Abstract

Everyone has been a consumer to fulfill their life needs, both primary and secondary needs in order to obtain goods and services, although not everyone has become a business actor, therefore as a consumer, it is not spared from various problems that may occur such as fraud by business actors, fraud and so on, it is necessary to settle consumer disputes properly and correctly, through the courts and outside the court such as the Consumer Dispute Settlement Agency (BPSK) as a new institution that provides opportunities for consumers and business actors to choose one of three consumer dispute resolution mechanisms, namely: Conciliation, Mediation, and Arbitration. This research uses several methods, namely: first, the literature study consists of (a). types of normative legal research or secondary data document studies; (b). the nature of the research in this study using descriptive analysis research; and (c). the types of data consist of primary legal data, secondary legal data, and tertiary legal materials. The second was to interview two members of the Consumer Dispute Resolution Agency (BPSK) in the Tangerang district and one of the administrators at the BPSK secretariat in the Tangerang district.

Abstract

Probation Institute regulated in the Criminal Code called poging according to doctrine is a crime that has been started, but has not been completed or is not perfect, the Criminal Code can threaten an act in order to prevent the occurrence of victims. The Problem Formulation is: How is the Criminal Law Review related to Experiments (poging) in Indonesia?, while the Research Method used is Normative Research, which is obtained from documents or library materials. The objective probation theory that the basis for the conviction of probation is because the act has endangered a legal interest, and the subjective theory of probation that the basis for the conviction of probation is the harmful nature of the perpetrator.

Abstract

AbstractThis community service activity aimed to critically evaluate the implementation of legal philosophy and professional ethics principles in Indonesia's correctional system, focusing on vulnerable groups (women and children). The study was conducted through site visits to the Tangerang Class II A Women's Correctional Facility and the Special Development Institution for Children (LKPA) Tangerang. Using a combination of direct observation, semi-structured interviews, and document analysis, the study assessed how rehabilitation programs align with restorative justice values and the ethical standards expected of modern correctional institutions. These values include equality of capabilities, the non-degradation principle, and agency recognition. The institutions were evaluated for their gender-responsive and child-centered innovations, such as trauma-informed care, arts-based therapy, adaptive education programs, and family mediation initiatives. However, structural issues like overcrowding, insufficient staff-to-inmate ratios, and infrastructure limitations were found to be significant barriers that hinder the realization of human dignity restoration, as mandated by Article 3 of Law No. 12 of 1995. The paper proposes strategic solutions, including institutional collaborations, programmatic innovations, and systemic reforms, to bridge the gap between normative ideals and the current realities of the correctional system. Ultimately, the findings contribute academic insight to support the advancement of a humane, just, and rehabilitative correctional framework in Indonesia. Keywords: restorative justice, vulnerable groups, human dignity. AbstrakKegiatan pengabdian masyarakat ini bertujuan untuk mengevaluasi secara kritis implementasi prinsip filsafat hukum dan etika profesi dalam sistem pemasyarakatan Indonesia, dengan fokus pada kelompok rentan (perempuan dan anak). Studi dilakukan melalui kunjungan lapangan ke Lapas Perempuan Kelas II A Tangerang dan Lembaga Pembinaan Khusus Anak (LKPA) Tangerang. Dengan metode observasi, wawancara, dan analisis dokumen, kegiatan ini menilai kesesuaian program pembinaan dengan nilai-nilai keadilan restoratif. Evaluasi ini berfokus pada tiga pilar utama dalam etika pemasyarakatan modern, yaitu kesetaraan akses rehabilitasi, perlindungan integritas psikologis, dan pengakuan partisipasi aktif warga binaan. Temuan menunjukkan adanya inovasi yang responsif terhadap gender dan usia, termasuk program berbasis potensi lokal, kurikulum edukatif adaptif, serta mediasi keluarga sebagai bagian dari proses restoratif. Meski demikian, keterbatasan struktural seperti kepadatan penghuni, rasio petugas yang rendah, dan minimnya fasilitas fisik menjadi hambatan dalam pencapaian restorasi martabat manusia sebagaimana amanat Pasal 3 UU No. 12 Tahun 1995. Rekomendasi strategis diajukan, antara lain kolaborasi lintas lembaga, pengembangan program non-residensial, serta integrasi pendekatan psikososial dalam pembinaan. Kegiatan ini memberikan kontribusi penting untuk memperkuat sistem pemasyarakatan yang lebih adil dan manusiawi di Indonesia. Kata kunci: keadilan restoratif, kelompok rentan, martabat manusia.

