Abstract

In addition to the professionalism element, the portion of certain ministries for the party supporting the presidential candidate will influence the presentation of women's representation as ministers in the government cabinet. This article aims to describe the problematic placement of women as ministers in Indonesia and the effective percentage of representation of women as ministers in a government cabinet. The analysis will be carried out normatively using a statutory, historical, and conceptual approach. The results of the study show that until now, women's representation had been accommodated in every government cabinets. However, there is no fixed number of women as ministers. Women tend to occupy ministries that dealt with nature and social life. Therefore, it can be done a special action (affirmative action) in the form of determining the minimum limit of the number of women's representation in a government cabinet. In addition, the determination of the composition of the government cabinet is also based on the zaken cabinet. Selain unsur profesionalitas, porsi kementerian tertentu bagi partai pengusung calon Presiden akan mempengaruhi presentasi keterwakilan perempuan sebagai menteri dalam kabinet pemerintahan. Artikel ini bertujuan untuk menguraikan problematika penempatan perempuan sebagai menteri di Indonesia dan presentase efektif keterwakilan perempuan sebagai menteri dalam suatu kabinet pemerintahan. Penelitian ini menggunakan analisa secara normatif dengan menggunakan pendekatan perundang-undangan, sejarah serta konseptual. Hasil kajian menunjukkan bahwa hingga saat ini, keterwakilan perempuan telah diakomodir dalam setiap kabinet pemerintahan. Akan tetapi, tidak ada jumlah yang tetap terhadap presentase perempuan sebagai menteri. Perempuan cenderung menempati kementerian yang berhubungan dengan kodrat dan kehidupan sosialnya. Oleh sebab itu, dapat dilakukan suatu tindakan khusus (affirmative action) berupa penentuan batas minimal jumlah keterwakilan perempuan dalam suatu kabinet pemerintahan. Selain itu, penentuan komposisi kabinet pemerintahan juga harus didasarkan pada kabinet zaken.

Abstract

Lahirnya Putusan MK nomor 16/PUU-XVI/2018 berimplikasi pada kewenangan Mahkamah Kehormatan Dewan (MKD) Dewan perwakilan Rakyat Republik Indonesia (DPR-RI) yang sebelumnya telah diatur Pada Pasal 2 Undang-Undang Nomor 2 tahun 2018 tentang Perubahan Kedua Atas Undang-Undang Nomor 17 tahun 2018 tentang Majelis Permusyawaratan Rakyat, Dewan Perwakilan Rakyat, Dewan Perwakilan Daerah, dan Dewan Perwakilan Rakyat Daerah (UU MD3). Permasalahan dalam penelitian ini adalah pertama, bagaimana kedudukan hak imunitas anggota DPR dalam perspektif equality before the law?. Kedua, bagaimana implikasi putusan mahkamah konstitusi nomor.16/PUU-XVI/2018 terkait wewenang MKD?. Penelitian ini merupakan penelitian normatif dengan menggunakan pendekatan perundang-undangan, pendekatan sejarah serta pendekatan kasus. Hasil penelitian menunjukkan bahwa hak imunitas anggota DPR tidak bertentangan dengan prinsip equality before the law sepanjang pemaknaan hak imunitas tidak mencakup keseluruhan kekebalan hukum anggota DPR sebagai warga negara pada umumnya. Selain itu, hak imunitas tersebut hanya berkaitan dengan fungsi serta wewenang dan tugas DPR semata. Adanya putusan MK Nomor 16/PUUXVI/2018, berimplikasi pada dua hal yakni, dihapusnya wewenang MKD dalam memberikan pertimbangan awal sebelum lahirnya izin tertulis presiden, serta persetujuan pemanggilan dan permintaan keterangan kepada anggota DPR sehubungan dengan terjadinya tindak pidana hanya melalui ijin Presiden semata.

Abstract

The reciprocal relationship between the state and citizens is seen in the granting of citizenship status and obedience to the law by citizens. Citizenship status is important in determining this relationship. The problem in this study is what are the implications of the release of citizenship status in Indonesia and what are the ideal terms and procedures for regaining Indonesian citizenship This research is a normative study using a statutory approach, case approach and conceptual approach. The loss of citizenship status has implications for not fulfilling one's basic rights that can be granted by the state. Therefore, it should be subject to weighting conditions and procedures by adding provisional length of stay of 10-15 years, add 'lost citizenship' note to the police record and to the residence permit, increase Citizenship money, do social work for a certain time, announce the action in media, and temporarily suspend the application for citizenship

Abstract

The election of village heads (Pilkades) is the representation of democracy at the village level. Nevertheless, the supervision mechanism by the district/city level election committee (PPK) becomes problematic when the authority also coincides with the authority to operate. It is important to know the legal construction regarding the supervision of village head elections and the model of village head election supervision in the future. These will be analyzed normatively using a statutory approach, case approach, and concept approach. The results of this study show that Pilkades is an important process to actualize the Constitutional rights of communities, democracy and village autonomy. However, the regulations governing the pilkades are not in line with democratic values and the principle of free and fair election because of the unification of the authority to operate and supervise simultaneously at the Village Head Election Committee formed by the regional Head. Therefore, improvements to the supervision of the Pilkades in the future can be carried out with three models, namely: involving district/city Bawaslu, forming district/city Pilakdes Supervisors, direct supervision by district/city Bawaslu.

