Abstract

This research discusses the interpretation of the Constitutional Court in reviewing laws regarding the formation of regions whose decisions grant the petitioner’s petition which have implications for changes in territorial boundaries, namely the Constitutional Court Decision No. 127 / PUU-VII / 2009. There are two problems examined in this research, namely (1) How is the interpretation of the Constitutional Court in resolving territorial boundary disputes through testing the laws in review of the 1945 Constitution; (2) How the design of territorial boundary dispute resolution constitutionally. The research method used is normative juridical research using a conceptual approach. In addition, it is reviewed with case studies related to the material being studied. The results of this study are (1) Based on the review of the Constitutional Court decision no. 127 / PUU-VII / 2009 which granted the request for judicial review of Law No. 56 of 2008 concerning the Establishment of Tambrauw Regency, the Constitutional Court stated that the legislators had ignored the aspirations of the people of Tambrauw Regency who had divided its territory from 10 (ten) districts into 5 (five) districts. This decision implied that 5 districts were re-entered into Law no. 56 of 2008 added 1 (one) district namely Fef District so that Tambrauw Regency has 11 (eleven) districts. Second, the design for the settlement of territorial boundaries is regulated in Permendagri Number 141 of 2017 and Law Number 23 of 2014, namely through Administrative (nonlegal) settlement by the Governor and the Minister of Home Affairs. In addition, legal dispute resolution is carried out through the Minister of Home Affairs’ judicial review rights at the Supreme Court and the Constitutional Court through judicial review of regional formation laws.

Abstract

In 16 August 2019, the President of Republic of Indonesia gave speech on an idea of the translocation of the Indonesian capital city. The new capital city has also already decided by the President. The decision is made before the legal analysis including the legal basis of the decision to have new capital city. This paper will discuss the concept of the capital city from general- legal perspective to comparative perspective. This paper also discuss on how the concept of capital city is developed in Indonesia from the historical constitutional perspective. It will also analyze the presidential authority on the idea of proposing and deciding the translocation of the capital city. The argument in this paper is written as a legal argument by having perspective on the doctrinal-legal approach. It will use conceptual approach, legal and statutes approach and constitutional history approach. This paper ends up with the conclusion that the concept of the Indonesian capital city is different from the concept of the capital city in other countries, such as the Netherlands and Malaysia. In both countries, the concept of capital city is separated from the concept of government city, which is as the city center for governmental affairs. Besides, it is concluded that based on the Indonesian Constitution, the President of Republic of Indonesia has no absolute authority on the issue of translocation of the capital city. The President of Republic of Indonesia may have the power to propose the translocation of the capital city but there shall be further process of joint discussion and joint approval by the President and the DPR.

Abstract

The Constitutional Court Decision Number 97 / PUU-XI / 2013 is a constitutional affirmation of the Court to relinquish its authority to resolve disputes over the results of regional head and deputy regional head elections. Given that conceptually the elections for regional heads and deputy regional heads are not included in the general election regime. After the decision of the Constitutional Court was issued Law Number 1 of 2015 as amended several times, most recently by Law Number 6 of 2020 which explicitly regulates and mandates the establishment of a special judicial body to handle disputes over election results. Neither the Constitutional Court decisions nor the Laws explain in detail the design of a special court that deals with disputes over election results. Therefore, this paper intends to answer research questions about; first, if the Constitutional Court has put the authority to resolve the election result dispute, what is the direction of the Constitutional Court’s thought in designing the settlement of the election result dispute based on decision Number 97/PUU-XI/2013? Second, the Constitutional Court Decision has been enumerated into the Election Law, is it in line with the Constitutional Court’s thoughts in the decision Number 97/PUU-XI/2013 with the normalization in the Election Law regarding disputes over results? third, how is the design of a special judicial body in line with the decision Number 97/PUU-XI/2013 and the Election Law? The research method used in this research is normative research with a statutory approach, conceptual approach, and case approach, with sources of literature law and prescriptive analysis techniques. The findings of this study are; First, the Decidendi Ratio of the Constitutional Court decision Number 97/ PUU-XI/2013 seems to implicitly place the authority to resolve disputes over the results of the elections as part of the authority of the Supreme Court. Second, the normalization of the Pilkada Law related to the settlement of election result disputes is in line with the Constitutional Court’s decision. Third, the design of a special electoral judiciary body is formed under the Supreme Court.

Abstract

In comparative constitutional law, the doctrine of unconstitutional constitutional amendments has in recent years attracted wide attention among scholars. The consequence of the doctrine is that there are limits to constitutional amendments. This paper seeks to explore theories that explain how authorities to amend the constitution may be limited. In addition, it also discusses the practice of the doctrine of countries such as Germany, India and Colombia. Drawing from the experiences of these countries, it attempts to answer whether the doctrine can be used in the Indonesian constitutional system. It argues that under the 1945 Indonesian Constitution, there exist unamendable provisions. Therefore, the Constitutional Court might adopt the view that there are limits to constitutional amendments in Indonesia if there was a constitutional amendment to unamendable provisions. This doctrinal legal research uses normative legal and comparative approaches.

