Abstract

Corruption is one form of systematic organized crimes performed with complicated modus operandi. Disclosing of this crime, in addition to requiring special equipment, also needs a certain method. One of the methods is using actors who collaborate or justice collaborator. The provisions on justice collaboratororiginally referred to Article 10 paragraph (2) of Law No. 13 of 2006 on Protection of Witnesses and Victims –but there are indications that these provisions do not provide protection to the justice collaborator. Because even though he plays as a collaborating actor,   it does not result in a loss of authority of the state to prosecute the concerned. This provision is considered violating the principle of lex certain criminal law, for  its ambiguity and multiple interpretations. Constitutional Court in its decision No. 42/PUU-VIII/2010states that Article 10 paragraph (2) regarding a quoprovision is not contrary to the 1945 Constitution. Without realizing it, Constitutional Court has come affirming the lack of protection on the collaborating actors. The fate of justice collaboratorthen finds the clarity in Article 10 paragraph (1) of Law No. 31 of 2014 on Protection on Witnesses and Victims. In the future, with reference to a quo provision, there is no guarantee to the justice collaboratorthat he would not be prosecuted either criminal or civil, except for statements or testimony that is not done in good faith. Besides regulated under legislation of Witnesses and Victims Protection, protection of the justice collaboratorhas also been set in UNTOC 2000 and UNCAC 2003.

Abstract

Freedom of association is not the right belongs to certain group but it is belong to every person as a social beings who naturally can not live alone and stand alone, but living in a group of specific communities.In the context of freedom of association for workers / laborers juridically guaranteed by the Constitution through Article 28 . Through its organic regulations, Law number. 21 year 2001 about Trade Union / Labor Union, according to the opinion of the writer this law is too consentrating on the substance of freedom of association in the shaping of workers / laborers organization, so there is a tendency out of the spirit and the purpose of the formation of trade unions / labor unions that promote the creation of the protection of the interests of the workers / laborers, and boils down to the welfare of the workers / laborers.At the level of industrial relations that emphasizes the aspect of Pancasila and Constitution 1945, the concrete is driven to the creation of industrial relations that runs in the balance between the worker / laborer with the company. The spirit and implementation of industrial relations should be clearly reflected in the harmonious relationship between the worker / laborer with the company, in the form of partnerships that are complementary and beneficial, that is created and protected the interests of the workers / laborers and the resulting product and / or service quality and high competitive, as the offerings from the workers to the company in order to create work productivity optimization.

Abstract

Article 46 KPU Regulation No.16 of 2010 count the percentage of  the gaining votes of each candidate pair from the total of valid ballot  paper. The invalid ballot paper is totally neglected. Thus the democratic right of those people who has an invalid votes is neglected as well. More over a danger implication of this article is a hidden crime that can be planned systematically by increasing the percentage of the gaining votes through out the invalid ballot paper. The more the number of invalid ballot paper,  the most the percentage of the gaining votes. If a total number of valid votes  is a for a candidate  pair A,  a total number  of valid votes  is b for a candidat pair B, according to the survey for example, and a/ (a+b) < b/(a+b) then a candidate pair A can  increase  mathematically their gaining votes to at least 30,01 % by planning at least t + s total number of invalid ballot paper such that t and s satisfy the inequality s>b – 69.99(a-t)/30.01 where t is the number of invalid ballot papers that should be subtracted from the total gaining vote of the candidate pair A and s is the number of invalid ballot papers that should be subtracted form the total gaining vote of the candidate pair B. This type of a hidden crime some time can be detected by the statistic but some time can not. The detectable hidden crime can be analyzed by Chi-Square formula. This paper provide a simulation how to detect these type of hidden crime. We use the Chi-Square formula, with 0.05 level of significance, to detect these hidden crime. The paper begin with the simulation how to increase the gaining votes at least 30,01 %.

Abstract

This research discusses the constitutional perspective of water resources management and its relation to the position of the state and the private sector in the management of water resources. This research examines the decision of the Constitutional Court in the judicial review of Law No. 7 of 2004 on Water Resources. There are two issues discussed in these studies namely (i) what is the constitutional perspective of water resource management and (ii) what is the position of the state and the private sector in water resources management? This research uses normative law research. The results showed that there are two constitutional perspectives in water resources management which are the perspective of control by the state under Article 33 paragraph (3) and the perspective of Human Rights perspective based on Article 28H of the 1945 Constitution. Based on the perspective of control  by the state, management of water resources should be controlled by the state from upstream to downstream. The state should take control of water resources  and establish distribution channels to meet the needs of the citizens on the water. From a human rights perspective, the state is obliged to protect, promote and fulfill the right  to water.  This obligation cannot be left to the private sector especially in water management based on its primary function. Therefore, the overall water management should be done by the state through the State Owned Enterprises or Regional Owned Enterprises. In fact, the monopoly of water management is a policy option that can be taken by the state. On the other hand, the private sector can take a part to commercialize water based on the use of water in its secondary function for industrial use through licensing mechanism. The study concluded that the state has an obligation to meet the citizens’ rights to water in order to meet the needs of a decent life based on primary functions of water. Secondary functions can be operated by private sectors.

Abstract

This legal hermeneutic article efforts to explore and formulates norms, rules, principles, standards, and criterions that must be referenced in order to understand, analyze, interpret, and explicate the intention and complexities meaning of legal texts, not only according to literary meaning but also to reveal the whole meaning  of pratices and outcome of the legal adjudication. These norms, rules, and principles link to primary or general priciples, attitudes and goodwill of intepreter, aim of interpretation, interest of people, structure of legal system, character and role of interpreter, and how to undestand and treate legal noms as text. This bibliographical study and empiris research article find out the meaning, history, and aplication of legal hermeneutic in practices of adjudication. One case from legal adjudication (court dicision) will be analysed here according to principles of legal hermeneutic.

