Abstract

This study examines the legal framework and enforcement efforts to combat the circulation of illegal cigarettes in Indonesia, with a focus on the “Gempur Rokok Ilegal” program implemented by the Directorate General of Customs and Excise (DGCE) in the jurisdiction of KPPBC TMP B Surakarta. Using a doctrinal legal research method with statute and conceptual approaches, the research analyzes preventive and repressive enforcement measures against violations in tobacco excise. Findings show that despite extensive campaigns and enforcement, the distribution of illegal cigarettes remains high, influenced by economic incentives, weak deterrence, and geographic proximity to major tobacco-producing regions. The study concludes that optimal law enforcement requires more intensive surveillance, stronger community involvement, and stricter penalties to deter offenders, thereby safeguarding state revenue from tobacco excise.

Abstract

The execution of mortgage rights through auction mechanisms should ideally provide legal protection and certainty for creditors and auction winners acting in good faith. However, in practice, the process of vacating the collateral object after the auction often faces legal and non-legal obstacles that prevent the auction winner from immediately taking physical possession of the object, even though ownership rights have been legally transferred through the auction minutes. This study aims to analyze the legal implications of these obstacles to eviction on the legal certainty of auction winners. The research uses a normative legal method with a legislative approach and a case approach through analysis of the Mortgage Law, SEMA, Minister of Finance Regulations, and court decisions. The results of the study show that the Mortgage Law does not explicitly regulate the mechanism for vacating the object after the auction, thus creating a normative vacuum and differences in interpretation in practice. Meanwhile, SEMA Number 4 of 2014 functions as a policy regulation and does not have substantive binding force. As a result, auction winners often experience delays in physical possession, cost losses, and legal uncertainty. This study concludes that regulatory updates are needed regarding the post-auction eviction mechanism, strengthening the authority of the implementing agency, and harmonizing procedural law so that protection and legal certainty for auction winners acting in good faith can be effectively realized.

Abstract

This article examines legal protections for bona fide buyers in informal land transactions, referencing Cirebon District Court Decision Number 59/Pdt.G/2022/PN Cbn as a key legal basis. It focuses on the conflict between the formal land registration regime outlined in Article 19 of Law No. 5 of 1960 and Article 37 of Government Regulation No. 24 of 1997, which mandates a PPAT deed, and the reality of community-based informal transactions. The study employs a normative juridical approach, including legislative, case, and conceptual analyses, along with prescriptive-argumentative methods to interpret the judge's considerations. Findings indicate that the court evaluated the agreement’s validity, the seller's authority, payment status, and the plaintiff’s control over the property as grounds for ratifying the transaction. As a good-faith purchaser, the plaintiff deserves legal protection, making the decision a means to legitimize administrative processes judicially. This ruling promotes substantive justice and legal certainty by updating land registration data and highlights a regulatory gap: protection currently relies on litigation rather than preventive administrative measures. Strengthening administrative legalization procedures for private transactions and establishing normative criteria for good-faith buyers are crucial steps toward achieving just and certain land law in Indonesia.

Abstract

This  article  analyzes  the  formal  requirements  of  the  class  action  mechanism,  specifically  the "commonality of  facts or events" and "commonality of  legal grounds," using a systematic interpretation method. The purpose of this article is to identify a singular interpretation of the terms "commonality of facts or events" and "commonality of legal grounds" based on legislation and legally binding court decisions. The findings demonstrate that the formal requirements of "commonality of facts or events" and "commonality of legal grounds" can be met if the plaintiff is able to establish a clear connection between the representative and the group members being represented. The commonality in question includes the type of loss, interest or claim, and the legal grounds invoked.

Abstract

This article analyzes the mechanism for distributing damages to class members in class action lawsuits in Indonesia, focusing on Court Decisions Number 5/Pdt.G/2023/PN Sbh and Number 26/PDT.G/2009/PN.TPI. The study employs a normative juridical method with a statutory approach and a case approach to both court decisions. The research sources consist of primary and secondary legal materials. Legal materials were collected through the library research method. The analysis was conducted using a descriptive method to provide a detailed overview of the class action mechanism. The findings reveal significant variations in the implementation of damage distribution mechanisms as regulated in Article 9 of Supreme Court Regulation Number 1 of 2002. The Sibuhuan District Court applied a simple distribution system through community leaders, while the Tanjung Pinang District Court adopted a more structured mechanism by establishing a special commission. The Tanjung Pinang District Court also implemented membership verification and a clear time limit in the damage distribution process. The findings indicate that the absence of clear and consistent procedural standards in compensation distribution may impede the achievement of substantive justice for class members. The research recommends regulatory improvements to establish more systematic and measurable compensation distribution mechanisms in class action cases in Indonesia.

Abstract

This study analyzes the alignment of judicial considerations in deciding criminal cases related to causing fires, as outlined in Decision Number 51/Pid.B/2021/PN Jkt.Sel, with Article 183 of the Indonesian Criminal Procedure Code (KUHAP). This research employs a normative legal approach with a prescriptive and applied nature. The methodology used is a case approach. The types of legal materials utilized include primary and secondary legal materials. The data collection technique employed is library research. The legal material analysis technique used is syllogistic deduction. The findings of this study indicate that the judicial considerations in deciding the criminal case of causing fires in Decision Number 51/Pid.B/2021/PN Jkt.Sel are consistent with Article 183 of KUHAP.

Abstract

Penelitian ini menganalisis alasan pengajuan kasasi Penuntut Umum yang dikabulkan oleh Mahkamah Agung dalam perkara narkotika, terkait kesalahan judex facti menerapkan hukum. Tujuan artikel ini adalah untuk membuktikan apakah alasan kasasi dan pertimbangan Mahkamah Agung dalam mengabulkan kasasi Penuntut Umum telah sesuai ketentuan Pasal 253 Ayat (1) KUHAP. Metode penelitian yang digunakan adalah penelitian hukum normatif sehingga sifat penelitian ini adalah perskriptif dan terapan dengan pendekatan studi kasus. Pengumpulan bahan hukum dilakukan dengan cara studi kepustakaan bersumber dari bahan hukum primer dan sekunder. Teknik analisis bahan hukum menggunakan metode deduksi silogisme. Berdasarkan hasil penelitiandan pembahasan dari permasalahan tersebut, disimpulkan bahwa pertimbangan Mahkamah Agung mengabulkan kasasi Penuntut Umum telah sesuai dengan ketentuan Pasal 253 Ayat (1) KUHAP, sebab fakta-fakta di persidangan menunjukan judex facti telah salah dan keliru menerapkan hukum dalam memutus perkara ini oleh hakim pengadilan sebelumnya
