Abstract

Abstracts: Medical waste management must be based on laws and regulations related to environmental protection and management, of course, as well as laws and regulations in the health sector because medical waste is leftover from the business and / or activities of health service facilities. The management of medical waste as part of the protection and management of the environment must certainly be in accordance with the direction of legal policies set by the state or government to achieve the goals and objectives of environmental protection and management, so that it can be understood, implemented, and enforced the principles or principles and legal norms in it comprehensively in accordance with the politics of environmental law. The implementation of national development must be pro-environment or protect the environment in accordance with the principles of sustainable development that ensure the survival and maintenance of the carrying capacity of the environment for the lives of the next generations. Pengelolaan limbah medis sebagai bagian dari PPLH tentu harus sesuai dengan arah kebijakan hukum yang ditetapkan oleh negara atau pemerintah untuk mencapai tujuan dan sasaran dari PPLH, agar dapat dipahami, dilaksanakan, dan ditegakkannya prinsip-prinsip atau asas-asas dan norma hukum yang ada di dalamnya secara komprehensif sesuai dengan politik hukum lingkungan. Abstract

Abstract: Medicine is an essential product for health because it can affect the degree of someone’s health consuming it. Therefore, supervision to medicine distribution is needed as an effort to ensure that the medicine is safe, qualified, and efficacious. This is to provide protection for the consumers’ health rights. This study aimed to find out a description of medicine distribution regulation, implementation of medicine distribution supervision, protection to consumers’ health rights and the factors influncing the implementation of the medicine distribution supervision and the protection to the consumers’ health rights. This study applied a socio-legal approach having a descriptive analytic specification. The research data consists of primary and secondary and the data gathering technique was through field and literature studies. The samples taken were based on non random sampling technique by applying purposive sampling. The data presentation was in the forms of narration, images and tables whereas the data were qualitatively analyzed. The results and discussion showed that the regulation medicine distribution supervision has already existed for in general, specifically and the form of supervision arrangements. Medicine distribution supervision in fulfilling the protection to consumers’ rights had not been optimally carried out although the supervision of the medicine distribution was already based on statutory provisions covering the general and special types of medicine distribution arrangements. This was caused by several factors covering juridical, social, and technical factors. The juridical factor influencing was is the provision of the Minister of Health and BPOM that still allowed Puskesmas (Health Center) not to have a pharmacist as the main beneficiary in the pharmaceutical unit. The social factors were about less understanding on health rights and unappropriate checking of the medicine condition beside to TTK directly submit the medicine to the drug consumer. The technical factors were about the limited number of supervisors at the Semarang City’s Health Office and Semarang’s BB POM beside lack of pharmacists in pharmaceutical facilities.Keywords: supervision, medicine distribution, protection of health rights, consumer

Abstract

Abstract: The incidence of TB-HIV is high and life-threatening, while on the other hand, TB-HIV patients have the right to get financial assistance in health services. Therefore, integrated health services are needed within the framework of the National Health Insurance. Health workers are an important aspect in the various health care approaches to patients with TB-HIV. This study aims to determine and examine the role of Health Workers in TB-HIV control and obstacles that are faced by Health Workers in carrying out their roles at Panti Wilasa Dr. Cipto Semarang Hospital.This research is a qualitative research with a sociological juridical approach. The data collection method used is literature study and field study. Primary data were obtained from interviews with the Semarang City Health Office, health workers and patients at Panti Wilasa Dr. Cipto Semarang Hospital. Secondary data consists of laws and regulations, books and journals.From the results of the research and discussion, it was concluded that the role of the Semarang City Health Office and Health Workers, such as General Practitioners, Specialist Doctors, Nurses, Laboratory and Pharmacy Officers at Panti Wilasa DR. Cipto Semarang hospital in the prevention of TB-HIV has been implemented well, but not optimal. This is influenced by: juridical aspects, sociological aspects, and dynamic aspects. The Problems faced by Health Workers in carrying out their role in TB-HIV control are often finding dishonest patients, patients who do not take medication, negative views of patients towards health workers, psychologically declining patients who tend to close themselves off from their families, Hospital services that are not integrated, lack of supporting hospital facilities, lack of health workers to  track patients' house, patients who have never seen a doctor, patients unable to take the TB-HIV medicine due to their work schedule, and no specific provisions were found that regulate the role of health workers in hospitals that can be used as the basis for legal protection in the implementation of TB-HIV disease control.Keywords: Tuberculosis, HIV, Health Workers, Role, Countermeasure Management