Abstract

The development of digital technology has encouraged the growth of the e-commerce sector in Indonesia, but on the other hand, it poses serious challenges related to the protection of consumers' personal data. This study analyzes the legal responsibility and effectiveness of government supervision of personal data leaks through a 2020 Tokopedia case study, which involved more than 91 million user accounts. The focus of this study is the Central Jakarta District Court Decision No. 235/Pdt.G/2020/PN.Jkt.Pst, where the lawsuit of the Indonesian Consumer Institute Foundation (YLKI) against Tokopedia and Kominfo was rejected only for reasons of absolute competence, without assessing the substance of the violation. This research aims to evaluate the weaknesses of the personal data protection legal system in Indonesia before the enactment of Law No. 27 of 2022 concerning Personal Data Protection, as well as assess the extent to which the Ministry of Communication and Information Technology (Kominfo) exercises its authority and responsibilities as a regulator. Using a normative juridical approach, this study examines relevant legal provisions, legal theories, and court decisions. Theoretically, this research refers to the theory of legal protection (Philipus M. Hadjon), and cybersecurity and data privacy (Daniel J. Solove). The results of the study show that legal protection for digital consumers is still formalistic and not yet substantive, and the lack of repressive actions from the state shows weak accountability in digital supervision. Therefore, a more responsive, accountable, and applicable legal approach is needed in ensuring the protection of personal data in the digital era.

Abstract

Putusan Nomor 164/Pdt.G/2022/PN Ptk merupakan sebuah perkara hak asuh anak yang menimbulkan kontroversi, di mana hak asuh anak yang berusia 4 tahun diberikan kepada ayah, meskipun dalam ketentuan hukum yang berlaku di Indonesia, hak asuh anak pada usia tersebut umumnya lebih diutamakan diberikan kepada ibu. Keputusan ini menjadi sorotan karena adanya tuduhan kekerasan terhadap ibu, yang dalam putusan tersebut tidak didukung oleh bukti sah yang kuat, seperti visum atau hasil evaluasi psikologis yang valid. Penelitian ini bertujuan untuk mengkaji pertimbangan hukum yang dilakukan oleh hakim dalam mengambil keputusan tersebut, serta menilai apakah keputusan tersebut sejalan dengan prinsip kepentingan terbaik bagi anak yang seharusnya menjadi dasar utama dalam penentuan hak asuh. Metode yang digunakan dalam penelitian ini adalah yuridis normatif dengan pendekatan studi kasus, yang mengutamakan analisis terhadap regulasi hukum yang ada dan fakta-fakta dalam kasus tersebut. Hasil penelitian menunjukkan bahwa dalam putusan tersebut, hakim tidak sepenuhnya mempertimbangkan bukti objektif yang ada, baik dalam bentuk fisik maupun psikologis. Keputusan yang diambil berpotensi mengabaikan hak ibu dan, yang lebih penting, kepentingan terbaik anak, yang seharusnya menjadi pertimbangan utama dalam menentukan siapa yang lebih pantas untuk mendapatkan hak asuh.

Abstract

The COVID-19 pandemic has accelerated the digitalization of health services in Indonesia, including the use of the PeduliLindungi application for vaccination certificates. However, the process of printing physical vaccine cards through unofficial third parties in Wonosobo Regency often leads to the leakage of personal data, such as Population Identification Numbers (NIK) and health information, which are misused for cybercrimes such as illegal online loans. This study aims to analyze the legal provisions of personal data protection based on Law Number 27 of 2022 concerning Personal Data Protection (PDP Law) and its application in the case of COVID-19 vaccine certificate data leak in Wonosobo. The research method uses a normative-empirical approach, with a study of legal regulations and primary data from interviews with law enforcement officials at the Wonosobo Police Station. The results show that the PDP Law provides a comprehensive preventive and repressive framework, including criminal sanctions of up to 6 years in prison and fines of up to Rp6 billion, supported by Article 28G paragraph (1) of the 1945 Constitution. However, implementation in Wonosobo is weak due to the lack of digital literacy of the community, lack of evidence, and the priority of restorative justice over repressive enforcement, causing inconsistencies between constitutional guarantees and field practices

