Abstract

This study aims to conduct a normative analysis of the role of law enforcement officials in combating drug smuggling, with a specific focus on the involvement of corrupt officials in such crimes. This issue is critical because the involvement of law enforcement officials not only undermines the integrity of law enforcement institutions but also has the potential to weaken the effectiveness of comprehensive narcotics eradication efforts. This study examines the legal framework regarding the roles, authorities, and responsibilities of law enforcement officials within the criminal justice system, and evaluates its alignment with actual practices on the ground. Additionally, the study analyzes the forms of criminal liability and the sanctions imposed on officials involved in drug smuggling. The method used is normative legal research employing a statutory approach and a conceptual approach. Legal sources include primary legal materials in the form of laws and regulations related to narcotics and law enforcement, secondary legal materials such as books, journals, and legal doctrines, as well as tertiary legal materials for supplementary purposes. Legal materials were collected through a literature review, which was then qualitatively analyzed to produce systematic conclusions. The results of this study are expected to contribute to strengthening law enforcement and enhancing the integrity of law enforcement officials in efforts to eradicate narcotics smuggling.

Abstract

Perkembangan industri musik digital telah mengubah secara mendasar pola produksi, distribusi, dan konsumsi karya cipta, sekaligus menantang sistem perlindungan Hak Kekayaan Intelektual (HaKI) yang berlaku. Di Indonesia, kebijakan mengenai pengelolaan royalti diatur melalui Peraturan Pemerintah Nomor 56 Tahun 2021 tentang Pengelolaan Royalti Hak Cipta Lagu dan/atau Musik. Namun, implementasi kebijakan ini menghadapi berbagai kendala, antara lain keterbatasan sistem pelacakan digital, ketimpangan akses antara pencipta lokal dan platform global, serta lemahnya transparansi dalam distribusi nilai ekonomi. Penelitian ini bertujuan untuk menganalisis efektivitas kebijakan perizinan dan pembayaran royalti musik digital dalam melindungi hak ekonomi pencipta, serta menawarkan model rekonstruksi kebijakan yang adaptif terhadap perkembangan teknologi digital. Pendekatan yang digunakan adalah yuridis-normatif dengan perspektif sosiolegal, memanfaatkan teori Code is Law (Lawrence Lessig) dan Hak sebagai Relasi Sosial (R. George Hughes) sebagai pisau analisis. Hasil penelitian menunjukkan bahwa regulasi nasional belum sepenuhnya mampu mengimbangi kekuasaan algoritmik platform digital yang menentukan arus nilai royalti secara otomatis. Oleh karena itu, diperlukan rekonstruksi kebijakan berbasis kolaborasi antara pemerintah, lembaga manajemen kolektif, dan penyedia layanan digital untuk menciptakan sistem perizinan dan pembayaran royalti yang transparan, inklusif, dan berkeadilan.

Abstract

This research is motivated by the high prevalence of debtors transferring fiduciary security objects without the creditor's consent, which potentially results in legal losses for the creditor. This study aims to analyze the differences and alignment of regulations regarding the transfer of fiduciary security objects in positive law and Islamic law, specifically through the concept of rahn tasjily. The method employed is normative legal research with conceptual and comparative law approaches. The results indicate that in positive law, the transfer of fiduciary security objects is restricted and requires written consent from the creditor. Meanwhile, in Islamic law, through the rahn tasjily concept, such transfer is permissible while remaining grounded in the principles of prudence, justice, and the protection of all parties. The novelty of this research lies in the construction of a normative harmonization between positive law and Islamic law to strengthen creditor protection within a dual legal system.

Abstract

This study analyzes normative issues in the regulation of law enforcement regarding domestic sexual violence based on Law Number 23 of 2004. The study focuses on the discrepancy between the construction of legal norms and the need for victim protection. The method used is normative legal research with a statutory and conceptual approach. The results indicate weaknesses in the norms, particularly regarding the lack of explicit regulation of the concept of consent in marital relations and the failure to accommodate the characteristics of sexual violence in the private sphere. Furthermore, a disharmony was found with more recent developments in sexual violence regulations. Therefore, operational steps are needed in the form of reformulating the norms in Law Number 23 of 2004, developing interpretation guidelines based on victim protection, and harmonizing them with related regulations to achieve more effective and equitable law enforcement.
