Abstract

Patient safety is the main thing in providing nursing services. Nurses must be able to ensure the ongoing patient safety program to suppress or reduce malpractice actions carried out when performing nursing services. The purpose of this study was to determine the form of legal responsibility of nurses for patient safety in independent nursing practice, and the concept of legal protection for patients as consumers of nursing service users. The approach method used in this research is a normative juridical approach, the method of collecting secondary data is that which is obtained through the literature and also sources of statutory law. Furthermore, the data were analyzed using qualitative analysis techniques. The results of the study indicate that the legal responsibility of nurses for patient safety is divided into two types of responsibilities, namely; civil liability as well as criminal liability. The application of patient protection law as a consumer includes preventive protection in the form of; services in accordance with standard operating procedures, professional standards, and standards of legislation with principles on patient safety and security as well as in the form of coaching, education, and supervision for patients. In a repressive manner in the form of; advocacy, efforts to resolve consumer protection disputes properly from the government and consumer protection institutions, in addition to compensation, compensation, and/or replacement of nursing services that are not in accordance with the agreement or not properly, as well as the implementation of justice and punishment for health care providers who has committed a error to the patient.

Abstract

The National Social Security System is basically a state program that aims to provide protection for basic needs and social welfare for all Indonesian people in order to fulfill their basic needs for a decent life. social security to the community. BPJS is a public legal entity that administers social security and is directly responsible to the president. This means that the position of BPJS is directly under the president so that BPJS cannot be included in state-owned enterprises whose position is under the minister of SOEs or under ministries such as the ministry of health or the ministry of manpower even though BPJS is in direct contact with the two ministries. The enactment of Law Number 11 of 2020 concerning Job Creation, inserts an article related to the social security system organized by BPJS regarding the job guarantee program. BPJS in administering social security, both BPJS Health which provides health insurance and BPJS Employment which carries out employment guarantees based on social insurance. In relation to this principle, all Indonesian citizens and foreign nationals who have lived for at least 6 months in Indonesia are required to participate in this social security. The social security program organized by BPJS is a constitutional mandate, where the government is obliged to develop social security so that all Indonesian people can be guaranteed their health and socio-economic welfare.

Abstract

Hospitals as one of the service facilities in the health sector have the obligation to carry out social functions for the poor as regulated in Law Number 44 of 2009 concerning Hospitals and their implementation through Regulation of the Minister of Health Number 4 of 2018 concerning Hospital Obligations and Patient Obligations. Hospitals do not only serve people who are able or rich, but hospitals are obliged to provide health service facilities intended for the poor through the provision of health services for underprivileged patients, emergency services without a down payment, free ambulances, services for victims of natural disasters and external events. ordinary, and social service for humanitarian missions. This study uses a sociological juridical method with analytical descriptive. The type of data used is the type of primary data and secondary data. Methods of data collection is done by literature study and field study. Field studies were conducted by interviewing respondents and resource persons. Analysis of the data used is a qualitative analysis. The result of the research is that although it does not partner with the Health Insurance Administration Agency (BPJS), the implementation of social functions in providing health service facilities for the poor is still carried out by the Banjarmasin Insan Asylum General Hospital. The social function is carried out through the provision of service facilities by providing class III treatment rooms with 32 beds out of 167 available beds for poor patients. Patients who are treated in class III get a charity discount of 50%-100%. An additional 25%-50% discount for laboratory examinations, emergency services without a down payment, providing free ambulances for underprivileged patients, carrying out social services and health promotion in remote areas of South Kalimantan according to the ability of the Hospital. However, the implementation of the Hospital's social functions has been hampered due to space and financial constraints, the decrease in the number of patients as a result of the Hospital's non-partnership with the Social Security Administering Body (BPJS), patients do not pay or pay for treatment costs, so that the implementation of the Hospital's social functions becomes difficult. not optimal.

