Abstract

Kajian ini berupaya untuk mencermati praktik pengarusutamaan perencanaan pembangunan daerah berbasis HAM. Untuk mendapat gambaran mengenai praktik, peneliti memotret tiga daerah yakni: Batang (Jawa Tengah), Trenggalek (Jawa Timur), dan Tanjungpinang (Kepulauan Riau). Praktik yang ada dihadapkan dengan alur pendekatan berbasis HAM, yakni: proses perumusan, kandungan pokok, mekanisme pelaksanaan, serta perlindungan dan pemulihan. Pendekatan kualitatif yang bersifat deskriptif digunakan untuk menggambarkan proses, memahami ketidaksesuaian sekaligus mengidentifikasi perencanaan dan pelaksanaan pembangunan.   Berdasar hasil kajian, pendekatan perencanaan yang lebih terbuka membuka peluang pengarusutamaan HAM ke dalam perencanaan pembangunan.  Prasyarat yang menjadi faktor pendorong berada pada dinamika regulasi daerah, komitmen kepala daerah dengan visi dan misi yang tertuang dalam RPJMD, maupun untuk menjaga roda birokrasi yang transparan, akuntabel dan bersih.

Abstract

This study seeks to examine the performance of legislation (lawmaking function) as the realization of human rights instruments. Scrutiny on the program period 2010-2014 national legislation, to determine the validity of the assuredness and values, human rights principles in the Law that were born in that period. The study was conducted by banging the process of formation of the Law, institutionalization are born by the state’s responsibility for human rights. The methods and approaches used in the study are in the type of normative or doctrinal study which aims to provide a systematic explanation of the rules, then analyzed the relationship between legislation and the realization of human rights as a state responsibility. Several approaches are used, among others, the statutory approach, the conceptual approach and the approach of the case. The relation between the lawmaking function with the realization of human rights, are in the state’s responsibility to look out of the politics of law. To parse each stage process that impact on the formal level, further analysis of the Law to include legal issues, regulatory patterns, models of responsibility of the state and its institutionalization. Proceeding from it, reflect on the process of legislation discover improper application of the limitation of the right, the context of government intervention and the application of the law. Collapsed it required for rights-based approach within the framework of law making function.

The development and implementation of a relationship leading to the birth of anomalous friction decision Judicial review to collide against the lawmaking function. The absence of a follow-up mechanism  to cancel the decision of the norm, led to   the birth anomaly judgment. Friction Judicial Review with Law making Function was born in the form of vague and superficial to the lack of follow-up mechanisms. Efforts to reduce the friction between the two of them was done to achieve the ideal relationship between judicial review with lawmaking function.

Abstract

Friksi hubungan Pengujian Undang-Undang dengan Pembentukan Undang-Undang lahirdalam bentuk samar dan semu dengan ketiadaan mekanisme tindak lanjut. Hal tersebutditengarai dengan lahirnya anomali Putusan Pengujian Undang-Undang sebagai improvisasiuntuk menyikapi ketiadaan mekanisme pelaksanaan Putusan Pengujian Undang-Undang.Sementara itu, pasca putusan Pengujian Undang-Undang norma hidup dalam kertas dan sulitmempunyai kekuatan mengikat. Penguatan norma, salah satunya dengan membedakankekuatan mengikat norma antar para pihak dan mengikat umum. Sejalan dengan itu upayauntuk mereduksi friksi di antara keduanya dilakukan dengan melengkapi pintu alternatifdalam Pengujian Undang-Undang. Sedangkan, integrasi analisa dampak, manfaat dan biayadalam proses Pembentukan Undang-Undang merupakan pelengkap dalam mekanisme tindaklanjut putusan Pengujian Undang-Undang.

Abstract

The Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) is a government institution with the authority to carry out duties and functions of public services in agrarian, spatial planning and land. The development of land law issues in society has involved many officials from the Ministry of ATR/BPN as implementers of agrarian and land sector functions. The impact is the emergence of a sense of anxiety and worry felt by the Ministry of ATR/BPN officials when carrying out their duties. It is because if the land administration services provided by the Ministry of ATR/BPN are not thorough and careful, there are many gaps in legal violations, not only administrative and civil but also criminal. If the implementer of agrarian and land functions is a Civil Servant (PNS) and becomes a suspect in a legal case, he will be temporarily dismissed. He will not receive income from the Government Regulation on Civil Servant Management. Therefore, the problem that will be studied in this paper is the legal impact of land problems on the implementers of agrarian functions. This study explores the potential legal risks that implementers of agrarian functions can experience amidst the development of problematic land issues. The method used in this study is qualitative with a normative juridical approach. A normative juridical approach examines the legal rules and regulations that apply to answer legal problems. The results are that the administrative services carried out by the Ministry of ATR/BPN cannot be seen solely as part of administrative law. This is because the administrative services carried out can impact a person's legal ownership/civil status. Existing law enforcement instruments differentiate the judicial process for administrative, civil, and criminal violations.

Abstract

Tapping in a human rights perspective is a form of limitation of the right to privacy. As an effort to guarantee human rights protection, tapping as a part of The Interception of Communication Bill arrangements must be following the principles of human rights restrictions. Some of the anomalies in The Interception of Communication Bill appear in vague forms and open up the broad ways of potential violations of individual rights. For this reason, the principles of legality and prudence as a form of control over government actions need to offset the urgency of tapping. Data collection methods use discussions and interviews to enrich and test secondary data findings. This research stipulates that The Interception of Communication Bill use tapping as an induced instrument in criminal law enforcement. At the same time, tapping is regulated regardless of the readiness of the legal apparatus; this naturally raises technical problems in the matter of implementation and opens the door to abuse of authority. Furthermore, based on the need for comprehensive regulation, it is necessary to look at a comprehensive regulatory scheme in the legal system. The functional control that is in line with the tapping mechanism needs to look at the character of the Indonesian criminal justice system.

Abstract

The current development paradigm is still dominated by the neoclassical economic perspective which sees economic development as a mechanical and simplistic process, without the need to look at aspects of respect, protection, and fulfillment of human rights, although, human rights is the first state responsibility of government. As a result, human rights are not the focus of development policy-making. Human rights and development have a mutually reinforcing relationship that will direct the efforts towards a higher quality of development.On this basis, this study shines a spotlight and examines the management of regional development planning with a human rights basis. To get an idea of ​​the reality, researchers use three areas as a sample, namely: Batang (Central Java), Trenggalek (East Java), and Tanjungpinang (Riau Islands). Existing practices are examined with a human rights-based approach, namely: the formulation process, main content, implementation mechanisms, and protection and restoration. Furthermore, a descriptive qualitative approach is selected to describe the process, understand the nonconformities as well as identify the planning process and the implementation of the development plan. For that, primary data collection is done through interview techniques, focused discussions, and field observation. While for secondary data collection through a literature study. The study shows that the fulfillment of the right to healthcare, education, and food has become priorities in regional development planning. A more transparent and accountable planning approach also opens opportunities to make human right-based development planning as the mainstream. The prerequisites driving factors lie in the dynamics of regional regulation and the commitment of the regional heads with the vision and mission outlined in the RPJMD, including a commitment to maintain a transparent, accountable and clean bureaucracy. In conclusion, the transparent planning approach in the RPJMD needs to be balanced by using human rights standards to improve the quality of human development in the region.