Abstract

Kekuasaan kehakiman sebagai salah satu materi muatan dalam konstitusi tertulis suatu negara hukum tidak dapat dipisahkan dari konsepsi trias politica. Hal tersebut dimaksudkan untuk menjamin independensi para hakim dalam membentuk hukum melalui putusannya sekaligus untuk mencegah penyalahgunaan kekuasaan. Dalam hal ini, penting membuktikan maksud tersebut telah sesuai dengan substansi kekuasaan kehakiman dalam materi muatan UUD 1945. Atas dasar tersebut, kajian ini dibatasi dalam dua pokok bahasan, yakni tentang sejauh mana latar belakang kekuasaan kehakiman menjadi materi muatan dalam UUD 1945 serta kedudukan kekuasaan kehakiman sebagai materi muatan dalam UUD 1945. Kedua hal tersebut akan dianalisa secara normatif dengan menggunakan pendekatan perundang-undangan dan pendekatan sejarah. Adapun hasil akhir dari kajian ini menunjukkan bahwa walaupun terjadi pergantian rezim pemerintahan, bentuk negara hingga perubahan UUD 1945, kekuasaan kehakiman tetap menjadi materi muatan yang penting dan mendasar dalam UUD 1945. Salah satu proses pembentukan hukum dapat terjadi pada badan peradilan melalui putusan hakim, oleh sebab itu substansi perubahan dalam UUD 1945 bertujuan untuk meneguhkan independensi kekuasaan kehakiman sekaligus penguatan prinsip pemisahan kekuasaan utamanya dalam bagian kekuasaan kehakiman sebagai bentuk checks and balances

Abstract

The state is obliged to fulfill and protect the rights of its citizens, including the right to citizenship status. This status will facilitate citizens in living their lives, both in the country that grants citizenship status and in other countries. The high mobility of citizens results in boundaries between countries no longer limited by distance and time. As a result, a person's citizenship status can change, either because of personal needs or obligations of the second country which requires citizens to have citizenship status of the country. The problem in this research is to what extent dual citizenship in the perspective of human rights can realize a welfare system ?. This research is a normative study using a statutory approach, historical approach, and case approach. The results of the study indicate that the guarantee of the right to citizenship status is an inseparable part of the concept of human rights as contained in the 1945 Constitution of the Republic of Indonesia. However, with the rapid flow of global developments causing dual citizenship accommodation in Indonesian citizenship law is something that can be applied in the future. Recognition of dual citizenship can be seen as part of the efforts of the state to bring prosperity to all citizens and protect the citizens' rights to citizenship status.

Abstract

The people of Maleo village who work in several companies in Maleo village and its surroundings are less aware of the health rights that must be obtained while working in the company. Therefore, this community service is carried out in the form of Observation and Data Collection, legal counseling, focus group discussions and the preparation of SOPs for complaints regarding the fulfillment of workers' rights. The results of the community service carried out by this team The results of the community service carried out by the community service team after carrying out various community service programs are the existence of valid data on the number of people in Maleo village who work in several companies around Maleo village, the formation of community understanding and knowledge of the health rights that must be obtained by every worker, the knowledge of various problems of fulfillment of rights experienced by workers, and the formation of SOPs for complaints and follow-up handling of problems of fulfillment of rights that are specifically related to the health rights of workers.

Abstract

The oversight function is one of the functions of the DPRD, but it has not worked well in practice. Therefore, through this research, we are trying to generate ideas regarding implementing the DPRD's oversight function on regional government administration, mainly carried out by the Gorontalo Province DPRD. This research is empirical legal research because it examines problems in the legal field, namely in the Gorontalo provincial DPRD as the research object. This qualitative research approach is a way of analyzing research results that produce descriptive data. This research concludes that the form of implementation of the oversight function carried out by the Gorontalo Province DPRD is in two forms, namely: supervision in hearings by inviting stakeholders and direct visits, both planned and unannounced (sudden inspections), as well as supervising the implementation of follow-up actions—results of examination of financial reports by the Financial Audit Agency. Therefore, the implementation of the oversight function carried out by the Gorontalo Provincial DPRD can be improved through the use of social media in receiving reports from the public so that it will make it easier for the monitoring mechanism by the Gorontalo Provincial DPRD as well as to control budget availability in the implementation of regional regulations so that budget allocation for the implementation of regional rules is appropriate. It has been established and can be used efficiently and accountably.

Abstract

The Post-Decision Intersection Between the Supreme Court and the Constitutional Court in Indonesia. The Constitutional Court Decision No. 70/PUU-XXII/2024 and the Supreme Court Decision No. 23/P/HUM/2024, both addressing the age eligibility requirements for candidacy in the 2024 simultaneous regional elections, have reignited tensions between two branches of judicial power. This tension is further exacerbated by the decision of the House of Representatives (DPR), through a Working Committee meeting, to favor the Supreme Court’s ruling. This study aims to analyze the extent of the intersection between the Supreme Court (MA) and the Constitutional Court (MK) by examining their respective decisions. The analysis adopts a normative approach, relying on secondary data as the primary source, supported by statutory, case law, and conceptual approaches to address the core issues. The findings reveal that the overlap between the Supreme Court and the Constitutional Court in conducting judicial reviews of regulations has led to delegitimization between Supreme Court Decision No. 23/P/HUM/2024 and Constitutional Court Decision No. 70/PUU-XXII/2024. To address this issue, both courts must exercise judicial restraint, particularly regarding substantive matters with potential overlap between their jurisdictions. Such restraint is essential to prevent external parties or institutions from exploiting court decisions to advance their institutional agendas, thereby avoiding unnecessary institutional conflicts.
