Abstract

This article aims to analyze the relationship between sharia, fiqh, and qanun from a siyāsah syar'iyyah perspective by examining historical practices during the Ottoman Empire and the Mamluk Dynasty. This research uses qualitative methods with a library study approach, drawing on classical and contemporary literature on Islamic law and Islamic political history. The results show that sharia serves as the primary normative source, fiqh as the dynamic interpretation of Islamic scholars, and qanun as an implementable form of codification of state law. From a siyāsah syar'iyyah perspective, these three elements form an integrative and adaptive relationship in responding to societal needs. Studies of the Ottoman period demonstrate a legal dualism between sharia and qanun that developed into a complex legal system, particularly during the Tanzimat period. Meanwhile, during the Mamluk period and the development of law in Egypt, a transformation from the dominance of fiqh to a legal system influenced by modern codification and Western law is evident. Thus, the relationship between sharia, fiqh, and qanun is not static, but rather dynamic and contextual, and oriented toward achieving public welfare as the primary goal of Islamic law.

Abstract

Artikel ini menganalisis konsep maslahah mursalah dan istishlah dari perspektif ushul fiqh dan mengkaji penerapannya pada kebijakan publik, bioetika, dan lingkungan. Studi ini menggunakan pendekatan kualitatif dengan metode riset kepustakaan, menganalisis literatur klasik dan kontemporer yang relevan. Temuan menunjukkan bahwa maslahah mursalah adalah manfaat yang tidak memiliki legitimasi eksplisit dalam teks namun konsisten dengan tujuan syariah (maqā).SMaslahah mursalah adalah metode ijtihad yang menggunakan pertimbangan manfaat sebagai dasar penentuan hukum. Dalam praktiknya, kedua konsep ini sangat relevan dengan masalah-masalah kontemporer: dalam kebijakan publik, keduanya mendorong regulasi yang berorientasi pada kesejahteraan; dalam bioetika, keduanya mendasari legitimasi praktik medis modern seperti transplantasi organ dan reproduksi berbantuan; dan dalam masalah lingkungan, pendekatan manfaat mendukung prinsip-prinsip keberlanjutan dan konservasi. Dengan demikian, maslahah mursalah dan istishlah menunjukkan fleksibilitas hukum Islam dalam menanggapi dinamika zaman tanpa meninggalkan prinsip-prinsip dasar syariah.

Abstract

Leasing is a permissible contract in Islam. However, if the purpose of the lease transaction creates significant dynamics for Islam, research is necessary to determine its legal basis in Islam. This research was conducted in Sidamanik District, Simalungun Regency, where a Muslim, having been unable to find a tenant for his land for a long time, immediately rented it to someone with the intention of establishing a pig farm on the leased land, despite the exorbitant rental price. This led to environmental pollution and health problems for local residents. This research was conducted to determine the actions of Muslim landowners, analyzing the principles of the Lafadz (words of Islamic law) in transactions, specifically regarding the practice of leasing land for pig farming. In the context of Islamic law, the basic principle of the permissibility of muamalah (economic transactions) is exempted when it comes to activities involving prohibited objects, such as pigs. This study aims to analyze the Islamic legal perspective on land leasing for pig farming and its implications for business actors. The research method used is descriptive analysis with a qualitative approach through a literature review of Islamic legal sources, including the Quran, Hadith, and the opinions of scholars. The results indicate that the practice of land leasing for pig farming has generated differing opinions among scholars, with the majority deeming it prohibited based on the prohibition of pork in Islam. This research is expected to contribute to the development of a deeper understanding of muamalah law and its application in the contemporary context, as well as provide guidance for Muslims in conducting economic activities in accordance with Islamic law
