Abstract

Penelitian ini menjelaskan tentang pasangan suami istri karir di Desa Moawe mewujudkan keluarga sakinah di tengah kesibukan pekerjaan mereka, serta menyelidiki praktik pembagian peran dalam perspektif hukum Islam. Penelitian ini menggunakan metode kualitatif dengan jenis penelitian lapangan (field research) dan pendekatan deskriptif analitis, di mana data dikumpulkan melalui teknik wawancara dan dokumentasi langsung terhadap subjek di Desa Moawe. Hasil penelitian menunjukkan bahwa metode mewujudkan keluarga sakinah pada pasangan karir di Desa Moawe Kecamatan Gunungsitoli Kota Gunungsitoli tersebut meliputi adanya izin suami terhadap istri untuk bekerja, pembangunan komunikasi yang jujur dan terbuka, sikap saling mendukung dalam pembagian tugas rumah tangga, serta penyediaan waktu khusus untuk berinteraksi dengan anggota keluarga. Dalam perspektif hukum Islam, fenomena ini menunjukkan pergeseran ke arah kemitraan yang setara dan tetap sejalan dengan prinsip maslahah selama kewajiban dasar terpenuhi, tidak ada pihak yang dizalimi, dan tetap menjaga batasan syariat seperti menutup aurat serta menjaga etika pergaulan. Secara keseluruhan, kemandirian finansial istri di Desa Moawe terbukti meningkatkan ketahanan keluarga sepanjang dilandasi oleh niat ibadah dan kesepakatan bersama.

Abstract

Marriage in Islam is an act of worship aimed at building a harmonious family based on the theological values of sakinah (love), mawaddah (love), and rahmah (mercy). However, the implementation of marriage law in various Muslim countries has a diverse knowledge base or epistemology. This study aims to examine in depth the differences in the epistemology of marriage law between Indonesia and Saudi Arabia, and their impact on the protection of domestic rights. Using a qualitative approach in normative-theoretical library research, this study dissects secondary data in the form of regulations in Indonesia and legal practices in Saudi Arabia. The research shows that Indonesia implements a positive codified legal system through Law No. 1 of 1974, the Compilation of Islamic Law (KHI), and Law No. 16 of 2019, which provides legal certainty through strengthening administration such as marriage registration and tightening requirements for polygamy. In contrast, Saudi Arabia implements an unwritten legal system (uncodified law) rooted in the methodology of the Hambali School, where legal practice relies heavily on the ijtihad of judges and fatwas of religious authorities. This difference has implications for legal protection policies, such as the strict minimum age limit for marriage in Indonesia (19 years), in contrast to Saudi Arabia, which does not set a rigid legal age limit and still recognizes men's unilateral rights in divorce.

Abstract

Ideally, marriage should create a harmonious family, but household dynamics are often threatened by the threat of rift caused by the phenomenon of nusyuz. Nusyuz is often biasedly identified as a wife's disobedience, even though this attitude can occur reciprocally between partners when they neglect their obligations. The research aims to explain the idea of nusyuz from the perspective of various Islamic schools of jurisprudence and to analyze its adaptation and contextualization in modern practice. Methods The type of library research used is qualitative, normative-theoretical in nature through a comparative approach between schools of jurisprudence. The results of the study indicate differences in the definition of nusyuz and its implications for the right to maintenance among jurists. The Hanafi, Maliki, and Shafi'i schools agree that a wife's right to maintenance is forfeited if she leaves the residence without permission (khuruj), but if the wife refuses intimate relations but lives with her husband (ihtibas), she still has the right to maintenance according to the well-known opinion of the three schools of jurisprudence. In the modern era, physical resolution measures (beating) in QS. An-Nisa: 34 faces legal challenges due to its conflict with Human Rights standards and the Law to End Domestic Violence (UU PKDRT). In conclusion, modern practice deconstructs classical understanding by prioritizing the principle of equal partnership (mubadalah). Nusyuz is now interpreted as a disregard for shared commitments, where refusal of intimate relations for health or psychological reasons is no longer considered disobedience. Conflict resolution is more directed towards psychological approaches, mediation by peacemakers (hakam), and peace (ishlah), while physical action is strictly avoided to uphold humanitarian values.

Abstract

This study examines the method of determining the criteria for kafaah from the perspective of munakahat fiqh as the main foundation for realizing a sakinah family. Kafaah is defined as equality, harmony, or balance between couples who are about to marry to maintain harmony and protect women's rights from the risk of household failure. Legally, Article 61 of the Compilation of Islamic Law emphasizes that religious differences cannot be a barrier to marriage. Scholars from four schools of thought differ on what is considered the elements of kafaah, including freedom, property, profession, and lineage. However, they all agree that the quality of religiosity and morals are the most important requirements. Religion is seen as a pillar of stability because it can guide the soul in facing household problems and prevent the emergence of caste or social stratification that contradicts the principle of piety, as mentioned in QS. Al-Hujurat verse 13. To evaluate the tension between classical texts and contemporary sociological realities, this study uses a qualitative descriptive-analytical and juridical-normative approach. Research shows that kafaah is a customary requirement for marriage, not a legal requirement. This allows women and their guardians to choose an equal partner to achieve a harmonious, stable, and lasting marriage.Keywords: kafaah criteria, sakinah family, munakahat fiqh perspective.

Abstract

Child protection in Indonesia is increasingly important, along with the increasing cases of domestic violence, exploitation, and post-divorce custody disputes, which often harm children due to conflicting parental interests. Although Indonesia has regulations such as the Child Protection Law, there is still a significant gap between positive legal norms that tend to be oriented towards worldly aspects and Islamic values, which include spiritual dimensions and the afterlife. This study aims to examine in depth the child protection instruments in Islamic civil law as a comprehensive value foundation, and compare them with the provisions of positive Indonesian law. This study uses a qualitative approach with a normative-theoretical literature study approach where data is obtained from authoritative religious texts, state laws and regulations, and secondary legal literature, which are then analyzed using descriptive-analytical analysis methods. The study shows that Islam prioritizes comprehensive child protection from the time of conception until reaching the age of tamyiz through the fulfillment of basic rights, which include the right to life, recognition of lineage, care (hadhanah), maintenance, and livelihood. All these rights are integrated as part of the main objectives of sharia (maqāṣid al-syarī'ah), especially in protecting the soul (ḥifẓ al-nafs) and protecting offspring (ḥifẓ al-nasl). The conclusion of this article emphasizes that child protection in Islamic civil law is a comprehensive instrument because it combines material and spiritual aspects. and positive state law is crucial for strengthening the moral foundation to ensure the overall well-being of children in the future.