Abstract

Abstract: Midwifery referrals are services provided by midwives in the context of making referrals to a higher service system or vice versa, namely services provided by midwives when receiving referrals from traditional birth attendants who help deliveries, as well as referral services conducted by midwives to other health service places / facilities. horizontally or vertically to other health professions. Proper midwifery services will improve the safety and well-being of mothers and their babies. Referral is made if there are certain conditions such as personnel and equipment in a health facility unable to manage complications that may occur.This research is asociological juridical research with analytical descriptive specifications. The data used in this research is primary data which is mainly obtained from interviews and secondary data obtained from literature studies. The data analysis method used is a qualitative method.From the results of thestudy it can be shown that in general the midwives in Sukamara Regency have understood their responsibilities in making referrals by following the flow and rules that apply in the individual health referral system stipulated in the Minister of Health Regulation Number 001 of 2012 concerning the Individual Health Care Referral System and System Guidelines. National Reference. However, the results of the study also showed that the mortality rate for mothers and babies in Sukamara District was still quite high. This is due to various conditions including delays in referring emergency patients to health facilities, local cultural factors, infrastructure, and difficult geographical conditions. Midwives are health workers, so the reference to the legal responsibility of midwives is referred to mainly from Law Number 36 of 2009 concerning Health, Law Number 4 of 2019 concerning Midwifery. From a legal perspective, the health professionals, including midwives, can be held accountable according to the rules in civil law, criminal law and administrative law. Midwives can also be subject to ethical sanctions based on the professional code of ethics of midwives.The suggestions or recommendations given by the author in relation to the results of the research are for midwives and other health workers so that they can provide health services to patients based on science and are guided by laws and regulations, professional service standards, standard operating procedures and code of ethics related to duties and authority. to maintain the quality of health services and always strive to improve competence by attending trainings.Keywords:    legal responsibility, referral, efforts to save mothers and babies, independent practicing midwives

Abstract

Abstract: This paper discusses the delegation of authority in medical actions, which are preventive, diagnostic, therapeutic and rehabilitative actions for patients delegated by doctors or dentists to nurses. This paper aims to identify and describe the arrangements regarding the procedures and requirements for the delegation of authority in medical treatment. In addition, it is also intended to identify the types of legal liability for medical actions that have been delegated. The method used in this study is qualitative with a statutory approach. The discussion is carried out through an analysis of decision number 1167/Pid.B/2010/PN.Sda to identify the responsibility of medical personnel and nursing staff if there is negligence or malpractice against the delegation of authority from medical personnel. Based on the results of the study, it was found that the delegation of authority in medical actions must be comprehensively regulated in the legislation, including in the event of an emergency.Keywords: delegation of authority, medical action, doctors, nurses, health law. Abstrak: Tulisan ini membahas mengenai pelimpahan kewenangan dalam tindakan medis, yakni merupakan tindakan berupa preventif, diagnostik, terapeutik dan rehabilitatif terhadap pasien yang dilimpahkan oleh dokter atau dokter gigi kepada perawat. Tulisan ini bertujuan untuk mengidentifikasi dan mendeskripsikan pengaturan mengenai tata cara dan persyaratan pelimpahan kewenangan dalam tindakan medis. Selain itu juga ditujukan untuk mengidentifikasi jenis-jenis pertanggungjawaban hukum terhadap tindakan medis yang telah dilimpahkan kewenangannya. Metode yang digunakan dalam penelitian ini kualitatif dengan pendekatan peraturan perundang-undangan. Pembahasan dilakukan melalui analisis putusan nomor 1167/Pid.B/2010/PN.Sda untuk mengidentifikasi pertanggungjawaban tenaga medis dan tenaga keperawatan apabila terdapat kelalaian atau malpraktik terhadap pelimpahan kewenangan dari tenaga medis. Berdasarkan hasil penelitian ditemukan bahwa pelimpahan kewenangan dalam tindakan medis harus diatur secara komprehensif di dalam peraturan perundang-undangan, termasuk jika terjadi kondisi emergency.Kata Kunci: pelimpahan kewenangan, tindakan medis, dokter, perawat, hukum kesehatan.

