Abstract

In several cases of settlement of the State Administrative Court, the Panel of Judges annulled the Presidential Decree (beschikking) which followed up on a Decision of the Honorary Council of Election Organizers regarding the dishonorable dismissal of members of the General Election Commission. Basically, the decision of the Honorary Election Organizing Council is final and binding. With this practice in mind, this paper discusses how the paradigm is "final and binding" in the Decisions of the Honorary Election Organizing Council and what the consequences are for legal certainty. This paper uses a normative juridical approach. The results of this paper indicate that the "final and binding" nature of the DKPP Decision has a paradigm of meaning and creates uncertainty and disruption of legal order in the administration of elections and nullifies the essence of the existence of DKPP as an ethical judiciary institution that balances power (checks and balances).

Abstract

Law Number 8 Year 2010 concerning Prevention and Eradication of Money Laundering Act (UU TPPU) has stipulates that criminal liability shall not only apply to natural persons but also legal entities and non-legal entities. In practice, corporate criminal liability has only been applied in the case of money laundering crimes committed by PT. Beringin Bangun Utama. This paper is intended to determine the regulation of corporate criminal liability based on the Money Laundering Law and its application in the case of PT. Beringin Bangun Utama. This study uses a normative method with 3 (three) approaches, namely the statutory approach, the case approach, and the conceptual approach. The results of the research conclude that corporate criminal liability in money laundering cases uses the doctrine of identification where to be able to impose criminal responsibility on corporations, law enforcement must be able to identify that those who commit (actus reus) are controlling personnel (directing mind or controlling mind). Furthermore, the intention or the attitude of the heart of guilt (mens rea) in the the doctrine of identification can be determined if the crime is committed in the context of providing benefits to the corporation.

Abstract

According to Article 183 of the Criminal Procedure Code, a judge may not impose a sentence on a person unless he has at least two valid evidence and he is convinced that a criminal act actually occurred and that the defendant was guilty of committing it. In this context there are at least two means of evidence and belief must be applied cumulatively based on the negative evidence theory (negative wettelijk bewijs theorie) adopted in Indonesia. The word two means of evidence refers to the parameter that there must be at least two pieces of evidence from the four pieces of evidence that have been determined limitatifly based on Article 184 of the Criminal Procedure Code, but the problem is that there is no clear measure (parameter) regarding the judge's conviction. The results of the study concluded that the judge's confidence parameters consisted of formal parameters and material parameters. Formal parameters are very much determined by formal evidence as stipulated in law and jurisprudence. Meanwhile, material actors have a freer character not only to see formal procedural facts but also to juridical, sociological, and philosophical aspects.

Abstract

The lack of understanding about public finance and private finance will affect the procedures for the management and accountability of a finance. Based on Article 2 letter g Law Number 17 of 2003, separated state assets which are used as capital participation (in this case money) in Limited Liability Companies (Persero) are part of state finance. This is not in line with the theory of legal entities and the theory of financial transformation. Based on that, this paper aims to explain the financial legal status of Limited Liability Companies (Persero) based on the theory of legal entities and the theory of financial transformation. This research is in the form of juridical-normative. The data used is secondary data consisting of primary and secondary legal materials. Data analysis was carried out using qualitative methods and the form of the results of this study was prescriptive analysis. Based on the theory of legal entities, a Limited Liability Company (Persero) is a private legal entity that has private power that can take provate legal actions and is subject to the provisions of private law. Based on the theory of financial transformation, the legal status of finance changes (transform) as a result of the legal action of transferring and separating finances from one legal subject to another. The transformation of the financial legal status causes changes in rights and obligations in the control and ownership of money in a legal entity so that management, responsibility and risk are under the new legal subjects.

