Abstract

This study aims to analyze legal certainty and the legal consequences of the annulment of Suspension of Debt Payment Obligations (PKPU) and bankruptcy decisions through Judicial Review in Supreme Court Decision Number 24 PK/Pdt.Sus-Pailit/2024. The research method employs normative legal research with statutory, conceptual, and case approaches, analyzed through the theory of legal certainty and the theory of legal protection. The results show that the annulment of PKPU and bankruptcy decisions through Judicial Review creates legal uncertainty because it eliminates all legal consequences of the Commercial Court and cassation decisions that had obtained permanent legal force. The annulment restores the debtor’s legal status, but at the same time reduces legal certainty for creditors, raises issues regarding the validity of the curator’s actions, and potentially triggers further disputes in bankruptcy proceedings. The study concludes that the availability of cassation and Judicial Review in PKPU cases following Constitutional Court Decision Number 23/PUU-XIX/2021 prolongs debt settlement and weakens the character of PKPU as a fast and final mechanism. Therefore, stricter normative limitations on the use of extraordinary legal remedies are required to maintain a balance between legal certainty and legal protection for both debtors and creditors. Abstract

The settlement of sexual harassment cases through peace agreements based on contracts remains a practice commonly found in society. This practice raises complex legal issues as it lies at the intersection of civil law and criminal law. On one hand, civil law recognizes contracts as legally binding instruments provided that the legal requirements of validity are fulfilled. On the other hand, sexual harassment constitutes a criminal offense, meaning that its resolution cannot rely solely on the agreement of the parties involved. This study aims to analyze the settlement of sexual harassment cases through contractual peace agreements from the perspectives of civil law and criminal law. The research employs a normative legal method using statutory and conceptual approaches. The legal materials consist of primary and secondary sources, which are analyzed qualitatively. The findings indicate that peace agreements in sexual harassment cases may be considered legally valid only if they fulfill the legal requirements of a contract, particularly the existence of free consent and a lawful cause. From a criminal law perspective, a peace agreement between the perpetrator and the victim does not eliminate the unlawful nature of sexual harassment, as such acts involve public legal interests protected by the state. Therefore, peace agreements may only operate within the civil law domain and cannot be used as a basis to negate criminal law enforcement processes.

Abstract

Abstract: The renewal of the Indonesian Criminal Procedure Code (New KUHAP) marks a paradigm shift in criminal law enforcement by integrating restorative justice as an integral part of the criminal procedure system. This approach is explicitly regulated in Articles 83 to 87 of the New KUHAP, which provide opportunities for resolving criminal cases through agreements between victims and offenders at the stages of inquiry, investigation, prosecution, and court examination. This study applies the criminal justice system theory to analyze the integration of authority among law enforcement institutions, as well as restorative justice theories proposed by Howard Zehr, Tony F. Marshall, Muladi, and Barda Nawawi Arief to assess the orientation toward victim and offender restoration in criminal case resolution. The research employs a normative legal method using statutory and conceptual approaches, examining the New KUHAP along with relevant regulations issued by the Indonesian National Police, the Attorney General’s Office, and the Supreme Court. The findings indicate that the New KUHAP establishes a more systematic, structured, and binding restorative justice framework, including mechanisms for terminating inquiry, investigation, and prosecution under the supervision of prosecutors and courts. The study concludes that the effective implementation of restorative justice depends not only on legal norms but also on institutional harmonization, the readiness of law enforcement officials, and the active participation of both victims and offenders. Abstrak: Pembaruan Kitab Undang-Undang Hukum Acara Pidana (KUHAP Baru) menandai perubahan paradigma penegakan hukum pidana di Indonesia dengan mengintegrasikan keadilan restoratif sebagai bagian dari mekanisme hukum acara pidana. Hal ini tercermin dalam Pasal 83 sampai Pasal 87 KUHAP Baru yang membuka ruang penyelesaian perkara pidana melalui kesepakatan antara korban dan pelaku pada tahap penyelidikan, penyidikan, penuntutan, hingga persidangan. Penelitian ini menggunakan teori sistem peradilan pidana untuk menganalisis keterpaduan kewenangan antar lembaga penegak hukum serta teori keadilan restoratif dari Howard Zehr, Tony F. Marshall, Muladi, dan Barda Nawawi Arief untuk menilai orientasi pemulihan dalam penyelesaian perkara pidana. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual melalui kajian terhadap KUHAP Baru serta peraturan Kepolisian, Kejaksaan, dan Mahkamah Agung. Hasil penelitian menunjukkan bahwa KUHAP Baru membentuk kerangka keadilan restoratif yang lebih sistematis, terstruktur, dan mengikat dengan mekanisme penghentian perkara di bawah pengawasan penuntut umum dan pengadilan. Kesimpulan penelitian menegaskan bahwa keberhasilan keadilan restoratif bergantung pada harmonisasi antar lembaga, kesiapan aparat, dan partisipasi aktif korban serta pelaku. Abstract