Abstract

Abstract: Based on Law Number 44 of 2009 concerning Hospitals, it is stated that the Hospital is a health service institution for the community. Hospital is part of the health care system, has a very strategic role in improving the health status of the community. Complete health services are needed during the Covid-19 pandemic. Hospitals are required to provide services in accordance with the standards of the World Health Organization (WHO). WHO in 2020 declared Covid-19 a global pandemic. Indonesia is also affected by the pandemic. The pandemic y has directly caused major changes in Hospital services. This includes the Bhakti Wira Tamtama Hospital in Semarang, which is an Army Hospital under the Military Command.The purpose of this study was to obtain an overview of the regulation and implementation of the roles and factors that influence the prevention and control of Covid-19. The research method used is qualitative research. Primary data was taken from direct interviews with sources, namely the task force Covid, management and patients and their families. The method of analysis using qualitative data analysis.Research result. The Bhakti Wira Tamtama Hospital has a Covid-19 alert status. Handling began at the start of the pandemic. 112 regular beds and 4 ICU beds were prepared from a total of 187 beds for the isolation of Covid-19 patients and 63 of the 332 health workers were prepared for the handling and prevention of Covid-19. The role of the Bhakti Wira Tamtama Hospital in dealing with the Covid-19 outbreak is in accordance with the Outbreak Law, Health Quarantine Law, Health Law, Hospital Law, Presidential Decree No. 11 of 2020, the Governor of Central Java's Decree, namely to participate in overcoming the outbreak starting from from screening, patient care, education to the return of the bodies of Covid-19 patients. The purpose of setting the role is to carry out Health Quarantine in accordance with the Health Quarantine Act. The mechanism for implementing its role is in accordance with and in line with regulations from the Central and Regional Governments. The hospital team consists of the screening, education, laboratory, nursing, disinfection and corpse recovery teams. The form of the role can be in the form of imperative and facultative roles. The influencing factors when viewed from juridical factors are in accordance with existing laws and regulations, social factors by dismissing the notion of "coviding" patients and technical factors with the limited number of health workers and special isolation rooms.Keywords: Health services, role, prevention, Covid-19, Abstrak: Rumah Sakit merupakan bagian sistem pelayanan kesehatan, memiliki peran sangat strategis dalam meningkatkan derajat kesehatan masyarakat. Pelayanan kesehatan yang paripurna dibutuhkan di saat pandemi Covid-19. Rumah Sakit dituntut untuk memberikan pelayanan sesuai dengan standar Badan Kesehatan Dunia (WHO). WHO pada tahun 2020 menetapkan Covid-19 merupakan pandemi dunia. Pandemi secara langsung menyebabkan perubahan besar layanan Rumah Sakit. Termasuk juga Rumah Sakit Bhakti Wira Tamtama Semarang yang merupakan Rumah Sakit Tentara yang berada dibawah Kodam.Hasil penelitian, Rumah sakit Bhakti Wira Tamtama berstatus siaga Covid-19. Penanganan dimulai sejak awal pandemi. Peran Rumah Sakit Bhakti Wira Tamtama untuk penanggulangan wabah Covid-19 sudah sesuai dengan Undang-Undang Wabah, Undang-Undang Kekarantinaan Kesehatan, Undang-Undang Kesehatan, Undang-Undang Rumah Sakit, Keppres Nomor 11 Tahun 2020, Keputusan Gubernur Jateng yaitu ikut serta dalam penanggulangan wabah mulai dari skrining, perawatan penderita, edukasi sampai dengan pemulasaran jenazah pasien Covid-19. Tujuan pengaturan peran untuk menyelenggarakan kekarantinaan Kesehatan sesuai dengan Undang-Undang Kekarantinaan Kesehatan. Mekanisme pelaksanaan perannya, sesuai dan sejalan dengan peraturan-peraturan dari Pemerintah Pusat maupun daerah. Tim rumah sakit terdiri dari tim skrining, edukasi, laboratorium, keperawatan, desinfeksi dan tim pemulasaran jenazah. Bentuk perannya dapat berupa peran imperative dan fakultatif. Faktor-faktor yang mempengaruhi bila ditinjau dari faktor yuridis sudah sesuai dengan peraturan perundangan yang ada, faktor sosial dengan menepis anggapan untuk meng”covid”kan pasien dan faktor teknis dengan terbatasnya jumlah tenaga kesehatan dan ruangan khusus isolasi.Kata kunci: Pelayanan kesehatan, peran, penanggulangan, Covid-19,

