Abstract

AbstractThe emergence of child influencers, or kidfluencers, has created new opportunities for creativity and digital participation while also increasing the risk of economic exploitation, privacy violations, and disruption of children's development. This study analyzes special protection for children subjected to exploitation in kidfluencer practices under Indonesian positive law and Islamic law. It employs normative legal research with statutory, conceptual, and comparative approaches. Primary legal materials include child protection, labor, personal data protection, and electronic system regulations, while secondary materials comprise scholarly literature and classical Islamic legal sources. The study finds that Indonesian law prohibits economic and sexual exploitation of children through Article 76I in conjunction with Article 88 of Law Number 35 of 2014. Recent digital governance rules strengthen platform obligations and child data protection, but they do not yet specifically regulate commercial content production involving children, including working time, income management, meaningful consent, and the right to withdraw content. Islamic law permits children to participate in beneficial activities only when participation is voluntary, proportionate to their capacity, does not interfere with education, rest, and play, and directs the resulting income toward the child's welfare. Coercion, harm, and appropriation of a child's earnings contradict the principles of maqāṣid al-syarī‘ah, particularly the protection of life, intellect, lineage, and property. Specific regulation, accountable supervision, and child-centered income and privacy safeguards are therefore required.ABSTRAKKemunculan anak sebagai influencer atau kidfluencer membuka peluang kreativitas dan partisipasi digital, tetapi juga meningkatkan risiko eksploitasi ekonomi, pelanggaran privasi, serta terganggunya tumbuh kembang anak. Penelitian ini menganalisis perlindungan khusus bagi anak yang mengalami eksploitasi dalam praktik kidfluencer berdasarkan hukum positif Indonesia dan hukum Islam. Penelitian menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan komparatif. Bahan hukum primer meliputi regulasi perlindungan anak, ketenagakerjaan, pelindungan data pribadi, dan tata kelola sistem elektronik, sedangkan bahan hukum sekunder berupa literatur ilmiah dan sumber hukum Islam klasik. Hasil penelitian menunjukkan bahwa hukum Indonesia melarang eksploitasi ekonomi dan seksual terhadap anak melalui Pasal 76I juncto Pasal 88 Undang-Undang Nomor 35 Tahun 2014. Regulasi tata kelola digital terbaru memperkuat kewajiban platform dan pelindungan data anak, tetapi belum mengatur secara khusus produksi konten komersial yang melibatkan anak, antara lain mengenai waktu kerja, pengelolaan pendapatan, persetujuan yang bermakna, dan hak untuk menarik konten. Hukum Islam memperbolehkan partisipasi anak dalam aktivitas yang bermanfaat selama dilakukan tanpa paksaan, sesuai kemampuan anak, tidak mengganggu pendidikan, istirahat, dan bermain, serta mengarahkan pendapatan untuk kepentingan anak. Paksaan, kemudaratan, dan penguasaan hasil kerja anak bertentangan dengan maqāṣid al-syarī‘ah, terutama perlindungan jiwa, akal, keturunan, dan harta. Karena itu, diperlukan regulasi khusus, pengawasan yang akuntabel, serta perlindungan pendapatan dan privasi yang berorientasi pada kepentingan terbaik anak.