Abstract: This study analyzes contractual amendments within multiyears integrated con-struction contracts. Such contracts are generally complex and urgent in nature, requiring both the design and implementation phases to be carried out by a single provider, with the contract duration exceeding 12 months. The issues examined concern the legal certainty of contract amendments and the potential legal implications arising from changes to con-tractual clauses in integrated contracts after the completion of the contract period. This research employs a normative legal research method using statutory, conceptual, and case-based approaches. The findings indicate that eleven contractual amendments were made, which should have met the validity requirements of agreements under Article 1320 of the Indonesian Civil Code. Several issues were identified: deficiencies in the legal ca-pacity of the parties signing the amendments, changes to the contract implementation pe-riod that overlooked conditions related to SCM implementation failures, modifications to performance measurement and payment mechanisms that undermined legal certainty, and alterations to project deliverables during contract termination that failed to comply with the specific legal norms governing public procurement. The study results that the amend-ment processes undertaken create potential legal issues concerning the validity of the agreement and the assurance of legal certainty in fulfilling the parties’ rights and obliga-tions. Keywords: Contract Amendment, Integrated Contract, Multiyears. Abstrak: Penelitian ini menganalisis perubahan kontrak konstruksi terintegrasi multi-years. Kontrak konstruksi terintegrasi multiyears umumnya memiliki sifatnya komplek dan mendesak sehingga perancangan dan pelaksanaan dilakukan satu penyedia dengan pelaksanaan kontrak lebih dari 12 bulan. Permasalahan yang dikaji adalah kepastian hukum perubahan kontrak dan potensi dampak hukum perubahan klasul kontrak terin-tegrasi pasca masa pelaksanaan kontrak berakhir. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan pendekatan kasus. Hasil penelitian menunjukkan bahwa telah dilakukan 11 kali peru-bahan kontrak yang seharusnya memenuhi syarat sahnya perjanjian Pasal 1320 KUHPerdata. Dalam hal perubahan para pihak penandantangan kontrak memiliki kelemahan kecakapan, perubahan waktu pelaksanaan kontrak mengabaikan kondisi keg-agalan pelaksanaan SCM, perubahan pengukuran prestasi dan pembayaran pekerjaan yang tidak mendukung kepastian hukum atas sesuatu hal, dan perubahan keluaran da-lam pengakhiran kontrak yang mengabaikan norma-norma leg spesialis pengadaan ba-rang/jasa pemerintah. Hasil penelitian menunjukkan bahwa proses perubahan yang dil-akukan menimbulkan potensi permasalahan hukum atas kebasahan perjanjian dan kepastian hukum dalam pemenuhan hak dan kewajiban. Abstract

This study is motivated by the existence of dual mechanisms of accountability for members of the Indonesian National Police (Polri) who commit narcotics-related crimes, namely criminal proceedings in the general courts and ethical-administrative proceedings through the Police Professional Code of Ethics Commission (KKEPP). This dual system often raises debates regarding the legitimacy of ethical sanctions, the application of the ne bis in idem principle, and the consistency of law and ethics enforcement within the Indonesian legal system. The purpose of this research is to analyze the legal accountability system for Polri members who commit narcotics crimes in both the criminal and ethical domains, as well as to examine the principles of professional ethics in relation to criminal court decisions and KKEPP decisions. This research applies the legal system theory and professional ethics theory. The method used is normative legal research with statutory, conceptual, and case approaches. The results show that the Indonesian legal system recognizes criminal and ethical accountability as two distinct but complementary mechanisms. Criminal court decisions determine the legal guilt of the offender, while KKEPP decisions assess integrity, moral responsibility, and the professional suitability of Polri members. Ethical sanctions in the form of Dishonorable Discharge (PTDH) do not violate the ne bis in idem principle because they fall within the domain of administrative law and professional ethics. The relationship between criminal and ethical decisions is complementary and plays an important role in maintaining professional integrity, institutional professionalism, and public trust in Polri
