Abstract

Dalam dunia yang semakin terhubung, penyelesaian sengketa internasional menjadi sangat penting untuk menjaga perdamaian dan stabilitas antara negara-negara. Mahkamah Internasional (ICJ) memainkan peran yang signifikan dalam hal ini. Artikel ini mengkaji berbagai aspek penyelesaian sengketa, dengan fokus pada peran ICJ, serta metode alternatif penyelesaian sengketa yang melibatkan unsur pemaksaan dan kekerasan. Prinsip utama dalam hukum internasional tetap merupakan penyelesaian sengketa secara damai. Upaya diplomatik dan negosiasi harus selalu menjadi prioritas dalam penyelesaian konflik. Namun, ketika upaya damai gagal, penting untuk memahami metode alternatif penyelesaian sengketa yang mungkin melibatkan penggunaan kekuatan. Artikel ini membahas berbagai bentuk penyelesaian sengketa yang melibatkan kekerasan, seperti perang, tindakan bersenjata non-perang, retorsi, tindakan pembalasan, blokade damai, dan intervensi. Setiap metode ini memiliki implikasi dan konsekuensi yang berbeda dalam kerangka hukum internasional. Temuan dari penelitian ini menekankan pentingnya meningkatkan kesadaran tentang hukum internasional dan mempromosikan penyelesaian sengketa secara damai. Ini juga menggarisbawahi perlunya memperkuat peran ICJ dan Perserikatan Bangsa-Bangsa dalam pencegahan dan penyelesaian konflik. Transparansi, akuntabilitas, dan pendidikan adalah elemen-elemen kunci dalam meningkatkan pemahaman dan kerjasama internasional untuk penyelesaian sengketa secara damai.

Abstract

This research discusses evidence in corruption money laundering cases in Indonesia, focusing on the use of reverse burden of proof. This burden of proof is applied primarily to the assets of the defendant in corruption cases. However, the use of this reverse burden of proof still raises uncertainties in its implementation, especially in identifying assets that are not defendants, and can have an impact on the ownership rights of the defendant's assets. This research uses a normative juridical method with interpretative analysis to investigate the complexity of the evidentiary mechanism. The results show that the defendant must prove that his/her assets are not the proceeds of a criminal offense to retain the right to the assets, otherwise, the assets will be confiscated by the state. Therefore, further clarification is needed in the relevant laws to improve clarity and fairness in the application of the reverse burden of proof in corruption and money laundering cases.

Abstract

Children are in an environment that increasingly leads to criminal acts, one of which is murder. In law enforcement, problems arise because the perpetrators of these crimes are children who do not yet have legal capacity. In Indonesia, law enforcement against children who commit murder has been regulated in Law Number 11 of 2012 concerning the Child Criminal Justice System with the aim that the legal process is different from adults. The method in this research is normative juridical. The result of this research is law enforcement against children who commit murder in Law Number 11 of 2012 concerning the Juvenile Criminal Justice System, can be sentenced to the main criminal sanction, namely imprisonment formulated in Article 81 paragraph (2), "The imprisonment that can be imposed on children is at most 1/2 (one half) of the maximum imprisonment for adults

Abstract

Corruption in the procurement of goods and services is a serious concern in many countries, including Indonesia. In this context, the role of the Commitment Making Officer (PPK) has a significant impact on the integrity and transparency of the procurement process. This research provides a legal review of the role of PPK in corruption crimes in the procurement of goods and services in Indonesia. The method used in this research is the normative juridical approach method. The approaches used in this type of normative research are statutory approaches and conceptual approaches. Types and sources of data used as research materials primary legal materials, secondary legal materials, and tertiary legal materials.  The results of the study found that Presidential Regulation No. 12 of 2021 authorizes PPK by prohibiting the practice of bribery, but the limits of PPK's authority are regulated by Article 52 Paragraph (2) and LKPP Circular Letter No. 8 of 2020. PPK's responsibilities include aspects of administrative and civil law, with the core of criminal liability focused on procurement law violations involving abuse of authority for personal or collective gain, harming the state. PPK's criminal liability involves individual fault, subjective fault, and the role of other parties in the procurement, including the Budget User (PA) and the Budget User Authority (KPA).

Abstract

The shipping sector is one of the vital sectors in the transportation of people and goods, so in the implementation of shipping activities, workers who work on ships are called as Ship's Crew (ABK). According to Law Number 17 of 2008 on Shipping, crew members are ship’s crew members other than masters, what is meant by crew members are people who work or are employed on a ship by the ship’s owner or operator of the ship to carry out tasks on board according to their position listed in the seafarer’s book (monsterrol). Problems related to legal protection of the rights of crew members in implementing seafarer employment agreements are mostly disputes about termination while the employer does not provide severance pay due to the legal principle that applies to seafarer employment agreements is referring to specific legal principle, namely lex specialis derogate lex generalis. The results of the study show that the legal basis for making maritime labor agreements in principle refers to Book II Chapter 4 of the Indonesian Commercial Code concerning Seafarer Employment Agreements. Nevertheless, the provisions of seafarer employment agreements in the Indonesian Commercial Code refer further to the provisions of employment agreements in Chapter 7A Book III of the Indonesian Civil Code, furthermore, in the procedure for seafarer employment agreement, seafarer employment agreements must fulfil legal requirements such as work agreements in general, but there is a slight difference in that work agreements generally only have two subjects involved in a work agreement. In the making of a seafarer employment agreements between the employer and the ship's crew must be made before the Syahbandar and legal protection for the crew is regulated in the seafarer employment agreements where the Government Regulation on the Seamanship that the seafarer employment agreements requires minimum wages, leave, welfare, safety and other than that, if there is an industrial relations dispute, it can resolve through the bipartite and tripartite phase.

