Abstract

Women’s representation in parties and legislative institution is closely related to Indonesian’s party typology as office seekers. It charted descriptive mandate to fulfill 30% quote of women’s representation in General Election 2014—not necessary representing women’s critical agenda. The phenomena of female legislators working previously as celebrities, actress, singers, or coming from political dynasty is the consequence of office seekers parties. It does not then guarantee the promotion, empowerment and protection of women’s critical issues in societies as they are not representing women in general substantively. It is necessary to create female critical actors coming to office in political parties to succeed feminist agenda.

Abstract

Violence against women is still a thorny issue in Indonesia. Data of Lembar Fakta Catatan Tahunan (CATAHU) from National Commission for Women in 2015 reached to 16.217 cases. Discrimination of local regulations, religious intolerance, death penalty policy, evictions, and political conflicts are considered associated with it. Resistance to this issue has been conducted through social movements (women), but the results have not been succesful. The development of the women’s movement has shifted from the old social movements (physical) towards new social movements (digital). Advancement in technology of new media communication hasprovide a space for people to interact in a novel patterns. Internet is considered as a medium capable of facilitating the movement of women to communicate their aspirations, mobilizing the masses to make collective actions. This paper aims to describe the transformation of communication through new media in the women’s movement for gender justice with case studies in Surakarta and Yogyakarta. This study is conducted in several groups of the women’s movement which are based in community and NGO.

Abstract

Discourse of sexual violence bill as a special legal protection has been rolled out in accordance with various criticisms towards Criminal Code. Meanwhile, the weaknesses of substance of legislations on protecting sexual violence victim take part to strengthen the discourse. Furthermore, various facts that show obstacles experienced by sexual violence victim to achieve justice in criminal justice system become a cornerstone to raise victim-oriented perspective on legislations. This paper will elaborate urgency of sexual violence bill appearance based on availability of legislations provide protection for victim. The paper will spell out various obstacles faced by women who experienced sexual violence when seeks justice through criminal justice system as well. Moreover, the paper will look opportunity to objectify the bill based on progress of National Legislation Program.

Abstract

The paper brings about the personal experience of Indonesian women citizen (WNI) who marry to foreigners (WNA) in obtaining access to their right in land ownership and in struggling to challenge the constrains and strategies in order to have their rights rehabilitated by the state who has been treating the citizen unfairly. The marriage status has caused women to be discriminated if they don’t have a prenuptial agreement. The research uses feminist-perspective qualitative methodology, reinforced by three theories, namely multicultural feminism, feminist legal theory, and access to justice theory. There are three findings of the research. First, the prenuptial agreement places woman WNI in a dilemmatic position to choose between access to land ownership rights or joint marital property. Second, some see this and name it as legal smuggling or some dub it legal breakthrough. Third, it is necessary to build solidarity to unite in struggling for change against discriminative policy, by involving and being involved in voicing woman experience to rehabilitate equality of rights before the law.

Abstract

The law restricting abortion in Indonesia and Malaysia doesn’t prevent any abortion, but instead, it forces women to take the health and life risk by using an unsaved abortion method. However, medical abortion in women’s residence by using mifepristone and misoprostol is very safe and effective, as mentioned in a research done by the WHO (2012). The research analyzes the figure of needs of Women on the Web service in 2015. Women on Web portal is visited by 355,004 visitors from Indonesia and 33,781 from Malaysia in 2015. As much as 1.989 women from Indonesia and 1.109 from Malaysia contacted the helpdesk of Women on Web. The figures show that there is a big need of information and access to safe medical abortion in Indonesia and Malaysia.

Abstract

Riset kali ini menarasikan perjumpaan antara agama dan politik di Pemilihan Legislatif 9 April dan Pemilihan Presiden 9 Juli 2014 (selanjutnya disingkat Pemilu: Pileg dan Pilpres) dalam menimbang status perempuan. Pendekatan feminisme kerap curiga dan tak percaya bagaimana aliansi kedua terminologi itu dapat dan bisa sungguh-sunguh melayani amanat keadilan gender dan keadilan sosial. Disamping melakukan dokumentasi teoritis, kajian pada Jurnal Perempuan Edisi 82 kali ini, salah satunya, merupakan dokumentasi FGD (Focus Group Discussion) yang dilaksanakan pada Selasa 1 Juli 2014 jam 13-17 WIB di kantor Yayasan Jurnal Perempuan, Jakarta. FGD ini difasilitasi oleh Mariana Amiruddin (Dewan Redaksi Jurnal Perempuan) dengan narasumber berikut: Ade Kusumaningtyas (RAHIMA), Husein Muhammad (Komnas Perempuan), Siti Khadijah Nasution (Kementrian Pemberdayaan Perempuan dan Perlindungan Anak), Manneke Budiman (FIB, UI), Masruchah (Koalisi Perempuan Indonesia), Muhamad Ali (Univ California, Riverside), Nur Iman Subono (FISIPOL UI), Septemmy Lakawa (Sekolah Tinggi Teologi Jakarta), Siti Musdah Mulia (Megawati Institute) dan Titi Sumbung (Indonesian Center for Women in Politics). Bahasan konseptual ketiga 113 terminologi pada judul di atas, akan dilengkapi dengan fakta-fakta politik tahun 2014 ini, yaitu fakta Pileg dan fakta Pilpres.
