Abstract

Migrant worker is an alternative in order to minimize unemployment number in Indonesia. BP2MI is an agency who has responsibilities to protect Indonesian migrant worker in time of pre-placement, placement and post placement. The aims of this research are to know the role of BP2MI Mataram in the protection of migrant worker during pre-placement time and implementation of Government Regulation Number 90 of 2019 on BP2MI. This research is qualified as empirical legal research. From research result, it is shows that form of legal protection in pre-placement phase are administratively and technically. However, it implementation of migrant worker protection by BP2MI Mataram is delivered by pre-placement protection.

Abstract

Isu perdagangan orang (human trafficking) dalam dekade terakhir ini menjadi sorotan dari berbagai pihak baik di tingkat nasional maupun internasional, para pemerhatipun menyoroti segala sesuatu yang berkaitan dengan perdagangan orang (human trafficking), khususnya aspek pencegahan perdagangan orang, seiring dengan dibukanya tambang tambang besar dibeberapa wilayah NTB serta pekembangnya sector pariwisata NTB menjadi daerah wilayah sending area, transit dan penerima. Tujuan penyuluhan ini adalah untuk membantu pemerintah dalam mensosialisasikan peraturan perundang-undangan tentang Pencegahan Perdagangan Orang di Tingkat Desa.sedangkan tujuan khusus penyuluhan ini adalah agar masyarakat khususnya Desa Malaka merupakan salah satu pintu masuk Pariwisata menuju tiga Gili di Kabupaten Lombok Utara yaitu Gili Trawangan, Gili Air, dan Gili Meno. Masyarakat banyak terlibat dan berpatisipati dalam jasa pariwisata dengan menjadi pegiat pariowisata terutama dari mancanegara. pengetahuan dan pemahaman masyarakat desa tentang bahaya perdagangan orang, migrasi aman dan penempatan pekerja migran Indonesia.mengngat des amalaka merupakan pintu wisata tiga gili yaitu gili air,gili meno dan Gili Trawangan.dan sebagian masyarakat desa malaka menggantungkan kehidupan dengan teribat disektor wisata. Selain beradu nasib disektor pariwisata ,animo masyarakat masyarakat desa Malakayg untuk menjadi calon pekerja migran Indonesia di luar negeri tinggi, sehingga perlunya pemahaman tentang penempatan pekerja migran Indonesia di luar negeri , migrasi aman khususnya dapat memahami tata cara menjadi pekerja Migran yang berdokumen legal dan paham tentang bahaya perdagangan orang dalam mendompleng ketenaran penempatan pekerja Migran Indonesia .

Abstract

This study aims to determine the legal protection of daily female laborers at PT. Rinjani Tirta Abadi in Aik Berik Village in terms of Law Number 13 of 2003 concerning Manpower. A female worker is a woman who works for wages or other forms of remuneration. Daily laborers are workers or laborers who work for entrepreneurs to carry out certain jobs that can vary in terms of time and volume of work by receiving wages based on the daily attendance of workers. The type of research used in this study is empirical legal research with a sociological juridical approach and uses primary legal sources obtained from field data and interviews. Law Number 13 of 2003 concerning Manpower has provided regulations regarding the rights of women workers. Based on the formulation of the problem and the purpose of this study, namely, to analyze further how the legal protection arrangements for daily workers at PT. Rinjani Tirta Abadi, and to find out the implementation of protection for daily female workers based on Law No. 13 of 2003 concerning Manpower.

Abstract

This study aims to determine the legal protection and social security for migrant worker in Indonesia under Indonesia positive law and to determine the protections for migrant worker in their occupancy period. This study using normative method, and using qualitative analyze method. Result of this study showed that one of the efforts of Indonesia government to protect migrant worker is giving social security for migrant worker pursuant to Indonesian law. This social security given to the migrant worker in their occupancy period.

