Abstract

This article discusses the problem of the dissolution of social organizations in Indonesia that is not in accordance with the principles of the rule of law. These problems will be answered methodologically using normative legal research. The author uses this legal research because the focus is on studying literature, legislation and court decisions relating to the object of research. Based on the results of the study this article concludes that the 1945 Constitution of the Republic of Indonesia emphasizes the importance of a system of checks and balances in which there needs to be a clear division of power between the executive and judicial functions. This means that in the case of the dissolution of social organizations it is very important to involve the court in deciding the dissolution of the social organization in Indonesia by structuring dispute resolution in the courts using the principle of quick, simple and low cost justice so that the process of dispute resolution of the social organization can be carried out effectively and efficiently.

Abstract

Penerapan ambang batas pencalonan presiden dan wakil presiden (presidential threshold) pada pemilu serentak tahun 2019 menimbulkan krisis legitimasi, dimana Undang-Undang Nomor 7 Tahun 2017 Tentang Pemilihan Umum masih mengakomodir presidential threshold sebagai syarat mutlak untuk pencalonan presiden yang merujuk pada perolehan hasil suara pemilihan umum 2014. Pengaturan tersebut tidak sejalan dengan logika pemilu serentak yang menghendaki semua partai politik peserta pemilu berhak untuk mencalonkan presiden dan wakil presiden. Artikel ini akan menjawab 2 (dua) pertanyaan yaitu pertama, bagaimana pengaturan presidential threshold dalam Undang-Undang Pemilu dan Putusan Mahkamah Konstitusi? dan Kedua, bagaimana rekonseptualisasi presidential threshold dalam pemilu serentak? Kedua pertanyaan tersebut akan dijawab secara metodeologis dengan menggunakan penelitian hukum normatif, dikarenakan fokusnya adalah mengkaji studi literatur, peraturan perundang-undangan dan putusan MK yang berhubungan dengan objek penelitian. Berdasarkan kajian penulis dapat disimpulkan bahwa pertama, UUD NRI Tahun 1945 telah mengamanatkan bahwa pengajuan calon presiden dan wakil presiden dapat diajukan oleh partai politik atau gabungan partai politik peserta pemilu. Ambang batas harus mengikuti secara otomatis dengan sistem pemilu yang diterapkan. Artinya koalisi hanya bersifat pilihan, bukan kewajiban demi memenuhi syarat ambang batas pencalonan. Kedua, rekonseptualisasi pemilihan presiden dan wakil presiden harus memberikan daya dukung kepada menguatnya sistem presidensial. Hal ini dapat dilakukan apabila presiden tidak merasa ketergantungan dengan partai politik. Koalisi alamiah semestinya terjadi sehingga kekuatan koalisi murni untuk kepentingan strategis dan jangka Panjang. Koalisi alamiah akan terpenuhi apabila tidak mensyaratkan ambang batas pencalonan. Atas dasar itulah, sistem presidensil akan kohesif dengan mencairnya partai politik untuk membangun koalisi yang strategis dan jangka Panjang

Abstract

Tujuan penulisan artikel ini yaitu menganalisis bentuk pengikisan nasionalisme yang berkembang saat ini serta upaya seperti apa untuk merekatkan kembali semangat nasionalisme. Penelitian ini adalah penelitian hukum normatif, karena penulis menggunakan penelitian hukum ini merupakan penelitian hukum normatif (normative legal research) dikarenakan fokusnya adalah mengkaji studi literatur dan peraturan perundang-undangan yang berhubungan dengan objek penelitian. Hasil tulisan ini menunjukan bahwa Pertama, salah satu dampak negatif dari reformasi adalah memudarnya semangat nasionalisme dan kecintaan pada negara. Menguatnya isu SARA, gerakan separatis, kekerasan, tindakan teroris dan tumbuhnya feodalistik memicu degradasi nasionalisme yang berujung pada instabilitas kehidupan berbangsa dan bernegara. Hal ini sangat berbahaya karena kondisi yang demikian menjadi ancaman bagi Indonesia apabila kelompok masyarakat sudah ditunggangi oleh korporasi/negara lain untuk dijadikan alat pemberontakan dan pengacau dalam negara. Kedua, Penanaman nilai-nilai nasionalisme adalah pilihan yang tepat untuk mereduksi gerakan negatif yang ingin memecah-belah bangsa. Nasionalisme indonesia adalah bercita rasa integralistik yang subtansinya tidak membeda-bedakan masyarakat atau warga negara atas dasar golongan atau yang lainnya, melainkan memadukan segala keanekaragaman menjadi suatu persatuan dan kesatuan dalam berkehidupan berbangsa dan negara. Semangat nasionalisme harus digelorakan kepada semua warga negara guna memperkokoh keutuhan kehidupan berbangsa dan bernegara. Hal ini dapat dilakukan apabila didukung oleh semua stakeholder khususnya di lembaga pendidikan, keluarga dan lingkungan masyarakat. Ketiganya memiliki peran strategis dalam pembentukan nilai-nilai nasionalisme dalam diri warga negara.

