Abstract

Digitalisasi prosedur perdata di Indonesia bertujuan untuk meningkatkan akses keadilan melalui kemudahan akses informasi dan efisiensi proses hukum. Namun, kelompok rentan, seperti difabel dan masyarakat yang tinggal di pulau kecil, seringkali menghadapi hambatan signifikan dalam memanfaatkan sistem peradilan berbasis digital. Hambatan tersebut meliputi keterbatasan aksesibilitas untuk difabel, infrastruktur teknologi yang buruk di daerah terpencil, dan rendahnya literasi digital. Artikel ini mengkaji dampak digitalisasi terhadap kelompok rentan, dengan fokus pada peran pemerintah dan lembaga peradilan dalam mengatasi hambatan-hambatan tersebut. Hasilnya menunjukkan bahwa meskipun digitalisasi memiliki potensi besar untuk mempercepat akses keadilan, implementasinya perlu disertai dengan perbaikan infrastruktur, desain sistem yang lebih inklusif, dan pelatihan literasi digital untuk kelompok rentan. Rekomendasi utama mencakup penguatan infrastruktur teknologi, peningkatan aksesibilitas digital bagi difabel, serta program pelatihan literasi digital di daerah terpencil.

Abstract

The implementation of the execution of judges' decisions after the Review (PK) raises a dilemma between legal certainty and the protection of the human rights of convicts. On the one hand, the execution of decisions that have had legal force is still necessary to maintain judicial authority and legal consistency. However, on the other hand, the PK as an extraordinary legal remedy opens up room for correction to potentially erroneous decisions, so that the execution cannot be carried out in a hurry. This research uses a normative-sociological approach by examining the Criminal Procedure Code (KUHAP), the Constitutional Court Decision, and the Supreme Court Circular Letter (SEMA) No. 7 of 2014, accompanied by an analysis of the practices of law enforcement officials. The results of the study show the need for regulatory synchronization and institutional reform so that post-PK executions reflect a balance between legal certainty, substantive justice, and the state's responsibility to protect the rights of convicts. Thus, this study emphasizes the importance of harmonization between legal norms and judicial practice to ensure that the execution of judgments not only upholds legal certainty, but also guarantees the protection of human rights.

Abstract

This study examines a court decision concerning an environmental case involving PT Cisadane Raya Chemicals, represented by Johny Sanggam Edison. The case focuses on improper management of hazardous and toxic waste (B3), which created potential environmental pollution. The research applies a normative juridical approach by analyzing the judge’s decision, evidence, and the prosecutor’s claims. The findings indicate that the defendant was legally proven to have violated regulations regarding hazardous waste management. The panel of judges imposed a criminal sanction in the form of a fine and ordered certain evidence to be confiscated or destroyed in accordance with the law. This decision highlights the importance of corporate compliance with environmental regulations and legal responsibility in protecting the environment. Furthermore, it serves as a form of law enforcement aimed at creating a deterrent effect for business actors to prevent similar violations in the future.

Abstract

The dissolution of political parties is one of the Constitutional Court’s authorities to safeguard democracy, state ideology, and the integrity of the Republic of Indonesia. Constitutional Court Decision Number 53/PUU-IX/2011 affirms that the Government is the only party with legal standing to petition for the dissolution of a political party. This study aims to analyze the juridical implications of such exclusivity and the legal consequences arising from a dissolution decision. This research employs a normative legal method through statutory, case, and literature approaches. The results show that limiting legal standing is intended to maintain national stability, but it also restricts citizens’ participation in monitoring political parties. Furthermore, the dissolution of a political party results in the revocation of its legal entity status, termination of its activities, state acquisition of its assets, and restrictions on certain political rights of its officials. Therefore, strengthening legal mechanisms is necessary to ensure legal certainty and uphold constitutional democracy.
