Abstract

This research aims to examine the use of social media has brought some negative impacts including loss of privacy, decreased information quality, spread of hoaxes, and the rise of radical groups online. Supporters of radical groups or extremists speak up their belief on social media which can affect the public, even they recruit their members online. This descriptive research was done using a normative juridical method to analyze primary and secondary data. Data were collected through observation, document and literature study using qualitative data analysis which stages were data reduction, data presentation and conclusion drawing. The results showed that social media which allow users to share user-generated content were often misused by terrorist networks as a powerful tool to support their movement and recruit new members as evidenced by terror cases in which terrorists made use of information technology through which they influenced and spreaded the radicalization. The internet plays a bigger role in the radicalization process than any religious institution. Terrorist networks use violent terrorist campaigns as propaganda to reach operational level tactics at global and local levels

Abstract

The deradicalization program is a program mandated by Law Number 5 of 2018 which is carried out in coordination with government institutions or institutions with targets being carried out on suspects, defendants, convicts, prisoners, ex-terrorism convicts, and people or groups who have been exposed to radical terrorism. The normative legal research method in this research used a methodological approach that is applied, namely the legal approach, conceptual approach, historical approach, and philosophical approach. Based on the results of this research that the application of the concept of deradicalization to perpe[1]trators of criminal acts of terrorism in Indonesia since the issuance of Presidential Decree number 46 of 2010 concerning the National Agency for Combating Criminal Acts of Ter[1]rorism has been running but in the implementation of the deradicalization program it has not touched the substance of the root of the problem, namely efforts to stem the rate of rad[1]icalism. Deradicalization model that prioritizes reintegration such as counter terrorism, preventing radicalism, understanding comparisons, avoiding hate provocations, hostility in the name of religion, preventing people from being indoctrinated, and community par[1]ticipation rejecting terrorism.

Abstract

Problems deviation between the expected role and should by Civil Servant Investigators (investigators) are overlapping in charge. It is essentially a paradox. This study uses a normative law research. To obtain accurate data, researchers used the literature study technique, which consists of primary, secondary, and tertiary legal materials. Data obtained from the results of library research will be analyzed qualitatively with descriptive methods. From the research results obtained, firstly in carrying out an investigation, PPNS must follow the applicable legal norms because it is a reflection of legal certainty as well as the obligation to coordinate with the Supervisory Coordinator as a requirement for the application of the principle of legality in all its forms (due process of law), namely that all government actions must based on legal and written laws and regulations. Second, certain Civil Servants who are given the authority by law to carry out investigations in accordance with the laws which are their respective legal bases are subordination of the executive branch not included in the Indonesian Criminal Justice System, therefore the Criminal Procedure Code strictly regulates that the PPNS relationship is under coordination. and supervision of police investigators.

Abstract

The pros and cons of the dissolution of civil society organizations have been an ongoing issue since the emergence of Law Number 16 of 2017 concerning Social Organizations, where there was a debate about how these Community Organizations should be dissolved. The approach method used in this research is the method of juridical analysis approach. With the research specifications used in this research is descriptive analytical. Legal data materials obtained from both the literature and field research were analyzed qualitatively, namely the data analysis method by conducting a selection of the data obtained based on their quality and truth and those related to the problems to be discussed. Based on the results of the study, it was found that the authority of the Ministry of Home Affairs in the mechanism for dissolution of communityt organizations in Indonesia is based on Law Number 16 of 2017 concerning Stipulation of Government Regulation in Lieu of Law Number 2 of 2017 concerning Amendments to Law Number 17 of 2013 concerning Community Organizations into Law, Article 62 which explains that for Community Or[1]ganizations committing violations given a written warning once within seven working days from the date the warning was issued. In the event that the Community Organizations does not comply with the written warning within a predetermined period of time, the Minister who carries out government affairs in the fields of law and human rights in accordance with his authority shall impose sanctions on the termination of activities.

Abstract

This study aims to see that police discretion has the potential to be abused, in justice, acts of corruption are things that cannot be hidden anymore. Pretrial as a means of control and supervision in its implementation has limitations. Based on the result, police discretion liability in the function of criminal law enforcement in Law on Police and Criminal Procedural Code was not governed expressly. Therefore, the concept of police discretion must obtain clearer, more measured, and objective interpretation and explanation so that the legitimization and operational are application and in line with the conception of legal state, law enforcement, and law liability. The absence of mechanism and examining and/or testing institution could not be maintained anymore, so had to be open to the obligation to account for it, either by pseudo-administrative trial, pure administrative trial, or both, with internal liability or external liability. Besides that, the aspect of legitimization and operational of police discretion was not applicable, limited by and in the sense within the scope of its legality principle and specification, and could not be used in the function of criminal law enforcement except police investigator discretion as a form of special discretion and constituted a specification of police discretion, realized in free discretion and bound discretion according to the Criminal Procedural Code.