Abstract։ The condition of adolescent reproductive health is very important, the state must provide sources or channels that can be accessed by adolescents in fulfilling their rights to obtain adequate information and reproductive health services so as to avoid misleading information. This study aims to determine the regulation and implementation of the protection of adolescent reproductive health rights in Tuatuka Village. This study uses a sociological juridical approach. Data were obtained through interviews with parties from the Kupang District Health Office, Kupang District Education Office, Kupang District Ministry of Religion Office, Oesao Health Center, Tuatuka Sub-district Health Center, the community, parents and youth in Tuatuka Village. Data were analyzed qualitatively. The implementation of the fulfillment of adolescent reproductive health rights is carried out based on the provisions of regulations at the national level as outlined in the Minister of Health Regulation Number 4 of 2019 concerning Technical Standards for Fulfilling Basic Service Quality in Minimum Service Standards in the Health Sector, there are no regional policies related to adolescent reproductive health in the Kupang Regency area. Protection of adolescent reproductive health rights is more inclined to preventive protection efforts. Preventive efforts are carried out through screening students in schools, namely carrying out UKS, BIAS and TTD activities carried out by health center midwives. In a curative effort, the Kupang District Health Office has not fully made efforts to improve supervision in the implementation of the Adolescent Reproductive Health Service (PKPR) program available at the puskesmas, because the program has not been utilized by adolescents. Keywords: Legal Protection, Youth, Adolescent Reproductive Health Rights Abstrak: Kondisi kesehatan reproduksi remaja sangat penting, negara harus menyediakan sumber atau saluran yang dapat diakses oleh remaja dalam memenuhi haknya memperoleh informasi dan pelayanan kesehatan reproduksi yang memadai sehingga terhindar dari informasi yang menyesatkan. Penelitian ini bertujuan untuk mengetahui pengaturan dan pelaksanaan perlindungan hak kesehatan reproduksi remaja di Kelurahan Tuatuka. Penelitian ini menggunakan pendekatan yuridis sosiologis. Data diperoleh melalui wawancara dengan pihak-pihak dari Dinas Kesehatan Kabupaten Kupang, Dinas Pendidikan Kabupaten Kupang, Kantor kementerian Agama kabupaten Kupang, Puskesmas Oesao, Puskesmas Pembantu Tuatuka, masyarakat, orang tua dan remaja di Kelurahan tuatuka. Data dianalisis secara kualitatif. Pelaksanan pemenuhan hak kesehatan reproduksi remaja dilakukan berdasarkan ketentuan peraturan di tingkat nasional yang terjabarkan dalam Peraturan Menteri Kesehatan Nomor 4 Tahun 2019 tentang Standar Teknis Pemenuhan Mutu Pelayanan Dasar Pada Standar Pelayanan Minimal Bidang Kesehatan, belum ada kebijakan daerah terkait kesehatan reproduksi remaja di wilayah Kabupaten Kupang. Perlindungan hak kesehatan reprduksi remaja lebih cenderung kepada upaya perlindungan preventif. Upaya preventif, dilaksanakan melalui penjaringan siswa-siswi di sekolah yaitu melakukan kegiatan UKS, BIAS dan TTD yang dijalankan oleh bidan puskemas. Dalam upaya kuratif, Dinas Kesehatan Kabupaten Kupang belum sepenuhnya melakukan upaya perbaikan terkait pengawasan dalam pelaksanaan program Pelayanan Kesehatan Reproduksi Remaja (PKPR) yang tersedia di puskesmas, karena program tersebut belum belum dimanfaatkan oleh remaja. Kata kunci: Perlindungan Hukum, Remaja, Hak Kesehatan Reproduksi Remaja

