Abstract

The rules of appointment and dismissal for the attorney generals  need to be regulated concretely in the law. It was not done solely by President but must be on the consideration of Parliament. Therefore, the implementation of its truly free from interference and political interests   of President. Term of office of the of the Attorney General should be established with certainty to avoid multi-interpretations that would lead to legal uncertainty.

Abstract

The research concluded, first, The Constitutional Court decision number 22-24/PUU-VI/2008 give the positive implications of affirmative action policy of women representation in the provincial parliament and regency/town in Yogyakarta, because every legislative candidates have equal opportunity to fight to obtain a majority vote in 2009 legislative elections. Second, when Law no. 10 year 2008 still use a list of serial numbers, women’s position in the list of candidates a majority in the lowest sequence number, the result difficult for female  candidates  to  gain seats as if his voice does not reach the number of automatic  splitter sounds will be given to the serial  number  on  it,  but  with a majority vote model , greater opportunities for female candidates was elected. Third, women representation in the provincial parliament Daerah Istimewa Yogyakarta (DIY) increased when compared with the results of the election of 2004, from 9 seats in 2009 elections to 12 seats, so there is an increase of 33%. in Gunung Kidul district legislature also increased the number of seats of women when compared with the acquisition of seats in the elections of 2004, from a seat in the 2009 election to 6 seats, so there is 500%. Sleman district legislature in the 2004 elections the number of women seats and as many as 6 seats in the 2009 election to 8 seats. So the increase of about 33%. in Yogyakarta city parliament also increased the number of seats in 2004 elections from 5 to 6 seats in 2009 elections. Thus, there is an increase of 20%. Kulonprogo parliament,the seats for women who gained in the 2004 elections and are 4 seats in the 2009 election into 4 seats so that there is an increase of 25%, and in Bantul Regency 2004 election results there are only 5 seats for women, in the 2009 election to 6 people or up 20%. Fourth, the concern that the ruling number 22-24/PUU-VI/2008 inhibit affirmative action policy has not been proven in Daerah Istimewa Yogyakarta (DIY), because the acquisition of women’s seats in parliament and city districts in Daerah Istimewa Yogyakarta (DIY) even more increased when compared to the acquisition in 2004 election.

Abstract

Democracy at the local level becoming a necessity for achieving the goals of regional autonomy. Furthermore, the strengthening of democracy at the local level being the significant pillar in strengthening democracy at the national level. The strategic step to consolidate democracy at the local level particulary in terms of the regional head elections is by elimination the position of deputy regional head . This paper is describes the problems about the circumtances after head local election specially the relationship between Regional Head and Deputy Regional Head along with the idea about the eliminationof the position of Deputy Regional Head.

Abstract

Harus diakui bahwa perkembangan hak dan kebebasan beragama di Indonesia mengalami berbagai masalah, baik secara substansi pengaturan maupun penegakannya. Ini dibuktikan dengan semakin maraknya aksi-aksi kekerasan berbasis agama di berbagai wilayah di Indonesia. Beragam aksi tersebut nyatanya bertentangan dengan jaminan terhadap hak dan kebebasan yang diatur oleh beberapa aturan positif Indonesia. Guna memperbaiki segala persoalan di atas, tidak ada salahnya jika dalam perumusan pengaturan hak dan kebebasan beragama berkiblat pada aturan hukum yang diberlakukan pada zaman Majapahit, mengingat selain terdapat kesamaan kultur, kerajaan tersebut telah teruji reputasinya sebagai negeri yang plural.

Abstract

Establishment of the Constitutional Court marks a new era in the power of the judiciary system in Indonesia. Some areas that had not been touched (Untouchables) by law, such as judicial review issues on the Constitution, can now be done by the Constitutional Court, including the authority, other authority provided for in the 1945 Constitution after the amendment. Besides, the existence of the Constitutional Court must also be equipped with a clear organizational structure, adequate procedural  law, legal principles and sources of law that the Constitutional Court made reference in carrying out its duties and judicial authority. The emergence of the Constitutional Court as a principal judicial authorities are expected to become entry points which promote the establishment of a modern system of judicial authority in Indonesia.