Abstract

The number of local regulations that are not harmonious with higher laws and regulations, poor public interest, decency and even human rights has attracted the attention of many parties. One of them is related to the role of the Regional Office of the Ministry of Law and Human Rights (Kanwil Kemenkumham) in the process of harmonizing draft regional regulations (raperda). The existence of Article 58 Paragraph (2) of Law No.15 of 2019 is expected to bring positive changes considering that every draft regulation must be harmonized through the Regional Office of the Ministry of Law and Human Rights before being facilitated by the Provincial Government Legal Bureau. The results showed that the implementation of Raperda harmonization by the Regional Office of the Ministry of Law and Human Rights is still not optimal. This is due to various obstacles, including the existence of the Circular Letter of the Director General of Legislation is considered not to be a strong basis as an implementing regulation for harmonization by the Regional Office of the Ministry of Law and Human Rights. Another problem is the conflict of harmonization authority between the Ministry of Law and Human Rights and the Ministry of Home Affairs (Kemendagri).  To overcome these obstacles, it is necessary to submit recommendations addressed to the Director General of Legislation to make an agreement with the Director General of Regional Autonomy of the Ministry of Home Affairs, to prepare a Joint Decree (SKB) between the Minister of Law and Human Rights and the Minister of Home Affairs related to the Harmonization of Regional Draft Regulations. In addition, the Director General of Laws and Regulations of the Ministry of Law and Human Rights should immediately make implementing regulations through Amendments to Presidential Regulation of the Republic of Indonesia Number 87 of 2014 concerning Implementation Regulations of Law Number 12 of 2011 concerning the Formation of Laws and Regulations. The amendment to the Presidential Regulation is adjusted to the contents of Article 58 Paragraph (2) of Law No.15 of 2019.

Abstract

Dispute resolution with mediation is an alternative of problems solving in society. In the concept of the current developments of the Judiciary, the procedure for handling criminal cases in several countries has been known for penal mediation. Penal mediation is an alternative settlemen of criminal cases emphasizing restorative justice approach, which is carried out between the victim and the offender or his/her family with the purpose of the restoring the balance in the society. This study aims to analyze how to the implementation of penal mediation children criminal cases with type of research is an literature approach. The presence of penal mediation is deemed necessary by the community as a means of resolving of chidren criminal cases that are fast, economical, and acceptable by parties outside the court so as to achieving a win win solution and will bring justice to perpetrators and victims. The application of penal mediation for the purpose of achieving Pancasila justice.

Abstract

Tulisan ini membahas Politik Kerakyatan (Sila Keempat Pancasila) dan Nilai Hukum dari perspektif Filsafat Hukum. Kajian ini diarahkan pada imperative-imperatif nilai yang melekat pada ‘politik kerakyatan’ Sila Keempat Pancasila. Kajian terhadap masalah dilakukan menggunakan alur dan cara kerja penelitian hukum doctrinal tipe theoritical research, yakni: research which foster a more complete understanding of the conceptual bases of legal principles and of combined effect of a range of rules and procedures that touch on a particular area of activity. Hasil kajian menemukan bahwa: (1). Imperative nilai hukum yang terkadung dalam politik kerakyatan Sila Keempat Pancasila tidak bisa dilepaskan dari konsepsi Sukarno tentang Pancasila sebagai Weltanschauung Indonesia, yakni filsafat tentang kehidupan bersama yang damai dalam negara Indonesia yang Bhineka Tunggal Ika. (2). Paling sedikit terdapat 4 (empat) Imperatif nilai politik kerakyatan Sila Keempat Pancasila, yakni: (i). Demokrasi harus bernurani, (ii). Kekuasaan harus untuk rakyat, (iii). Pelaksanaan Pemilu harus beradab, (iv). Musyarwarah dan mufakat tentang kepentingan rakyat.

Abstract

The use of social networks is not only a means of socializing and exchanging information but also an interactive medium, serving as a practical bridge for conducting business, providing services or social resources, and being utilized as a platform for engaging in illicit activities. Nowadays, social media has become a common and effective tool for achieving objectives in business affairs related to prostitution. This study employs the normative legal research method, which involves examining applicable laws and regulations or those implemented concerning a specific legal issue. In this context, the study analyzes the problem from the perspective of legal provisions on the criminal act of online prostitution. Based on various legal provisions in the Indonesian Penal Code (KUHP), Law No. 11 of 2008 on Electronic Information and Transactions, and Law No. 44 of 2008 on Pornography, the existing regulations have not been effective in prosecuting and combating the online prostitution business. These laws do not regulate the users of prostitution services, resulting in their exemption from legal prosecution under Indonesia’s Positive Law. Online prostitution refers to prostitution activities that use the internet as a medium for transactions. Under the Indonesian Penal Code (KUHP), only individuals who facilitate online prostitution, such as pimps or procurers, can be criminally prosecuted. Meanwhile, sex workers and their clients cannot be punished, as this offense is considered a victimless crime.

Abstract

Legal protection for victims of criminal threats and extortion is a crucial aspect in ensuring a fair judicial process. This article discusses the challenges and solutions in providing legal protection for victims through a legal and technological approach. Based on an analysis of the Witness and Victim Protection Law, it is found that there are still obstacles in accessing justice for victims, particularly for economically disadvantaged individuals. Moreover, firm law enforcement against perpetrators, the utilization of information technology in handling crimes through electronic media, and enhancing the legal awareness of victims are also focal points in improving the legal protection system. On the other hand, the active role of the Witness and Victim Protection Agency is expected to enhance protection for victims by prioritizing their interests in the judicial process. Through collaborative efforts among the government, protection agencies, and public legal awareness, it is hoped that legal protection for victims can be enhanced to achieve better justice.