Abstract

Status keistimewaan Provinsi DIY dalam kurun waktu sekian lama lebih sering diinterpretasikan sebagai istimewa dalam hal wilayah yang dulunya berbentuk kerajaan, istimewa dalam pemimpin yaitu dipimpin dwi tunggal dari lingkungan Kasultanan dan Pakualaman, dan istimewa dalam sistem pemerintahannya yang hierarkis patrimonial. Apabila dikelompokkan, pemaknaan keistimewaan Provinsi DIY setidaknya terbelah menjadi 2 (dua) yakni pihak yang pro-pemilihan  dan  pro-penetapan.  Penetapan Sri Sultan Hamengku Buwono sebagai Gubernur dan Sri Paku Alam sebagai Wakil Gubernur Provinsi DIY tidak bertentangan dengan prinsip-prinsip demokrasi menurut UUD 1945 karena dalam Pembukaan UUD 1945, para penyusun UUD 1945 sepakat untuk mengadaptasikan bentuk dan model demokrasi yang sesuai dengan budaya dan corak masyarakat Indonesia yakni demokrasi permusyawaratan berdasar kekeluargaan. Artinya, masyarakat DIY berhak bermufakat secara kekeluargaan mengenai mekanisme yang ingin dipraktikkan, sepanjang mekanisme tersebut dipandang demokratis, dalam arti tidak bertentangan dengan gagasan demokrasi permusyawaratan serta tidak mengabaikan hakikat keistimewaan DIY, termasuk melalui mekanisme penetapan. Dalam hal menentukan kepala daerah DIY, para pengubah UUD 1945  tidak memaknai demokrasi hanya melalui mekanisme pemilihan secara langsung oleh rakyat atau oleh DPRD, melainkan membuka mekanisme lain di luar itu sepanjang mekanisme tersebut dianggap demokratis dan mendapatkan payung hukum dari undang- undang.

Abstract

Concurrent local elections to be held in December 2015, characterized by the dynamics of democracy and new political dynamics. Dynamics it is the birth of a single candidate in several areas that will carry out the election. It is on the one hand shows that the dynamics of democracy in the country increasingly show progress and our society is increasingly “literacy” and political savvy, but on the other hand it raises a new problem, namely whether the elections will be postponed or published decree. This happens because the legislators did not expect the birth   of a single candidate. This fact shows that the lawmakers have not been able to make laws that meet the philosophical and sociological aspects of that legislation was well received presence in the midst of society without conflict and live longer. Because it is common to occur in Indonesia legislation only whole corn.Issues to be addressed in this study is what legal remedies in the face of a single candidate and how the legal steps to prevent the birth of a single candidate in the elections. This study is a normative legal research, using qualitative juridical analysis. The result showed that the legal solutions that can be done to deal with a single candidate is  to 1). Exposes a single candidate with an empty tube, 2). Delay the election until   the election outright in 2017. 3). Published the decree. While the legal steps that  can be taken to prevent the birth of a single candidate is 1. Revise election laws, by adding specific chapter or article concerning a single candidate, 2. Increasing political education for the public and political party cadres and prepare the mature cadre in the party’s  internal.

Abstract

PenDahuluanKebebasan informasi telah menjadi salah satu isu yang seksi dalam proses reformasi peradilan. Isu ini ditingkahi dengan adanya Surat Keputusan Ketua Mahkamah Agung (SK KMA No.144/KMA/ SK/VII/2007) pada tahun 2007 dan pengesahan Undang-Undang Keterbukaan Informasi Publik pada tahun 2008. SK KMA tentang Keterbukaan Informasi di Pengadilan ini mengawali perubahan mendasar dalam perkembangan birokrasi di kekuasaan yudikatif. Sedangkan Undang-Undang No.14 Tahun 2008 diklaim sebagai kunci pembuka gerbang ke arah perubahan yang  signifikan atas performa dari pelayanan-pelayanan publik dan bertujuan untuk mempermudah akses publik dan transparansi, termasuk birokrasi di institusi-institusi peradilan.303 Undang-undang ini menjamin akses publik untuk memperoleh informasi dari badan publik dan mewajibkan badan-badan publik untuk menyediakan informasi yang dikategorikan sebagai informasi publik yang menjadi kewenangannya. Undang-undang ini telah melalui proses pembahasan yang cukup lama. Sejak dorongan muncul dari masyarakat sipil kepada pemerintah untuk mengeluarkan satu undang-undang sakti guna menguak tabir kronis ketertutupan birokrasi.  Terhitung,  undang-undang  ini  telah  terkatung-katung selama 9 tahun sebelum akhirnya disahkan secara aklamasi oleh Komisi I DPR di pertengahan tahun   2008. ...

Abstract

Ratio decidendi of the Constitutional Court that said he was not an organ that has an authority to review constitutional rights loss of applicant, beside contrary to constitutional protection principles, also contrary to functions of the Constitutional Court as the guardian of the constitution, the protector of citizen’s constitutional rights dan the protector of human rights. The Constitutional Court should avoid to put his legal reasoning (in his ratio decidendi) that verdict of administrative court has not a legal nature – erga omnes. He should become aware that an administrative dispute is a public dispute bound under public law principles.