Abstract

Abstract:  Puskesmas is a first-level health service facility whose task is to provide promotive, preventive and curative services. Health services at Puskesmas include Community Health services and Individual Health Services. School Dental Health Programme   (UKGS) is a community health service related to dental and oral health that targets primary school-age children. The Covid-19 pandemic makes many problems that have hindered the implementation of this program. Descriptive research is held to know the implementation of UKGS in Semarang Regency during a pandemic, especially in 2021, and the factors that influence it. Data was collected from monthly reports and analyzed by qualitative methods, referring to the regulation and result of discussion during evaluation activities with dental and oral health programmers at Puskesmas. Data shows that only 50 % of elementary school students had to dental examination, and only 12,5 % of students get dental treatment. The dental health worker spent more time controlling covid 19.  Prevention programme to decrease Covid 19 transmission and learning  system online is the main obstacle. There are some Puskesmas with good performance who utilize technology information to hold UKGS. Technology information is an alternative for implementing on UKGS programme, when pandemic covid 19 is still ongoing, or when it has been declared an endemic disease. So collaboration work needed to involve the health district office, school and Puskesmas.A legally binding regulation form is needed, like regulation or decree of the health minister. The Circular Letter of Health Minister, Republik of Indonesia Number HK.02.01/303/2002 concerning the Implementation of Health Services through the Utilization of Information and Communication Technology in the Context 0f Preventing the Spread of Corona Virus Disease 2019 has no binding legal force as hierarchy regulation the contained in Law number 12 0f 2011 concerning the Establishment of Law regulation. The Health Office of Semarang regency, should compile technical instructions concerning School Dental Health Programme   (UKGS ) during pandemic covid 19 and socialized it to improve the achievement of UKGS.Keywords: UKGS, Pandemic Covid 19, Semarang Regency. Abstrak: Puskesmas merupakan fasilitas pelayanan kesehatan tingkat pertama yang bertugas memberikan pelayanan promotif, preventif, dan kuratif. Pelayanan kesehatan di Puskesmas meliputi pelayanan Kesehatan Masyarakat dan Pelayanan Kesehatan Perorangan. Program Kesehatan Gigi Sekolah (UKGS) merupakan pelayanan kesehatan masyarakat terkait kesehatan gigi dan mulut yang menyasar anak usia sekolah dasar. Pandemi Covid-19 membuat banyak masalah yang menghambat pelaksanaan program ini.Penelitian deskriptif diadakan untuk mengetahui pelaksanaan UKGS di Kabupaten Semarang pada masa pandemi khususnya tahun 2021, dan faktor-faktor yang mempengaruhinya. Data dikumpulkan dari laporan bulanan dan dianalisis dengan metode kualitatif, mengacu pada peraturan dan hasil diskusi selama kegiatan evaluasi dengan programmer kesehatan gigi dan mulut di Puskesmas. Data menunjukkan bahwa hanya 50% siswa sekolah dasar yang melakukan pemeriksaan gigi, dan hanya 12,5% siswa yang mendapatkan perawatan gigi. Tenaga kesehatan gigi lebih banyak menghabiskan waktu mengendalikan covid 19. Program pencegahan penularan Covid 19 dan sistem pembelajaran online menjadi kendala utama. Ada beberapa Puskesmas yang kinerjanya baik yang memanfaatkan teknologi informasi untuk menyelenggarakan UKGS. Teknologi informasi menjadi salah satu alternatif pelaksanaan program UKGS, saat pandemi covid 19 masih berlangsung, atau sudah dinyatakan endemis penyakit. Sehingga diperlukan kerja sama yang melibatkan dinas kesehatan, sekolah dan Puskesmas.Diperlukan suatu bentuk peraturan yang mengikat secara hukum, seperti peraturan atau keputusan menteri kesehatan. Surat Edaran Menteri Kesehatan Republik Indonesia Nomor HK.02.01/303/2002 tentang Penyelenggaraan Pelayanan Kesehatan Melalui Pemanfaatan Teknologi Informasi dan Komunikasi Dalam Rangka Pencegahan Penyebaran Corona Virus Disease 2019 tidak mempunyai kekuatan hukum mengikat sebagai pengaturan hierarki yang tertuang dalam Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-undangan. Dinas Kesehatan Kabupaten Semarang, hendaknya menyusun petunjuk teknis tentang Program Kesehatan Gigi Sekolah (UKGS) di masa pandemi covid 19 dan mensosialisasikannya untuk meningkatkan pencapaian UKGS.Kata kunci: UKGS, Pandemi Covid 19, Kabupaten Semarang.