Abstract

Libel crime is an offence attacking the honor and image of person. There are at least two elements in the libel crime in which a judge has an obligation to prove them, subjective and objective element as well as malice. An offender cannot be blamed for his/her conduct unless he/she commits these elements. In the term of article 27 (3) of electronic transaction and information act no 11 of 2008, its content is still in accordance with the rule of law conception and several articles of Indonesia Constitution of 1945 dealing with some fundamental rights of citizen and the right of freedom to express and to obtain information. State has untitled to make any limitation by prohibiting certain activities attacking the honor and image of person which is based on the same rights of the same freedom.

Abstract

Subjectum litis in The Legislative and Regional Head Election Disputes in Indonesia has been determined in a limited manner in The legislation and The regulation of the Constitutional Court. However along with the election, there is expansion and constriction of subjectum litis. The purpose of this study was to investigate the determinant factors that cause flexibility of subjectum litis in legislative and regional head election dispute. In addition, no previous studies that examine factors associated with the causes flexibility of subjectum litis in the legislative and the regional headselestion.The method used in this research is using qualitative methods with normative juridical approach by collecting data and information of the legislative and head regional election dispute advance in literature. The results obtained in this study that the shift in legislative elections expanded not only to political parties and individuals DPD that can be subjectum litis but also those of individual candidates of political parties can be subjectum litis in the legislative election disputes. The factor that caused it is the choice of electoral system is still used to 2014 electoral system. Meanwhile, the Regional Head election disputes in general as subjectum litis are that couple candidates for Governor and Vice Governor, Regent and Vice Regent and the Mayor and Deputy Mayor. But in its development, the narrowing of the only candidates who met the threshold difference of votes that can act as an applicant. Besides narrowing, there is also an extension where Consitutional court accommodate domestic election observers were registered and accredited by the KPU / KIP can act as subjectum litis and as the applicant would be candidates in the General Election of 2010. Factors that cause the narrowing and expansion in the elections of regional heads are the will of lawmakers and the limited authority of the Consitutional court as well as the presence of a single candidate who is not predictable by lawmakers in drafting electoral laws regional head. Whereas in 2010, the expansion of subjectum litis because the Court did extensive interpretation caused by serious violations of the right to be elected (rights to be a candidate). Suggestions for lawmakers tobe more thoroughly formulate norms by looking at the existing state of society so it can bring justice and legal certainty both for the expectant couple and society.

Abstract

Legal certainty is an important factor in developing international investment contracts in regional areas. How ever, it cannot be accomplisehed yet because of, among others, obscurance and inconsistance of laws regulating capacity to contracts for regional sub-divisions in Indonesia. The capacity to contract of the regional sub-divisions can be ascertained based on criteria of definition of the international contracts which is different from treaties, legal personality theory on the subject, and object concerning local government affairs. This article concludes that regional sub-divisions, such as Aceh Province, has capacity to be a party to international contracts, therefore, inconsistence laws should be adjusted.

Abstract

This study seeks to examine the performance of legislation (lawmaking function) as the realization of human rights instruments. Scrutiny on the program period 2010-2014 national legislation, to determine the validity of the assuredness and values, human rights principles in the Law that were born in that period. The study was conducted by banging the process of formation of the Law, institutionalization are born by the state’s responsibility for human rights. The methods and approaches used in the study are in the type of normative or doctrinal study which aims to provide a systematic explanation of the rules, then analyzed the relationship between legislation and the realization of human rights as a state responsibility. Several approaches are used, among others, the statutory approach, the conceptual approach and the approach of the case. The relation between the lawmaking function with the realization of human rights, are in the state’s responsibility to look out of the politics of law. To parse each stage process that impact on the formal level, further analysis of the Law to include legal issues, regulatory patterns, models of responsibility of the state and its institutionalization. Proceeding from it, reflect on the process of legislation discover improper application of the limitation of the right, the context of government intervention and the application of the law. Collapsed it required for rights-based approach within the framework of law making function.

Abstract

For the implementation of democratic elections required the existence of an institution independent of the general elections. The regulation of the formation of management bodies General Election in Aceh that was different from other regions are specifically regulated in Law Number 11 Year 2006 about Aceh Government and Qanun Aceh No. 7 of 2007 on General Election Organizer in Aceh. The purpose of this paper is to identify and explain the setting election of members of the general elections in Aceh and institute legal position of the general elections in Aceh. Based on the results of the study reveal any rules that conflict with the principles and legislation governing the establishment of the general elections in areas outside Aceh that assessed the existence of the institution of the general elections in Aceh are not independent because of the intervention of members of political parties.