Abstract

The discourse on limiting the legislators standing to submit a constitutional review is not an entirely new issue to analyze. However, these things still need to be examined to explore the legal ratio of limitation of the legislator’s standing to submit a constitutional review by the Constitutional Court. This research specifically answers the questions: (a) how are the dynamics of the use of the legislators standing in the constitutional review? (b) what is the legal ratio for limiting legislators standing in the constitutional review? This study uses a normative legal research method by analyzing secondary data in the form of legislation, the Constitutional Court decisions, and literature related to legislators standing to submit the constitutional review. The results of this study indicate that the legal ratio limiting legislators’ standing can be traced through the legal considerations of the Constitutional Court decisions from 2003-2019.

Abstract

The election of village heads (Pilkades) is the representation of democracy at the village level. Nevertheless, the supervision mechanism by the district/city level election committee (PPK) becomes problematic when the authority also coincides with the authority to operate. It is important to know the legal construction regarding the supervision of village head elections and the model of village head election supervision in the future. These will be analyzed normatively using a statutory approach, case approach, and concept approach. The results of this study show that Pilkades is an important process to actualize the Constitutional rights of communities, democracy and village autonomy. However, the regulations governing the pilkades are not in line with democratic values and the principle of free and fair election because of the unification of the authority to operate and supervise simultaneously at the Village Head Election Committee formed by the regional Head. Therefore, improvements to the supervision of the Pilkades in the future can be carried out with three models, namely: involving district/city Bawaslu, forming district/city Pilakdes Supervisors, direct supervision by district/city Bawaslu.

Abstract

   This article discusses the problems of regulating Koranic education in regional regulations in Gorontalo Province. This is based on the consideration of the Ministry of Home Affairs which states that the draft regional regulation on Koranic education cannot be regulated separately but is integrated with existing regional regulations for the provision of education. These problems will be answered methodologically by using normative legal research. The author uses this legal research because the focus is on reviewing literature studies, laws and regulations and court decisions related to the object of research.   Based on the results of the study, this article concludes that the establishment of a regional regulation in the Gorontalo province regarding Qur'anic Education has the potential to cause conflict with the principles of establishing legislation. This is based on the material content of regional regulations that require protection for all groups and religions to prevent discriminatory actions on the formation of a regional regulation.The basis for regulating Qur'anic education should be used as part of local wisdom where the province of Gorontalo is known as the Serambi Medina area with a majority Muslim population supported by a strong culture so that a legal policy for the Gorontalo Provincial government is needed to accommodate Qur'anic education in regional regulations regarding the implementation of education in the region so that later the values of the Koran are not only accepted in the sociological scope but are recognized juridically.   Therefore, it is necessary to revise regional regulations on the implementation of education by including a chapter on religious education which does not only regulate Koranic education, but other religions can also be included in the chapter. If the regional regulations have been revised, the next effort is to strengthen Koranic education, it is necessary to make an implementing regulation, namely the governor's regulation on Koranic education as a follow-up to regional regulations on the implementation of education..

Abstract

The management of BUMDesa is not yet optimal because many BUMDesa administrators still need to understand BUMDesa regulations and institutions. Seeing these problems, there needs to be capacity building preceded by legal reasons as a guideline for regulating BUMDesa management signs. Increasing the capacity of Village-Owned Enterprises (BUMDesa) as an organ driving the village economy can be carried out through the Job Creation Era, which has become a momentum for structuring BUMDesa regulations and institutions. The era of work creation referred to is the birth of Law Number 11 of 2020 concerning Job Creation which is now declared invalid with the presence of Government Regulation  (Perpu) Number 2 of 2022 concerning Job Creation. This study uses normative legal research methods(normative legal research). The author uses this legal research because the focus is on studying literature and laws and regulations related to the object of research. The results of the research show that the Job Creation Perpu needs to be pushed into law so that it can become a legal umbrella for the establishment and management of BUMDesa institutions because, in fact, the spirit that is carried out in the Job Creation Era, namely improving the investment ecosystem and business activities, one of them through the institutional arrangement of BUM Desa.

Abstract

Issues with regional rules on Koranic education in Gorontalo Province are discussed. This is because the draft regional law on Koranic education is merged with preexisting regional regulations for the provision of education, as stated by the Ministry of Home Affairs. As a methodology, normative legal study will provide solutions to these issues. The author employs this legal research method because it allows for a comprehensive assessment of relevant literature, statutes, and judicial decisions. This article draws the conclusion, supported by the study's findings, that a regional regulation on Qur'anic education in the province of Gorontalo may contradict with the principles of forming legislation. This is because the establishment of regional regulations should never lead to discrimination of any kind, and this is based on the content of regional regulations that mandate protection for all groups and religions. A legal policy for the Gorontalo Provincial government is required to accommodate Qur'anic education in regional regulations regarding the implementation of education in the region so that, in the long run, the values of the Koran are not only accepted in the sociol Later, the values of the Koran are not only accepted in the sociol. Therefore, it is essential to update regional regulations on the implementation of education to include a chapter on religious education that regulates not just Koranic education but also education in other religions. As a follow-up to the revision of regional regulations on the implementation of education, the governor's regulation on Koranic education is required.