Abstract

Abstract : A marketplace is a platform that provides and sells various kinds of commodity goods ranging from daily necessities to medicines. Marketplace users come from ages ranging from teenagers to adults, so problems arise for those who are not yet adults and make online transactions through this platform. In this paper, the author wants to discuss how the marketplace is responsible for selling drugs, one of which is abortion drugs that can be purchased freely, including by people who are not yet adults. The writing methodology used by the author is normative juridical based on library research using secondary data, namely legislation and law books. A license to sell drugs is required under the applicable laws and regulations to avoid unlawful acts and harm to consumers. Furthermore, the marketplace party should run a checking and filtering system for selling medicinal commodities to prevent illegal actions and losses. Some drugs need a prescription and are forbidden to be sold freely.. Keywords: Regulation, Marketplace, Drug Circulation, Online Transaction Abstrak: Marketplace adalah wadah atau platform yang menyediakan dan menjual berbagai macam barang komoditas mulai dari kebutuhan sehari-hari hingga obat-obatan. Pengguna marketplace berasal dari kalangan usia mulai dari remaja hingga usia dewasa, sehingga timbul permasalahan bagi mereka yang belum dewasa dan melakukan transaksi online melalui platform marketplace ini.  Dalam paper ini, Penulis ingin membahas bagaimana pertanggungjawaban marketplace terhadap penjualan obat-obatan salah satunya obat aborsi yang dapat dibeli secara bebas, termasuk oleh orang yang belum dewasa. Metodologi penulisan yang digunakan penulis adalah yuridis normatif berdasarkan penelitian keperpustakaan dengan jenis data sekunder, yaitu perundang-undangan, buku-buku, literatur, dan kamus. Untuk menghindari perbuatan melawan hukum dan kerugian bagi konsumen, dibutuhkan ijin penjualan obat-obatan sesuai dengan peraturan perundang-undangan yang berlaku. Untuk mengindari perbuatan melawan hukum dan kerugian, pihak marketplace sepatutnya harus menjalankan sistem pengecekan dan pemfilteran terhadap komoditas obat-obatan yang boleh atau tidak boleh dijual secara bebas.Kata Kunci : Peraturan, Marketplace, Peredaran Obat, Transaksi Online