Abstract

Cases of piracy against patents or trademarks are cases that often occur in Indonesia. Responding to these challenges, this study aims to find out how the legal protection of citizens economic constitutional laws through patents in Indonesia. This research is prescriptive legal research and was carried out using systematic literature review methods. The research data is sourced from rules and regulations in force in Indonesia, books, and articles from national and international journals that discuss patent rights. The researcher then analyzed the data collected in a descriptive qualitative manner. The results of this study indicate that the Indonesian government protects the constitutional rights of its citizens through patents by registering their work or products by the provisions in force in Indonesia. However, when the work or product is not registered, the product is not protected by law. For this reason, citizens who have works and products that are economically valuable that allow them to be reproduced are advised to register their products or works through patents.

Abstract

This paper is directed to notice about the limits of authority formation Government Regulation in Lieu of Act (PERPU) as outlined in Article 22 of the Indonesia Constitution 1945 as the excesses of the state that are considered critical and pushy or in legal terminology often referred to as matters of urgency to force. Nevertheless, the existence of Article 22 Indonesia Constitution 1945 as the legal basis of the authority of the President in the form Government Regulation in Lieu of Act (PERPU) not provide any legal certainty regarding presidential authority limits in the PERPU formation. The nature of subjectivity strengthened in the President becomes a problem and the pros and cons in any talks regarding the formation of this Government Regulation in Lieu of Act (PERPU) by using the methodology of normative legal research and the study of literature and used conseptional approach. On conclusion that there are three (3) main principal requirement Government Regulation in Lieu of Act (PERPU) their formation performed by the President based on the provisions of Article 22 of the 1945 Constitution and the law analisan results in this paper. These three things first is the limitation of time (when) a Government Regulation in Lieu of Act (PERPU) which by Maria Farida is limited (temporary) and limits the material (substance) were interpreted in the Constitutional Court Decision Number 138 / PUU-VII / 2009 as well as limits to the protection of the constitutional rights of the people.

Abstract

The concept of mineral and coal mining management provided by business entities, cooperatives and individuals as regulated in Law No.3 of 2020 concerning Amendments to Law No.4 of 2009 concerning Mineral and Coal Mining which is managed under the concept of a Mineral and Coal mining company. constitution based on the 1945 Constitution. The research method used is juridical normative, resulting in that the form of mineral and coal mining companies by the 1945 Constitution is a business entity, cooperative or individual listed in the Mineral and Coal Mining Law. which has a cooperative nature by the 1945 Constitution.

Abstract

The discourse regarding the determination of the taxpayer standing in judicial review is not a completely new issue to be analyzed. However, it still needs to be examined in the framework of exploring the legal ratio for determining taxpayer standing in judicial review by the Constitutional Court. The findings of this research are an inseparable part of legal research in doctoral degree regarding the dynamics of the Petitioner’s legal standing in judicial review by the Constitutional Court. This research specifically answers the following questions: (a) how is the taxpayer doctrine as a legal standing in judicial review? (b) What is the legal ratio for determining taxpayer standing in judicial review by the Constitutional Court? This is normative legal research, by analyzing secondary data in the form of statutory regulations, Constitutional Court decisions, and literature related to the doctrine of the taxpayer standing in judicial review. The results indicate that the legal ratio for determining taxpayer standing in a judicial review can be traced through the legal considerations of the Constitutional Court decisions in judicial review since 2003-2019.

Abstract

Kebijakan perusahaan atau instansi yang melarang seorang pegawai menikah dengan rekan kerja sering dianggap wajar untuk mencegah konflik kepentingan dan penurunan kinerja pegawai. Akibatnya pasangan pegawai itu berada pada pilihan yang sulit yakni terpaksa berhenti bekerja ataukah merahasiakan status perkawinan mereka. Mahkamah Konstitusi menilai bahwa ketentuan di dalam UU Nomor 13 Tahun 2003 tentang Ketenagakerjaan yang membuka ruang bagi perusahaan/instansi untuk menerbitkan larangan demikian adalah inkonstitusional. Hal ini bertentangan dengan hak untuk bekerja yang diatur dalam UUD 1945. Penelitian ini menggunakan metode penelitian hukum doktrinal, menunjukkan bahwa Putusan Mahkamah Konstitusi Nomor 13/PUU-XV/2017 mengenai konstitusionalitas perkawinan antar-pegawai dalam perusahaan yang sama belum sepenuhnya dipatuhi. Beberapa kantor yang masih menerapkan larangan ikatan perkawinan antar-pegawai hendaknya segera mencarikan solusi yang dapat diterima oleh semua pihak dalam rangka melindungi hak konstitusional pegawai sekaligus kepentingan perusahaan.

Abstract

Discourse about periodization of the term of office of the Constitutional Court judge ended at the Constitutional Court Decision Number 53/PUU-XIV/2016 and Number 73/PUU-XIV/2016 which transferred the authority of regulating the term of the constitutional judge to be fully regulated by the legislators (open legal polic). This article discusses the problem of the term of office of the Constitutional Court judge, if it is regulated as an open legal policy for the quality of the independence of judicial power held by the Constitutional Court. This article was prepared based on the results of normative legal research using the statutory approach. This article provides two conclusions. First, the open legal policy in determining the periodization of the term of constitutional judge has the potential to reduce the degree of independence of the judicial power. Second, a relatively long period of time is an ideal concept for the term of office of constitutional judge. The term of office of constitutional judge should be aligned with the Supreme Court’s tenure.
