Abstract

This study examines the massive demonstrations on August 25-29, 2025, as a manifestation of the disintegration of the social contract between the people and the state. These actions stemmed from deep disappointment with the House of Representatives (DPR), sparked by the issue of allowance increases and the arrogance of council members. Using a socio-legal approach, this study argues that the demonstrations signaled a breakdown in the political and moral legitimacy of the people's representatives, where the law was no longer obeyed out of conviction, but rather out of coercion. Key findings indicate that the DPR's non-participatory legislative function, exacerbated by systemic abuse of power to serve oligarchic interests, has significantly eroded public trust. Although the quantity of DPR legislation in the 2019-2024 period increased, its quality is questionable due to the practice of "fast-track" legislation and the low completion of the National Legislation Program (Prolegnas) targets. Comparative analysis reveals a recurring pattern of protests against flawed legislation. However, the 2025 demonstrations saw a new escalation after a tragic incident that killed a protester, shifting the focus of public anger from policy issues to alleged human rights violations by the authorities. This study concludes that the restoration of trust can only be achieved through a more participatory and transparent reconstruction of the social contract, as well as firm law enforcement against individuals who betray the public mandate.

Abstract

Pancasila Industrial Relations (HIP) is the foundation of Indonesian employment, prioritizing deliberation and consensus. However, its implementation faces significant challenges with the normalization of the outsourcing system and flexible work practices in the Job Creation Law. This paper analyzes the resilience of HIP through the advocacy movement of labor unions in responding to uncertainty about employment status. Using a juridical-normative approach, this paper examines how the Constitutional Court's ruling on the judicial review of the Job Creation Law has become a new instrument for labor unions to fight for legal certainty. The results show that collective advocacy remains a key bulwark in maintaining the balance between company productivity and workers' normative rights amidst the current liberalization of the labor market.

Abstract

Transforming the economy based on knowledge leads to redefining industrial relations as more than merely physical but also intellectual energy. This research explores the juridical and sociological challenges behind the redistributing of the economic value of IP generated by a worker in Indonesia. The urgency of this research was triggered by the plan to revise the Indonesian Labor Law by the Indonesian Parliament in March 2026. Using the normative-comparative legal research method, this study compares the Work Made for Work doctrine in the US with Arbeitnehmererfindergesetz system in Germany. The data obtained concludes that there is a lack of regulation that often causes the employer dominant position at worker-employer relations, which disregards the worker’s moral and economic right. As a solution, this research suggests an alternative academic script that calls for more power in CBA in three pillars: economic justice, legal certainty, and power balance between parties. The conclusion of this research encloses the idea that the labor law should enforce the CBA as a balance instrument that secures the equal benefit between workers and employer in quest of competitive and harmonious industrial climates.

Abstract

Conflicts between the Management Board and apartment unit owners regarding the collection of Environmental Management Fees (IPL) often create prolonged social and legal tensions. This study aims to analyze the legitimacy of these actions through the lens of the Consumer Protection Law, contract law, and criminal law using normative juridical research methods. This study analyzes the urgency of harmonizing regulations on apartment management by integrating the principles of Restorative Justice and the Consumer Protection Law (UUPK). Through normative juridical research methods, it was found that unilateral termination is a form of abuse of power relations that violates Article 18 of the UUPK and consumer human rights. The study shows that unilateral termination is a form of abuse of power relations that violates basic consumer rights and contradicts the principle of propriety, so that the clause in the House Rules that legitimizes this practice is declared null and void. As a mitigation solution, this study offers a Restorative Justice paradigm that prioritizes dialogue and relationship restoration to avoid the practice of vigilantism or eigenrichting which carries criminal risks. This study offers a new paradigm in conflict resolution through penal mediation (restorative justice) and a relationship restoration approach, to avoid the practice of vigilantism (eigenrichting). The results of the study recommend the need for policy reform that prioritizes dialogue and proportional sanctions to create harmony in life in flats.

Abstract

The rapid development of information technology has shifted the banking paradigm from conventional banking to a digital ecosystem (Industry 4.0 and 5.0). While offering efficiency and financial inclusion through services such as Mobile Banking, QRIS, and e-Wallets, this digitalization brings new risks in the form of cybercrime and misuse of personal data. This article aims to analyze the legal protection framework for bank customers in Indonesia in the context of digital transactions. Using normative research methods, this study examines the relationship between the Banking Law, the ITE Law, and the Personal Data Protection Law (PDP Law). The discussion shows that legal protection for customers must be based on the principles of justice, transparency, and security. Synergy is needed between regulatory authorities (OJK and BI) and increasing public digital literacy and strengthening banking technology security systems to mitigate the risks of cybercrime and Money Laundering (TPPU).

Abstract

Penelitian yuridis normatif ini menganalisis bahwa pada delik formil terkait dokumen publik, kejahatan dianggap telah sempurna tanpa mensyaratkan akibat kerugian fisik karena dokumen tersebut merupakan manifestasi kebenaran negara yang membawa Asas Praduga Sah. Berdasarkan Teori Kepastian Hukum dari Jan M. Otto dan Teori Keadilan Bermartabat, hukum harus memberikan kejelasan status yang tetap dan tidak boleh menjadi alat kompromi atas kegaduhan publik yang diciptakan secara sengaja melalui narasi negatif atau legal harassment. Hasil pembahasan menunjukkan bahwa penerapan RJ pada kasus yang memicu polarisasi massa dan keresahan nasional justru melanggar syarat materiil dalam Pasal 5 huruf (a) Perpol 8/2021 serta menciptakan kecelakaan hukum berupa privatisasi kebenaran. Mengingat korban dalam delik pemalsuan dokumen publik adalah entitas abstrak yaitu negara dan kepercayaan masyarakat, maka penyelesaian lewat jalur privat tidak mampu memulihkan kerugian kepercayaan publik secara absolut. Oleh karena itu, penelitian ini menyimpulkan bahwa penolakan Restorative Justice dalam kasus berdampak luas adalah sebuah keharusan yuridis guna mencegah preseden destruktif di mana hukum disandera oleh tekanan opini publik. Proses litigasi terbuka di pengadilan menjadi satu-satunya instrumen konstitusional untuk memutus rantai spekulasi, memberikan edukasi hukum, serta memastikan supremasi hukum tetap terjaga melalui pembuktian yang memiliki kekuatan hukum tetap.

Abstract

Artikel ini menganalisis keabsahan tindakan tersebut melalui pendekatan yuridis normatif dengan pisau analisis Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen (UUPK), hukum perjanjian, dan hukum pidana. Hasil penelitian menunjukkan bahwa penggunaan utilitas vital sebagai “alat sandera” merupakan bentuk penyalahgunaan relasi kuasa (abuse of power) dan dikategorikan sebagai tindakan main hakim sendiri (eigenrichting). Klausula dalam House Rules yang melegitimasi tindakan tersebut dinyatakan batal demi hukum karena melanggar larangan klausula baku dalam Pasal 18 UUPK dan bertentangan dengan asas kepatutan. Penulisan ini merekomendasikan perlunya intervensi regulator untuk melakukan standardisasi tata tertib hunian guna menjamin hak dasar konsumen tanpa menegasikan hak finansial pengelola melalui mekanisme penyelesaian sengketa yang lebih beradab dan proporsional.