Abstract

The economic and political needs of countries in the world have provided a strong basis for the birth of the World Trade Organization (WTO). This need has also prompted many countries to form preferential agreements such as the Regional Trade Agreement (RTA). A clash between the two international trading systems is inevitable, there is the ambiguity of the relationship and inconsistency of views held, such as in discriminatory and non-discriminatory approaches. Doctrinal research was conducted to find out which agreement should take precedence over the two legal regimes. This paper concludes that international legal provisions favor the WTO Agreement over preferential agreements such as the RTA. Thus, an RTA that does not conform to the WTO legal regime should be considered contradictory.

Abstract

AbstractNotary is a public official who is authorized to make an authentic act. Law No. 2 of 2014 on the Amendment of Law No. 30 Year 2004 on Notary, explains that, to take a photocopy of a Notary deed minuta and call a Notary in law enforcement, no longer through the Regional Supervisory Council permission. So the question arises, how the basic formation of the Honorary Council of Notaries in Act No. 2 of 2014, and how to call the Notary deed made. Based on research outputs by the author, Honorary Council of Notaries of birth, due to the need of legal protection against a Notary in deed. Notary Honorary Council is indispensable in the implementation of the law enforcement process, where the calling Notary by law enforcement (police, prosecutors, judges) must obtain permission from the Notary Honorary Council. To fill the legal vacuum, because the Honorary Council of Notaries has not been established, the Notary can use the right Dissenters, Indonesian Notary Association urged the government to establish a Notary Honorary Council Implementing Regulation.Keywords: Notary Public; Law Enforcement; Law Notary.IntisariNotaris merupakan seorang Pejabat Publik yang berwenang untuk membuat sebuah akta otentik.Undang Undang Nomor 2 Tahun 2014 Tentang Perubahan Atas Undang-Undang Nomor 30 Tahun 2004 Tentang Jabatan Notaris, menjelaskan bahwa, untuk mengambil fotokopi minuta akta seorang Notaris dan memanggil seorangNotaris dalam penegakan hukum, tidak lagi melalui izin Majelis Pengawas Daerah. Maka timbul pertanyaan, bagaimana dasar pembentukan Majelis Kehormatan Notaris dalam Undang-Undang Nomor 2 Tahun 2014, dan bagaimana memanggil Notaris yang membuatkan akta, Paska Perubahan Undang-Undang Jabatan Notaris Nomor 30 Tahun 2004. Berdasarkan hasil penelitian yang penulis lakukan, Majelis Kehormatan Notaris lahir, akibat kebutuhan perlindungan hukum terhadap seorang Notaris dalam pembuatan akta. Majelis Kehormatan Notaris sangat diperlukan didalam pelaksanaan proses penegakan hukum, dimana pemanggilan Notaris oleh para penegak hukum (polisi, jaksa, hakim) harus mendapat izin dari Majelis Kehormatan Notaris. Untuk mengisi kekosongan hukum, karena Majelis Kehormatan Notaris belum terbentuk, maka Notaris bisa menggunakan hak Ingkar, Ikatan Notaris Indonesia mendesak pemerintah untuk membentuk Peraturan Pelaksana Majelis Kehormatan Notaris.Kata Kunci: Notaris,penegakan hukum, Undang-Undang.

