Abstract

Klausul baku dalam usaha laundry ialah upaya pelaku usaha untuk meminimalkan tanggung jawab kepada konsumen. Penjelasan Pasal 18 ayat (1) UUPK menyebutkan maksud pelarangan pencantuman klausul baku yaitu agar kedudukan konsumen sejajar dengan pelaku usaha berdasarkan asas kebebasan berkontrak. Penelitian ini terfokus pada dua permasalahan yaitu perjanjian baku jasa laundry dikaitkan dengan UUPK di Kota Pekanbaru, serta, pengaturan hak dan kewajiban para pihak dari perjanjian baku yang dibuat oleh Badan Usaha Laundry dihubungkan dengan perlindungan konsumen dan Tanggung Jawab Pelaku Usaha Laundry terhadap Konsumen Pengguna Jasa Laundry di Kota Pekanbaru. Penelitian hukum sosiologis ini dilakukan dengan cara survei menggunakan wawancara dan kuesioner. Hasil penelitian ini menyimpulkan bahwa terdapat beberapa ketentuan perjanjian baku oleh pelaku usaha laundry yang menyatakan adanya pengalihan tanggung jawab yang bertentangan dengan UUPK Pasal 18. Lebih lanjut, pengaturan hak dan kewajiban antara pelaku usaha dan konsumen tidak sesuai dengan UUPK karena antara konsumen dan pelaku usaha sama-sama tidak memahami dan mengetahui apa saja yang menjadi hak dan kewajibannya masing-masing. Tanggung jawab pelaku usaha terhadap konsumen dalam kondisi ini merupakan sebuah ketidakseimbangan sangat merugikan konsumen.

Abstract

This study investigates the phenomenon of marriage anxiety among Generation Z and Millennials in Indonesia. This concern has become increasingly relevant amid modern social, cultural, and religious shifts. The research aims to understand the factors influencing young people’s perceptions of marriage, including economic instability, digital media influence, and evolving gender roles, and to propose a reinterpretation of Islamic family law to address contemporary concerns. Findings reveal that financial pressures, lack of religious education, societal expectations, and the influence of social media contribute significantly to the fear of marriage. Additionally, the study highlights the need for a more flexible and equitable approach to marital readiness, with a focus on emotional, social, and financial preparedness. Employing a normative qualitative research method, the study combines sociological and Islamic legal perspectives to offer a comprehensive understanding of marriage anxiety. The research concludes that addressing these fears through a blend of cultural, religious, and socioeconomic support can foster healthier perceptions of marriage and promote its value in modern society. The study contributes to the renewal of marriage concepts, ensuring their relevance in contemporary Indonesia.

Abstract

Contemporary fiqh muamalah faces significant challenges in response to the development of modern economic practices characterized by transactional complexity, economic digitalization, and unequal economic relations. Within Islamic economic law, the development of fiqh muamalah remains largely dominated by a legal-formalistic approach that emphasizes the textual validity of contracts, while the objectives of Islamic law and the socio-economic impacts of transactions receive limited attention. This condition contributes to the weak realization of substantive justice in contemporary muamalah practices. This paper examines the problem of legal formalism in fiqh muamalah and analyzes the operational limitations of maqāṣid al-sharī‘ah in Islamic economic practice. Employing a normative–conceptual legal approach, the discussion focuses on reconstructing contemporary fiqh muamalah based on maqāṣid al-sharī‘ah by positioning legal objectives as the foundation of legal reasoning. The analysis demonstrates that such reconstruction requires the repositioning of maqāṣid al-sharī‘ah as an epistemological basis, the expansion of legal analysis from contractual relations to economic structures and impacts, and the affirmation of substantive justice as a key criterion of Sharī‘ah compliance. This approach is expected to strengthen the role of fiqh muamalah as a responsive, contextual, and justice-oriented framework within the development of Islamic economic law.
