Abstract

Digitalisasi prosedur perdata di Indonesia bertujuan untuk meningkatkan akses keadilan melalui kemudahan akses informasi dan efisiensi proses hukum. Namun, kelompok rentan, seperti difabel dan masyarakat yang tinggal di pulau kecil, seringkali menghadapi hambatan signifikan dalam memanfaatkan sistem peradilan berbasis digital. Hambatan tersebut meliputi keterbatasan aksesibilitas untuk difabel, infrastruktur teknologi yang buruk di daerah terpencil, dan rendahnya literasi digital. Artikel ini mengkaji dampak digitalisasi terhadap kelompok rentan, dengan fokus pada peran pemerintah dan lembaga peradilan dalam mengatasi hambatan-hambatan tersebut. Hasilnya menunjukkan bahwa meskipun digitalisasi memiliki potensi besar untuk mempercepat akses keadilan, implementasinya perlu disertai dengan perbaikan infrastruktur, desain sistem yang lebih inklusif, dan pelatihan literasi digital untuk kelompok rentan. Rekomendasi utama mencakup penguatan infrastruktur teknologi, peningkatan aksesibilitas digital bagi difabel, serta program pelatihan literasi digital di daerah terpencil.

Abstract

Coastal environmental conflicts caused by sea dredging often lead to tensions between fishing communities and parties exploiting natural resources. These tensions frequently escalate into protest actions accompanied by acts of violence. This study aims to analyze the application of criminal law to violent acts during fishermen’s protests and to examine the social implications of handling such cases. The research method employed is a normative juridical approach with qualitative analysis of legislation, legal doctrines, and relevant cases. The findings indicate that the application of criminal law often emphasizes repressive measures without addressing the root causes of environmental conflict, resulting in social impacts such as the marginalization of fishermen and distrust toward law enforcement authorities. A more comprehensive approach is required, integrating the protection of coastal communities’ rights with restorative measures.

Abstract

The implementation of the execution of judges' decisions after the Review (PK) raises a dilemma between legal certainty and the protection of the human rights of convicts. On the one hand, the execution of decisions that have had legal force is still necessary to maintain judicial authority and legal consistency. However, on the other hand, the PK as an extraordinary legal remedy opens up room for correction to potentially erroneous decisions, so that the execution cannot be carried out in a hurry. This research uses a normative-sociological approach by examining the Criminal Procedure Code (KUHAP), the Constitutional Court Decision, and the Supreme Court Circular Letter (SEMA) No. 7 of 2014, accompanied by an analysis of the practices of law enforcement officials. The results of the study show the need for regulatory synchronization and institutional reform so that post-PK executions reflect a balance between legal certainty, substantive justice, and the state's responsibility to protect the rights of convicts. Thus, this study emphasizes the importance of harmonization between legal norms and judicial practice to ensure that the execution of judgments not only upholds legal certainty, but also guarantees the protection of human rights.