Abstract

AbstractThis study aims to determine the social security system adopted by Indonesia, see Indonesia as a function of the welfare state as mandated by the 1945 Constitution has not done well, and to know the view of progressive legal theory legislation related to social security in providing solutions to the problems of social security the workforce. This research is devoted to the study of normative legal systematics, which is intended to determine the implementation of a theory of the legal conditions that exist in society. Results of this study produces a secondary data. The data obtained from the document collection process or library materials. Of the collection process, the data were analyzed qualitatively, systematically arranged, and presented descriptively. The results showed that Indonesia is still not able to fully administer social security for the people, where social security is still a “black and white” but the State has not been able in practice to assume responsibility for the implementation of social security as a whole. About social security, the Government is still not able to provide significant changes to the equalization gain social security for the workers, but changes in social security regulations on labor is performed repeatedly. Necessary party whom dared to take a policy or decisions that benefit the workers to realize the welfare of the workers. Parties reffered to the law is used as a progressive peeler, is a party that has an important role that enterpreneurs and the Industrial Relations Court Judge.Keywords: Social Security, Labour, Progressive LawIntisariPenelitian ini bertujuan untuk mengetahui sistem jaminan sosial yang dianut Indonesia, melihat fungsi Indonesia sebagai negara kesejahteraan sesuai amanat Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 belum terlaksana dengan baik, serta untuk mengetahui teori hukum progresif memandang peraturan perundang-undangan terkait jaminan sosial tenaga kerja dalam memberikan solusi atas permasalahan jaminan sosial tenaga kerja tersebut.Penelitian ini bersifat normatif yang dikhususkan pada penelitian sistematika hukum, yang dimaksudkan untuk mengetahui implementasi pelaksanaan suatu teori terhadap kondisi hukum yang ada di masyarakat. Hasil penelitian ini menghasilkan suatu data sekunder. Data tersebut diperoleh dari proses pengumpulan dokumen atau bahan pustaka. Dari proses pengumpulan tersebut, data yang diperoleh dianalisis secara kualitatif disusun secara sistematis dan disajikan secara deskriptif.Hasil penelitian menunjukkan bahwa Indonesia masih belum mampu secara seutuhnya menyelenggarakan jaminan sosial bagi rakyat, dimana jaminan sosial tersebut masih sebatas “hitam diatas putih” namun, negara belum mampu dalam pelaksanaannya untuk mengemban tanggung jawab pelaksanaan jaminan sosial tersebut secara utuh. Tentang jaminan sosial tenaga kerja, pemerintah masih belum mampu memberikan perubahan yang signifikan terhadap pemerataan perolehan jaminan sosial tenaga kerja bagi para pekerja tersebut, padahal perubahan peraturan tentang jaminan sosial tenaga kerja tersebut berulang kali dilakukan. Diperlukan pihak yang berani untuk mengambil suatu kebijakan atau keputusan yang bermanfaat bagi pekerja demi terwujudnya kesejahteraan bagi pekerja. Pihak sebagaimana dimaksud jika hukum progresif yang digunakan sebagai alat pengupas, adalah pihak yang memiliki peran penting yaitu pengusaha dan Hakim Pengadilan Hubungan Industrial.Kata Kunci: Jaminan Sosial, Tenaga Kerja, Hukum Progresif.

Abstract

AbstractSatjipto Rahardjo’s Progressive Law (Hukum Progresif) is intended to be an antithesis to the modern law, but the philosophical foundation of this law is not so clear. This article, based on literature research, try to find out the philosophical basis for this kind of law. With research methods and particular approaches, the possibility of philosophical foundation are exlplored. First, in the basic ideas of Progressive Law such as “law for human, sociology oriented law, liberation law, etc.” we can see the philosophical direction of this law. Second, based on certain philosophy, we can say that the metaphysical anthropology, realism, process philosophy and “postmodernism” are the roots of philosophy of Progressive Law.Keywords :progressive law, philosophical foundation,postmodernismIntisariHukum Progresif dari Satjipto Rahardjo dimaksudkan sebagai antitesis terhadap hukum modern. Meskipun demikian, belum jelas landasan filosofis hukum ini. Dengan metode penelitian dan pendekatan tertentu dicari kemungkinan landasan filosofis bagi hukum ini. Pertama, berdasarkan ide-ide dasar Hukum Progresif seperti “hukum untuk manusia”, “orientasi sosiologis” dan “pembebasan”, arah dari filosofis hukum ini dapat diketahui. Kedua, berdasarkan filsafat tertentu dapat dikatakan, bahwa antropologi metafisika, realisme, filsafat proses dan postmodernisme merupakan akar filsafat dari Hukum Progresif.Kata Kunci : hukum progresif, landasan filosofis, paska modernisme