Abstract

Abstrak The aims of this research is to find the model of traditional tourism governance format so that it can be used as a benchmark in the development of village tourism or sustainable hamlet tourism by re-arranging regulations based on local wisdom that support traditional tourism. Another objective is to evaluate and refine the implementation of village regulations that have been developed and implemented in the village tourism domain to determine the extent of their implications on improving the economy of people in tourist villages. This paper is authored using a qualitative approach with the orientation of literature study as an employed strategy in this study. The literature study is used in social research methodologies to trace historical data, as is found in this study. The results showed that the development of rural tourism is able to minimize the potential of urbanization from rural to urban society caused by the ability of local people to create economic activities based on tourism activities (tourism economy) in rural areas. The productive power of local potentials, including the potentials of rural areas, can be encouraged to grow and develop by utilizing the resources owned by the village, so that it can be an effective instrument in encouraging the development of socio-cultural and economic fields of rural communities. Furthermore, efforts will be encouraged to conserve and empower the potential of local culture and local wisdom values that tend to be threatened with extinction due to the heavily globalized currents that have entered rural areas. In the development of a tourist village, certain guidelines are needed so that the impact of the development of tourism activities in each rural area can be controlled. Keywords: tourism village; sustainable tourism development; economic empowerment; local wisdom.

Abstract

This study aims to find out how to arrange leave rights for women workers according to labor laws and the implementation of women's leave rights according to labor laws against regulations at Bank BTN KC Mataram companies. Implementation of research using empirical research methods. Based on the results of the study, the rights of women workers to leave have been regulated in Law Number 13 of 2003 concerning Manpower. Bank BTN KC Mataram has an official bond agreement. Female workers get special leave rights in the form of leave for menstruation, pregnancy, childbirth, and miscarriage. This provision is regulated in the signing of the cooperation. The company should give special leave to all female workers regardless of whether the worker is in service or not.

Abstract

This study aims to determine and discuss the effectiveness of services for BPJS Health participants and the factors that influence the implementation of health services for BPJS health participants. This type of research is empirical legal research with a statutory approach, conceptual approach and sociological approach. The results showed that the Labuhan Haji Health Center had the capacity of health facilities, health administration, health center safety standards that were effective and in accordance with applicable regulations, as well as the factors that influenced the implementation of BPJS services at the Labuhan Haji Health Center consisting of geographical factors, the availability of Labuhan Haji Health Center facilities, and capacity. Health Human Resources. The availability of health services will affect the success of the implementation of BPJS services at the Labuhan Haji Health Center.

Abstract

Penelitaian ini bertujuan untuk mengetahui bentuk tanggung jawab dan pengawasan yang dilakukan oleh pemerintah Daerah berdasarkan Undang-Undang Republik Indonesia Nomor 18 Tahun 2017 Tentang Perlindungan Pekerja Migran Indonesia. Abstract

This research’ purposes are to know and to analyze implementation of implemented P3K by the company in their workers as the form PT. Alfaria Trijaya’s responsibilities in the work accident. This study was empirical legal research. Research’s result shows that implementation of P3K in PT. Alfaria Trijaya Tbk, can be said has been done according to the Ministry of Manpower Regulation Number 15 /MEN /VIII/2008 on the first assistance during work accident in workplace. It start with the first assistance officers, rooms, first aid cabinet or box and its contain, evacuation tools and transportation. However, the first aid implementation of company has not meets the standard according to the ministry regulation. The liability of PT Alfaria Trijaya Tbk in the event of a work accident in the workplace, as for the forms of liability including: Such as the provision of first aid for work accidents in the workplace (P3K), and the Employment Social Security Administration Agency (BPJS) covering transportation costs; Temporary compensation for being unable to work (STMB); Disability compensation; Compensation for death, funeral expenses and periodic compensation at once; Rehabilitation costs in the form of replacement of assistive devices (orthoses) and/or replacement devices (protheses); Reimbursement of dentures, hearing aids and glasses; Education Scholarship.