Abstract

ABSTRAKArticle 285 of the Criminal Code states that anyone with violence and threats of violence forces a woman to have sex with him outside of marriage, is threatened with rape with a maximum imprisonment of twelve years. If you look at the written sanctions formulation, the maximum sentence for the crime of rape is twelve years. However, in reality, judges rarely impose maximum criminal sanctions in society as stated in these provisions. In addition, when viewed from the perspective of creating justice for victims of maximum criminal sanctions, it has not touched the recovery of losses and suffering experienced by rape victims. This research is a normative juridical research but is also supported by empirical data so that what is studied is data originating from the literature and court decisions. The results of the study indicate that the imposition of maximum criminal sanctions on perpetrators of the crime of rape as regulated in the Criminal Code has not been implemented properly, this is because in practice law enforcement officers including the panel of judges who should be the mouthpiece of justice have not been able to provide maximum sanctions. to the perpetrator, in imposing criminal sanctions the judge tends to ignore the condition of the victim who is traumatized and depressed. This provides clear evidence that there is still a lack of guarantees for legal protection for victims of sexual violence and rape in criminal justice in Indonesia.Pasal 285 KUHP menyatakan barang siapa dengan kekerasan dan ancaman kekerasan memaksa seorang wanita bersetubuh dengan dia di luar pernikahan, diancam karena melakukan perkosaan dengan pidana penjara paling lama dua belas tahun. Jika melihat formulasi sanski yang ditertulis maka pidana maksimum bagi tindak pidana perkosaan adalah dua belas tahun. Namum dalam kenyataannya di dalam masyarakat Hakim jarang menjatuhkan sanksi pidana maksimal seperti yang tercantum di dalam ketentuan tersebut. Selain itu apabila ditinjau dari terciptanya keadilan bagi korban sanksi pidana maksimum belumlah menyentuh pemulihan kerugian dan penderitaan yang dialami oleh korban perkosaan. Penelitian ini merupakan penelitian yuridis normatif namun juga didukung dengan data empiris sehingga yang diteliti adalah data yang berasal dari kepustakaan dan putusan pengadilan. Hasil penelitian menunjukkan bahwa penjatuhan sanksi pidana maksimum terhadap pelaku tindak pidana perkosaan sebagaimana diatur dalam Kitab Undang-Undang Pidana belum terimplementasi dengan baik, hal tersebut dikarenakan dalam prakteknya aparat penegak hukum termasuk didalamnya majelis hakim yang seharusnya menjadi corong keadilan ternyata belum mampu memberikan sanksi yang maksimal kepada pelaku, dalam penjatuhan sanksi pidana hakim cenderung mengabaikan kondisi korban yang mengalami trauma dan depresi. Hal tersebut memberikan bukti nyata bahwa masih minimnya jaminan perlindungan hukum terhadap korban kekerasan seksual perkosaan dalam peradilan pidana di Indonesia.

Abstract

The juridical provisions governing the existence of land are contained in Law Number 5 of 1960 (UUPA). The land rights contained in the UUPA will give rise to civil rights for the community and business entities, namely through the transfer of property rights to building use rights. The method used in this study is the normative juridical method or legal research literature. The data used are primary and secondary data. The data were collected using library or document techniques and interviews. The data that has been obtained is then analyzed using a qualitative juridical method. The results showed that the implementation of the release of the original land rights followed by the determination of the granting of land rights from Property Rights into Building Use Rights. Business Entities will become unattractive to investors in investing in Indonesia if the obstacles do not get legal guarantees from the government, especially in the utilization and use of land with respect to the period of Building Use Rights with a certain time limit, which can be extended according to applicable regulations.

Abstract

Terjadinya peristiwa-peristiwa yang bersifat fenomenal diantaranya perkembangan dunia yang saling ketergantungan (interdependency) dan saling terhubung (connected), maka negara tidak lagi menjadi satu-satunya aktor yang bertanggung jawab untuk menghadapi ancaman yang membahayakan negara dan bangsa. Peran serta aktif setiap warga negara dalam bentuk Bela Negara akan menentukan keberhasilan suatu bangsa dalam mengatasi implikasi negatif yang mengancam keberadaan negara. Ancaman yang berupa perubahan iklim, ketahanan pangan, energy, perdagangan manusia, organisasi kejahatan yang terorganisir dan kejahatan dunia maya merupakan contoh ancaman yang harus diatasi tidak hanya oleh negara namun juga diperlukan peran dari warga negara. Peneliti menggunakan jenis penelitian hukum normatif. Sumber data dalam penelitian ini yaitu data sekunder. Teknik pengumpulan data melalui studi kepustakaan dan wawancara sedangkan teknik analisis data yang peneliti gunakan adalah metode normatif kualitatif. Hasil penelitian ini adalah Konsep Bela Negara dalam Pertahanan Negara memerlukan suatu Badan Khusus Bela Negara yang mempunyai tugas, fungsi dan wewenang menyelenggarakan program Bela Negara sesuai yang diamanatkan dalam UUD RI Tahun 1945 dan UU No. 3 Tahun 2002 tentang Pertahanan Negara serta menumbuhkan semangat Nasionalisme Kader Bela Negara agar implementasi Bela Negara dapat berjalan dengan maksimal

Abstract

This research aims to examine and understand the implementation of peace agreement dispute resolution in the Bankruptcy Process for Delaying Debt Payment Obligations (PKPU), as well as evaluate homologation decisions against creditors based on Law No. 37 of 2004 concerning Bankruptcy and Delaying Debt Payment Obligations. The research method used in this research is normative legal research conducted as an effort to obtain the necessary data related to the problem. The results of this study reveal that legal protection for creditors, especially unsecured creditors (concurrent), is very limited due to large debts by debtors. Debtors have significant control over the postponement of debt payment obligations (PKPU) application, and secured creditors often have no influence on this decision. Asset sales after bankruptcy are often insufficient to satisfy debts, to the detriment of creditors. Therefore, government intervention is required to provide better legal protection to creditors, especially unsecured (concurrent) creditors, which takes into account their human rights and business continuity. In this context, legal measures such as action paulina and the principle of parity creditorium in the Bankruptcy Law are essential to protect creditors. Thus, this research highlights the need for improved legal protection for creditors, especially unsecured creditors, in insolvency situations in Indonesia.
