to examine the consistency of corporate criminal law enforcement in money laundering cases and identify relevant challenges and solutions. The research method used is normative juridical with statutory approaches and case studies. The results of the study show that although there is an adequate legal umbrella, implementation in the field is still inconsistent, both in terms of proving corporate guilt and in imposing sanctions. It is necessary to harmonize regulations and increase the capacity of law enforcers to realize an effective corporate criminal law system in tackling money laundering crimes.

Abstract

Penelitian ini bertujuan untuk menganalisis kecakapan hukum debitur di bawah usia 21 tahun dalam pelaksanaan akad kredit menurut hukum perdata Indonesia. Berdasarkan ketentuan Pasal 1320 dan Pasal 1330 Kitab Undang-Undang Hukum Perdata (KUHPerdata), salah satu syarat sahnya perjanjian adalah adanya kecakapan hukum para pihak. Pasal 330 KUHPerdata menentukan bahwa seseorang baru dianggap dewasa apabila telah mencapai usia 21 tahun atau telah menikah. Dengan demikian, debitur di bawah usia 21 tahun yang belum menikah dianggap belum cakap hukum untuk melakukan perbuatan hukum, termasuk akad kredit. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa perjanjian kredit yang dilakukan oleh debitur di bawah usia 21 tahun tanpa persetujuan orang tua atau wali hanya memiliki kekuatan hukum bersyarat, yakni dapat dibatalkan oleh pihak yang berwenang. Temuan ini menunjukkan pentingnya prinsip kehati-hatian (prudential principle) bagi lembaga keuangan dalam proses penyaluran kredit untuk menjamin kepastian dan perlindungan hukum bagi para pihak.
