Abstract

Although there was a displecement of legislative power from president tohouse of respresentative after the amandement of indonesian constitution1945, the president still has major authority in proferring draft of law, themovement of president in discussing draft of law together with house ofrepresentative aimed at gaining common agreement (section 20, article (2)constitution of 1945, basically there is no different prior to the amandement ofindonesian institution 0f 1945. This mechanism shows that the displacement oflegislative power from president to house of representative (section 5, article(1) and section 20, article (1) of indonesian constitution of 1945) refers to thelinguistic shiffting not to the real meaning of displacement.Keyword: displecement of legislative power

Abstract

Penelitian ini bertujuan untuk mengidentifikasi seberapa urgensi Peraturan Desa dalam penyelenggaraan Pemerintahan Desa serta menganalisis kedudukan Peraturan Desa dalam hierarki Peraturan Perundang-undangan. Penelitian ini menggunakan metode Penelitian Hukum Normatif dengan menggunakan pendekatan Perundang-undangan dan pendekatan Konseptual. Sumber data dalam penelitian ini berasal dari data primer, data sekunder dan data tersier yang dianalisis secara yuridis kualitatif kemudian menarik kesimpulan menggunakan silogisme proses berfikir deduktif untuk menarik kesimpulan bersifat khusus. Hasil penelitian menunjukkan bahwa berdasarkan sejarah Desa, urgensi peraturan Desa dalam penyelenggaraan Pemerintahan Desa yaitu sebagai suatu perangkat dasar legitimasi penyelenggaraan Pemerintahan Desa, dengan kata lain Peraturan Desa disusun sebagai acuan dalam melaksanakan pemerintahan dan pembangunan di Desa sebagai konsekuensi dari Desa sebagai suatu daerah otonom yang berhak mengatur dan mengurus pemerintahannya sendiri. Hal ini diperkuat teori Negara Hukum yang dianut oleh Indonesia yang menimbulkan konsekuensi bahwa pemerintahan harus berdasar kepada konsepsi Negara Hukum yakni pemerintahan berdasarkan peraturan perundang-undangan, yang dalam konsepsi Pemerintahan Desa harus berdasrkan Peraturan Desa. Sedangkan tata susunan hierarki Peraturan Desa tidak terlepas penjabaran materi muatan dan sumber kewenangan pembentukan Peraturan Desa, sehingga hierarki Peraturan Desa dalam peraturan perundang-undangan di Indonesia pada dasarnya berada dibawah Peraturan Daerah Kabupaten/Kota, karena pada Peraturan Daerah Kabupaten/Kota mengatur ketentuan yang memberikan kewenangan delegasi kepada Pemerintah Desa untuk membentuk Peraturan Desa.

Abstract

The Constitutional Court Decision Number 97 / PUU-XI / 2013 is a constitutional affirmation of the Court to relinquish its authority to resolve disputes over the results of regional head and deputy regional head elections. Given that conceptually the elections for regional heads and deputy regional heads are not included in the general election regime. After the decision of the Constitutional Court was issued Law Number 1 of 2015 as amended several times, most recently by Law Number 6 of 2020 which explicitly regulates and mandates the establishment of a special judicial body to handle disputes over election results. Neither the Constitutional Court decisions nor the Laws explain in detail the design of a special court that deals with disputes over election results. Therefore, this paper intends to answer research questions about; first, if the Constitutional Court has put the authority to resolve the election result dispute, what is the direction of the Constitutional Court’s thought in designing the settlement of the election result dispute based on decision Number 97/PUU-XI/2013? Second, the Constitutional Court Decision has been enumerated into the Election Law, is it in line with the Constitutional Court’s thoughts in the decision Number 97/PUU-XI/2013 with the normalization in the Election Law regarding disputes over results? third, how is the design of a special judicial body in line with the decision Number 97/PUU-XI/2013 and the Election Law? The research method used in this research is normative research with a statutory approach, conceptual approach, and case approach, with sources of literature law and prescriptive analysis techniques. The findings of this study are; First, the Decidendi Ratio of the Constitutional Court decision Number 97/ PUU-XI/2013 seems to implicitly place the authority to resolve disputes over the results of the elections as part of the authority of the Supreme Court. Second, the normalization of the Pilkada Law related to the settlement of election result disputes is in line with the Constitutional Court’s decision. Third, the design of a special electoral judiciary body is formed under the Supreme Court.

Abstract

The research aims to know and comprehend the customary law principles as a rule in the exploration of natural resources, to know communities behavior on customary law in exploring the natural resources, and to explain the customary law as a beneficial rule to conserve the natural resources in lore lindu region. It will be conducted through the research method of socio-legal by data collecting will be done by direct observation of the research object as well as interview and participatory appraisal. Secondary data such as documented policy, law and regulations, political agreements, village demographic data, and other supporting data will be collected from various sources of concerns. The result of the research could be revealed as that the customary law principles as a rule in the explorations of natural resources still influence their rule in using its of course lead by head of tribe (totua Ngata) for a long time ago. As well as the communities behavior on customary law in using the natural resources in general. Then the customary law as a beneficial rule to conserve the natural resources in lore lindu region in particular can be assumed, but the intervention of state law or policy made it diminish gradually. Customary law related to forest conservation as a part of their values such as ombo (forbidden) cutting or bring tree or fish in a certain time. Keyword: Formation; Customary Law; Natural Resources; National Park

Abstract

The one of legal functions performed by the Election Law is the function of controlling behavior in the context of social and political life . To carry out this function , the Election Law formulates imperative norms so that political behavior complies with election law . The imperative norm is in the form of rules that prohibit money politics during the campaign , the quiet period and when the ballot takes place . Then, if there is a violation of the rule of law , the culprit will face legal proceedings to obtain criminals sanctions in the form of prisons and fines. Identification of the problem in this research is: why the imperative norms of the Election Law are not effective in preventing the practice of money politics, and what factors influence the weak power of the electoral law imperatives so that massive money politics practices occur? That problem is discussed and analyzed in this article. The author uses normative jurisdiction research, besides that the writer also uses the imperative theory of Edward A. Ross, Achmad Ali’s legal function theory and Jimly Asshiddiqie’s law enforcement theory. From this study the authors found that when the 2019 Concurrent Elections took place, the imperative norm was not effective in controlling political behavior expected by the Election Law. The practice of massive money politics took place so that the process of democracy and the 2019 Simultaneous Elections occurred.

