Abstract

This study examines the concept of husband's nusyuz in Islamic family law and its relevance as a valid reason for divorce in Religious Courts. While nusyuz has often been associated exclusively with wives, contemporary approaches suggest that husbands can also commit nusyuz when they neglect their household obligations, such as failing to provide maintenance, committing violence, or abandoning their wives without just cause. This study uses a normative-empirical legal method with a statutory, conceptual, and sociological approach. The study focuses on the analysis of two court decisions, namely Decision Number 2472/Pdt.G/2023/PA.Lmg and Decision Number 257/Pdt.G/2020/PA.Mtr, which indicate that a husband's actions that violate his wife's rights have been recognized as grounds for divorce even though they are not explicitly stated as nusyuz. The results of this study confirm that husband's nusyuz can be used as a legal basis in a divorce suit by a wife, in accordance with the provisions of Article 39 paragraph (2) of Law Number 1 of 1974 and Article 116 of the Compilation of Islamic Law. This finding also contributes to a renewed perspective on Islamic family law, focusing on fairer and more equal treatment.

Abstract

This research investigates whether the ban on absentee land ownership retains its significance in today's context. The goal is to provide an updated perspective on the prohibition of absentee ownership of agricultural land in Indonesia. This investigation is normative, supported by empirical evidence, and employs both a statutory and a conceptual framework throughout the paper. The findings yield the following conclusions: initially, the underlying rationale for banning absentee land ownership is to ensure that agricultural land is actively cultivated and managed by its rightful owner for optimal yield. This emphasizes the principle that agricultural land should be actively utilized by its owner, as outlined in Article 10 of the UUPA. There is a necessity for oversight and preventive actions, such as rejecting registration applications, enforced by the district or city land office, to halt the ongoing issue of absentee land registration. Secondly, the importance of the absentee land ownership prohibition in Indonesia has diminished in light of contemporary realities, as the legislative framework established sixty years ago is no longer aligned with present-day societal conditions. The regulations regarding absentee land ownership require modernization; previously, ownership of agricultural land was restricted to the sub-district level, which should be revised or replaced by new laws allowing agricultural land ownership at the district or city level. This transformation would enable the new regulations to respond to the evolving landscape and address the increasingly complex challenges that arise.

Abstract

Early marriage is a multidimensional problem that hinders the fulfillment of children's and women's rights in Indonesia, especially in West Nusa Tenggara (NTB) province, which has a high prevalence rate (14.23% in 2023) compared to the national average (8.06%). This practice is rooted in economic factors, local traditions, and low legal awareness, which leads to serious consequences for health, education, and socioeconomic aspects. Therefore, legal counseling in Penujak Village, Central Lombok, which still holds strong traditional values, is a strategic step to increase public awareness about the risks of early marriage and the importance of child protection. This activity was conducted on September 4, 2025, at the Penujak Village Hall using a participatory method. The goal was to provide legal understanding and education through presentations and interactive discussions involving village officials, religious leaders, traditional leaders, parents, and teenagers. The results of this activity showed an increase in understanding and collective awareness among participants, evidenced by their enthusiasm in discussions and their commitment to supporting early marriage prevention efforts. Participants realized that delaying the age of marriage is a long-term investment to achieve a healthy, intelligent, and competitive "Golden Generation 2045". Thus, this legal counseling activity is considered a successful and strategic first step in building public legal awareness and has the potential for further development through the formation of a children's forum or village regulations. ABSTRAKPernikahan usia dini menjadi persoalan multidimensional yang menghambat pemenuhan hak anak dan perempuan di Indonesia, khususnya di Provinsi Nusa Tenggara Barat (NTB) yang memiliki prevalensi tinggi (14,23% pada tahun 2023) dibandingkan rata-rata nasional (8,06%). Praktik ini berakar pada faktor ekonomi, tradisi, dan rendahnya kesadaran hukum, yang menimbulkan konsekuensi serius pada aspek kesehatan, pendidikan, dan sosial-ekonomi. Oleh karena itu, penyuluhan hukum di Desa Penujak, Lombok Tengah, yang masih kental dengan nilai adat, menjadi langkah strategis untuk meningkatkan kesadaran masyarakat tentang risiko pernikahan usia dini dan pentingnya perlindungan anak. Kegiatan ini dilaksanakan pada 4 September 2025 di Balai Desa Penujak dengan menggunakan metode partisipatif. Tujuannya adalah untuk memberikan pemahaman hukum dan edukasi melalui pemaparan materi serta diskusi interaktif yang melibatkan perangkat desa, tokoh agama, tokoh adat, orang tua, dan remaja. Hasil dari kegiatan ini menunjukkan adanya peningkatan pemahaman dan kesadaran kolektif di kalangan peserta, yang terlihat dari antusiasme dalam diskusi dan komitmen untuk mendukung upaya pencegahan pernikahan dini. Peserta menyadari bahwa menunda usia perkawinan adalah investasi jangka panjang untuk mewujudkan "Generasi Emas 2045" yang sehat, cerdas, dan berdaya saing. Dengan demikian, kegiatan penyuluhan hukum ini dinilai berhasil sebagai langkah awal yang strategis dalam membangun kesadaran hukum masyarakat dan berpotensi untuk dikembangkan lebih lanjut melalui pembentukan forum anak atau regulasi desa.
