Abstract

The concepts of Sakīnah, Mawaddah, wa Raḥmah constitute a spiritual and emotional trilogy that the Qur'an proclaims as the fundamental goal of marriage (QS. Ar-Rum: 21). This study aims to analyze thematically (maudhū'ī) the integration of these three principles as the main foundation for the development and resilience of Muslim families in the contemporary era. Through a qualitative approach with literature study and thematic interpretation, it was found that Sakīnah (inner peace) functions as a spiritual foundation; Mawaddah (active, passionate love) as the driving force of the relationship; and Raḥmah (loving kindness that is ready to sacrifice) as a safety net and sustainability. The integration of these three elements provides an ideal model for contemporary Muslim families to face challenges such as digital disruption, changing gender roles, and economic pressures. The results of the study confirm that family resilience does not only depend on material aspects, but primarily on the quality of transcendental relationships based on Qur'anic values.

Abstract

This study aims to analyze in depth the methodology and characteristics of Imam ‘Imaduddin Abu al-Fida’ Isma’il ibn ‘Umar ibn Kathir’s (d. 774 AH) thinking in interpreting the verses on marriage in his monumental work, Tafsir Al-Qur’an Al-‘Azhim. As one of the most influential tafsir in the Islamic world, Ibn Kathir's thoughts on family issues have had a significant impact. This study uses qualitative methods with a library research approach and content analysis of Ibn Kathir's interpretation of key verses on marriage, polygamy, leadership in the household (qawamah), divorce, and the rights and obligations of husbands and wives. The results show that Ibn Kathir's main methodology is tafsir bi al-ma'tsur (interpretation based on tradition) which is hierarchical: interpreting the Qur'an with the Qur'an, then with the Hadith, then with the words of the Companions and Tabi'in. His thinking on munakahat issues tends to be textualist-normative, oriented towards fiqh (law), and heavily influenced by the views of the salaf scholars. As a result, Ibn Kathir's interpretation tends to be patriarchal, reflecting the socio-historical context of his time, but it remains a primary reference due to the wealth of historical data it presents.

Abstract

The concepts of nusyuz (disobedience of husband or wife) and syiqaq (escalating disputes) are fundamental frameworks in the jurisprudence of munakahat for analyzing and resolving domestic conflicts. However, existing literature tends to focus on the conventional manifestations of these two concepts. This study aims to reconceptualize nusyuz and syiqaq in the context of the digital era, which has given rise to new forms of problematic issues. Using conceptual analysis methods based on primary sources of Islamic law and contemporary social theories, this article identifies and categorizes forms of "Digital Nusyuz," such as financial nusyuz through non-transparent online transactions, emotional nusyuz through social media interactions, and digital privacy violations as triggers of conflict. Furthermore, this article analyzes how the escalation of digital nusyuz can lead to more complex syiqaq. As a solution, a resolution model is proposed that integrates the role of traditional hakam (peacemakers) with digital literacy and online conflict mediation. The results of this study offer a new framework for legal practitioners, marriage counselors, and judges in Religious Courts to understand and resolve household problems rooted in interactions in the digital world, a contribution that is expected to fill the gap in contemporary Islamic family law studies.