Abstract

Abstract: The shortage of medical personnel (doctors) creates a situation that requires nurses to take medical actions or take medical actions that are not under their authority. These actions are carried out with or without the delegation of authority from other health workers including doctors so that it can cause legal problems related to responsibilities that are imposed unilaterally and can be detrimental to nurses. Based on the Strategic Plan of the Rote Ndao District Health Office for 2019-2024, in 2018 the ratio of specialists is 1:79,807 population, the ratio of general practitioners is 1: 12,278 population, the ratio of dentists is 1: 26,602 population and in total the ratio of medical personnel is 1: 7,501 residents. If referring to the national target according to the health workforce development plan for 2011-2025, the standard ratio of specialist doctors is 1:10,000 population, the ratio of general practitioners is 1:2,500 population and the ratio of dentists is 1:1,833 population and the ratio of medical personnel is 1:632 population. . Every state and government administration must have legitimacy, namely the authority granted by law. In administrative law, there are 3 (three) sources of authority, namely attribution, delegation, and mandate. Health services by health workers recognize the delegation of authority, which is commonly known as the delegation of authority. The practice of delegation of authority (delegation of authority) involves the nursing community, which occurs both in nursing services and in health care practices. The delegation of authority is understood as the delegation of doctors to nurses to carry out certain medical tasks. This study aims to analyze the knowledge of nurses about legal responsibilities in carrying out actions based on the delegation of doctors at Korbafo Health Center and analyze the implementation of delegation of medical actions by doctors to nurses at Korbafo Health Center. The approach method used is empirical legal research. This type of research is descriptive and qualitative. This research for novice lecturers will increase the knowledge and competence of researchers in developing research and national publications. The research output is in the form of articles in Indonesian nursing and health law journals.Keywords: Nurse knowledge, legal responsibility, medical action and delegation  Abstrak: Keterbatasan tenaga medis (dokter) menimbulkan situasi yang mengharuskan perawat melakukan tindakan pengobatan atau melakukan tindakan medis yang bukan wewenangnya. Tindakan tersebut dilakukan dengan atau tanpa adanya pelimpahan wewenang dari tenaga kesehatan lain termasuk dokter, sehingga dapat menimbulkan permasalahan hukum terkait dengan tanggung jawab yang dibebankan sepihak dan bisa merugikan perawat. Berdasarkan Rencana Strategis Dinas Kesehatan Kabupaten Rote Ndao Tahun 2019-2024 adalah Pada tahun 2018 rasio dokter spesialis sebesar 1 :79.807 penduduk, rasio dokter umum sebesar 1 : 12.278 penduduk, rasio dokter gigi sebesar 1 : 26.602 penduduk dan secara total rasio tenaga medis 1:7.501 penduduk. Jika mengacu pada target nasional menurut rencana pengembangan tenaga kesehatan tahun 2011-2025, standar rasio dokter spesialis sebesar 1:10.000 penduduk, rasio dokter umum 1:2.500 penduduk dan rasio dokter gigi sebesar 1:1.833 penduduk dan rasio tenaga medis sebesar 1:632 penduduk. Setiap penyelenggaraan kenegaraan dan pemerintahan harus memiliki legitimasi, yaitu kewenangan yang diberikan oleh undang-undang. Dalam hukum Administrasi, dikenal 3 (tiga) sumber kewenangan, yaitu atribusi, delegasi, dan mandat. Pelayanan kesehatan oleh tenaga kesehatan mengenal adanya pelimpahan wewenang, yang biasa dikenal dengan delegasi wewenang. Praktik pelimpahan wewenang (delegasi wewenang) tersebut melibatkan komunitas perawat, yang terjadi baik pada pelayanan keperawatan maupun praktik pelayanan kesehatan. Delegasi wewenang tersebut dipahami sebagai pelimpahan dari dokter kepada perawat untuk melaksanakan tugas medis tertentu. Penelitian ini bertujuan untuk menganalisis pengetahuan perawat tentang tanggung jawab hukum dalam melakukan tindakan berdasarkan delegasi dokter di Puskesmas Korbafo dan menganalisis pelaksanaan delegasi tindakan medis oleh dokter kepada perawat di Puskesmas Korbafo. Metode pendekatan yang digunakan yaitu penelitian hukum empiris. Jenis penelitian ini adalah deskriptif kualitatif. Penelitian dosen pemula ini akan meningkatkan pengetahuan dan kompetensi dari peneliti dalam mengembangkan penelitian dan publikasi nasional.