Abstract

Abstract Deconstruction is a thought based on the method of reading texts that are based on philosophical values, since the 2015-2020 regional elections there have been several problems in handling structured, systematic, and massive administrative offences by Bawaslu. This research is a normative juridical research by analysing the laws and regulations related to the simultaneous local elections. This study concludes that the presence of a structured, systematic, and massive concept in the simultaneous Pilkada is based on the concept that was born in the examination of the dispute over the election results by the Constitutional Court which was then normalized into the Pilkada Law. The handling of administrative violations that are structured, systematic, and massive is categorized as difficult to prove because it uses a cumulative element. Deconstruction is carried out by changing the element of evidence in handling TSM administrative violations with an alternative – cumulative element, with the provision that alternative evidence is carried out against acts of promising or giving money or other materials proven massively. This study also suggests making changes in the construction of norms governing structured, systematic, and massive administrative violations in the Pilkada Law by using alternative – cumulative elements to achieve justice. Abstrak Dekonstruksi merupakan suatu pemikiran yang berbasis pada metode membaca teks yang bertumpu pada nilai filosofis. Sejak Pilkada Tahun 2015-2020 terdapat beberapa problematika dalam penanganan pelanggaran administrasi terstruktur, sistematis dan masif (TSM) oleh Bawaslu. Penelitian ini merupakan penelitian yuridis normatif dengan menganalisis peraturan perundang–undangan yang terkait dengan Pilkada serentak. penelitian ini menyimpulkan bahwa hadirnya konsep terstruktur, sistematis dan masif pada Pilkada serentak didasarkan atas konsep yang lahir dalam pemeriksaan sengketa hasil Pilkada oleh Mahkamah Konstitusi yang kemudian dinormakan ke dalam UU Pilkada. Penanganan pelanggaran Administrasi terstruktur, sistematis dan masif terkategori sulit dibuktikan karena menggunakan unsur kumulatif. Dekonstruksi dilakukan dengan mengubah unsur pembuktian dalam penanganan pelanggaran administrasi TSM dengan unsur alternatif–kumulatif, dengan ketentuan pembuktian secara alternatif dilakukan terhadap perbuatan menjanjikan atau memberikan uang atau materi lainnya terbukti secara masif. Penelitian ini juga menyarankan agar melakukan perubahan dalam konstruksi norma yang mengatur pelanggaran administrasi terstruktur, sistematis dan masif di dalam UU Pilkada dengan menggunakan unsur alternatif-kumulatif sehingga dapat mewujudkan keadilan.

Abstract

Handling election violations abroad is one of the determinants of the quality of elections in Indonesia. With the rise of cases that occurred abroad during the 2019 general election, it is hoped that this will be a lesson to make an ideal design for handling election violations abroad in 2024. This research is executed differently from existing or previous research, for Example “The novelty of this research will make a significant contribution to determining the means, size, and function of the parliamentary threshold in the legislative election.” The conclusions of the research show that first, the urgency of handling election violations abroad to create order and peace, protect constitutional rights and uphold justice. Second, to realize the ideal design for handling election violations abroad in 2024, it is carried out increasing the number of members of the Overseas General Elections Supervisory committee from 3 to 5 people, making changes to Article 112 letter c, Article 507 of the Election Law, Article 13 paragraph (4) of the Regulation of General Elections Supervisory Agency Number 7 of 2018 and Article 60 paragraph (1) of the Regulation of General Elections Supervisory Agency Number 8 of 2018, and changing the paradigm of law enforcement from compliance level to internalization of legal Compliance in the 2024 elections.

Abstract

Penelitian ini bertujuan untuk menganalisis penerapan nilai keadilan sebagai dasar pertimbangan Mahkamah Konstitusi No 74/PUU-XVIII/2020 Pengujian Pasal 222 Undang-Undang No 7 Tahun 2017 tentang Pemilihan Umum terkait dengan Legal Standing Pemohon. Penelitian ini merupakan penelitian hukum normatif. Hasil penelitian ini menunjukkan bahwa argumentasi  kerugian  konstitusional  para  pemohon  seharusnya  Mahkamah  Konstitusi  mempertimbangkan  kembali  terkait  kedudukan  hukum  para  pemohon.  Norma ambang batas (presidential threshold) pencalonan  Presiden  dan  Wakil  Presiden  yang  diajukan  oleh  para  pemohon  sangat berpotensi  menimbulkan  kerugian  konstitusional. Para  pemohon  juga  secara  konkret  telah  terjadi  suatu  peristiwa  hukum  dimana  partai-partai  baru  tidak  dapat  mencalonkan  Presiden  dan  Wakil  Presiden  yang  disebabkan  norma  ambang  batas  Pencalonan  Presiden  dan  Wakil  Presiden.  Diperlukan pengaturan  secara  spesifik  terkait  dengan  penentuan  kualifikasi  legal  standing  perkara  abstrak  dan  perkara  konkret  tehadap  pemohon  dua  perkara  tersebut  agar  dapat  terwujudnya  kepastian  hukum  dalam permohonan  judicial  review.