Abstract

This research discusses the legal position of motor vehicle credit leasing, especially regarding the resolution of defaults in leasing agreements through the BPSK institution and the dispute resolution mechanism through the leasing channel itself. Motor vehicle leasing agreements often experience default due to the debtor's inability to fulfill installment payment obligations. This research aims to examine the legal position of leasing agreements in relation to default and analyze the dispute resolution mechanism through BPSK. This research uses a normative juridical approach with descriptive analysis. The research results show that leasing agreements have a clear legal basis, even though they are not explicitly regulated in the Civil Code. Default dispute resolution can be done through mediation, conciliation or arbitration at BPSK. Dispute resolution through BPSK provides space for consumers and business actors to reach an agreement without going through a more formal litigation process.

Abstract

The position of the Consumer Dispute Settlement Body in the judicial power law is not as a court institution but carries out an adjudicating function called a Quasi Court with resolution through mediation, conciliation, and arbitration, the decisions of which are final and binding.  The formulation of the problem in this paper is: Why is legal protection needed for consumers as a Quasi Court from the Final Decision of the Consumer Dispute Settlement Agency (BPSK)? Meanwhile, the method used in this research is the normative method, using a statutory and analytical approach, then the legal materials used are primary, secondary, and tertiary legal materials.  Consumers are weaker in existence than business actors, because business actors often carry out actions that can harm consumers to gain profits, therefore consumers need to receive legal protection, even though UUPK has been formed to resolve disputes through the Consumer Dispute Resolution Agency (BPSK), but the BPSK decision which is final and binding has not been fully implemented consistently as stated in the Consumer Protection Law (UUPK), because there is still an opportunity to submit objections for parties who object to the BPSK decision.

Abstract

This community service research aims to analyze the forms of agrarian conflict and the effectiveness of non-litigation strategies in resolving land disputes in Pamijahan District, Bogor Regency. The case involves a landowner, Hlm, who purchased land in 1970 but lost control due to claims by a community organization (ormas) based on an MoU with Perhutani. Using a qualitative case study through interviews, document analysis, and field observation, the study found that mediation and negotiation are effective for restoring ownership rights despite limited formal evidence, emphasizing legality and administrative legitimacy. The study highlights the need to strengthen legal documentation and clarify jurisdictional authority. Its main contribution is offering an evidence-based, non-litigation advocacy model applicable to similar agrarian disputes in local communities.ABSTRAKPenelitian pengabdian masyarakat ini bertujuan menganalisis bentuk konflik agraria dan efektivitas strategi non-litigasi dalam penyelesaian sengketa tanah di Kecamatan Pamijahan, Kabupaten Bogor. Kasus ini melibatkan pemilik tanah berinisial Hlm yang memiliki bukti pembelian tahun 1970, namun tidak dapat menguasai lahannya karena diklaim organisasi kemasyarakatan (ormas) berdasarkan MoU dengan Perhutani. Metode penelitian menggunakan pendekatan kualitatif studi kasus melalui wawancara, analisis dokumen, dan observasi lapangan. Hasil pendampingan menunjukkan bahwa mediasi dan negosiasi dapat menjadi strategi efektif untuk memulihkan hak kepemilikan meski bukti formal terbatas, dengan menekankan aspek legalitas dan legitimasi administratif. Penelitian ini menegaskan pentingnya penguatan bukti hukum dan transparansi yurisdiksi. Kontribusi utama penelitian ini adalah memberikan model advokasi non-litigasi berbasis bukti yang aplikatif bagi penyelesaian konflik agraria serupa di tingkat masyarakat lokal.

Abstract

This research examines the legal implications of eliminating the outsourcing system in Indonesian labor law amid ongoing debates post-Job Creation Law. The objective is to analyze impacts on worker protection, business legal certainty, and state regulatory roles. Employing normative juridical methods with statute and conceptual approaches, supplemented by empirical data, the population comprises outsourcing workers, practitioners, and employers in Tangerang Regency, using purposive sampling of experienced respondents. Instruments include semi-structured interviews and structured questionnaires, analyzed via qualitative descriptive techniques with data triangulation. Findings reveal outsourcing enhances business efficiency but causes job insecurity, wage disparities, and tripartite supervision challenges. Conclusions recommend comprehensive transitional regulations over 2-3 years, BPJS strengthening, and bipartite supervision reforms to balance interests without mass layoffs or economic instability.