Abstract

Abstract: The process of buying and selling drugs online has risks and negative impacts that can harm the community. The process of buying and selling drugs already has laws and regulations that specifically regulate the sale and purchase of drugs. Business actors still easily buy and sell drugs online without limits and without regard to drug laws and regulations, which will be very risky for drug consumers. This study aims to determine and analyze how the regulation of legal protection and the implementation of legal protection for consumers and business actors in buying and selling drugs with an online system. The research method uses a sociological juridical approach with analytical descriptive specifications. Using secondary data and primary data obtained from library studies and field studies. The data were analyzed qualitatively and presented systematically and presented in the form of tables and narratives. The results of the study indicate that: (1) The regulation of legal protection for business actors and consumers in buying and selling drugs online is based on the Electronic Information and Transaction Law (UU ITE) and the Government Regulation on the Implementation of Electronic Transaction Systems (PP PSTE), the Consumer Protection Act. (UU PK) and Regulation of the Drug and Food Supervisory Agency Number 8 of 2020 concerning Control of Drugs and Food Circulated Online have provided legal protection to consumers and business actors, but the implementation has not been optimal, so there are still business actors who violate the provisions of the regulation. (2) The implementation of legal protection related to the process of buying and selling drugs online, both preventively and repressively, has not been maximally carried out, this can be seen from the increasing number of business actors selling illegal and counterfeit drugs online. The BBPOM of the City of Surabaya in collaboration with the Surabaya City Health Service and the Indonesian National Police (POLRI), needs to improve supervision, guidance, investigation, and investigation as well as monitoring and evaluating the implementation of online drug trading. Abstrak: Proses Jual beli obat secara online memiliki resiko dan dampak-dampak negatif yang dapat membahayakan masyarakat. Proses jual beli obat telah memiliki peraturan perundangan yang mengatur khusus tentang jual beli obat. Para pelaku usaha masih dengan mudah melakukan jual beli obat online tanpa batas dan tanpa memperdulikan peraturan perundangan obat-obatan, yang akan sangat beresiko kepada para konsumen obat. Penelitian ini bertujuan untuk mengetahui dan menganalisis bagaimana pengaturan perlindungan hukum dan pelaksanaan perlindungan hukum terhadap konsumen dan pelaku usaha dalam transaksi jual beli obat dengan sistem online. Metode penelitian menggunakan pendekatan yuridis sosiologis dengan spesifikasi deskriptif analitis. Menggunakan data sekunder dan data primer yang diperoleh dari studi Pustaka dan studi lapanagan. Data dianalisis secara kualitatif dan disajikan secara sistematis dan disajikan dalam bentuk tabel dan narasi. Hasil penelitian menunjukkan bahwa : (1) Pengaturan perlindungan hukum terhadap pelaku usaha dan konsumen dalam jual beli obat online berdasarkan Undang-Undang Informasi dan Transaksi Elektronik (UU ITE) dan Peraturan Pemerintah Penyelenggaraan Sistem Transaksi Elektronik (PP PSTE), Undang-Undang Perlindungan Konsumen (UU PK) dan Peraturan Badan Pengawas Obat Dan Makanan Nomor 8 Tahun 2020 Tentang Pengawasan Obat dan Makanan yang Diedarkan Secara Daring telah memberikan perlindungan hukum kepada konsumen maupun pelaku usaha namun pelaksanaannya belum optimal, sehingga masih ditemukan pelaku usaha yang melanggar ketentuan peraturan tersebut. (2) Pelaksanaan perlindungan hukum terkait proses jual beli obat secara online baik secara preventif dan represif belum makmimal dilakukan hal ini terlihat dari masih meningkatnya pelaku usaha yang menjual obat illegal dan palsu secara online. BBPOM Kota Surabaya dalam berkolaborasi dengan Dinas Kesehatan Kota Surabaya dan Kepolisian Republik Indonesia (POLRI), perlu meningkatkan pengawasan, pembinaan, penyelidikan, dan penyidikan serta monitoring dan evaluasi pelaksanaan jual beli obat secara online.

Abstract

Obat generik tengah digalakkan oleh pemerintah sehingga mendapat pengawasan yang ketat mulai dari produksi oleh pabrik farmasi sampai pada konsumen. Target pemerintah telah menunjukkan perkembangan yang menggembirakan meskipun demikian, pemantauan produk generik di pasaran berdasarkan kualitas bioekivalensi masih perlu ditingkatkan. Amoxicilin adalah salah satu antibiotik spektrum luas dan merupakan antibiotik pilihan untuk pengobatan infeksi saluran pernapasan atas, banyak di antaranya diproduksi dalam bentuk generik. Penelitian ini dilakukan untuk melihat kinetika absorbsi amoxicilin generik dibandingkan dengan amoksisilin produk dagang. Pengelompokan hewan uji Oryctolagus cuniculus sebagnyak tujuh ekor yang diambil secara acak dengan berat badan 1,5- 2,0 kg B/B. Setiap hewan uji Oryctolagus cuniculus mendapat perlakuan yang sama. Oryctolagus cuniculus yang sebelumnya dipuasakan selama 24 jam, di beri amoxicilin generic 500mg secara oral dosis tunggal. Pada menit 10’ sampai 120’ kadar amoxicilin utuh didalam darah di pantau secara spektrofotometri λ273nm. Kemudian hewan uji Oryctolagus cuniculus yang lain diberi amoxicilin produk dagang 500mg secara pe-oral, dan pemantauan dilakukan secara pemberian pertama. Hasil: Hasilnya menunjukan bahwa kecepatan absorbsi dua bentuk sediaan obat tersebut tidak memberikan perbedaan yang bermakna. Hal ini ditunjukan dengan harga t½ absorbsi untuk produk generik dan brended 27 dan 23 menit. Tidak ada hubungan jenis obat dengan uji bioekivalensi antara amoksisilin generik dan brended.

Abstract

South Konawe District at Southeast Sulawesi Province is a producer of agriculture such as Papaya fruit ranging from 1168 quintals each year. Papaya fruit contains β-carotene which plays an important role in the formation of vitamin A in the body. This research was conducted to determine the β-carotene content of papaya fruit by using variables planting method, fruitage, and fruit condition. The mashed fruit was extracted using n-hexane: acetone: ethanol (2: 1: 1) v/v, then separated from polar and non-polar solutions. Qualitative analysis was carried out using the Carr-Price method and quantitative analysis or determination of β-carotene levels using the UV-Visible spectrophotometric method λ = 452.0 nm. The qualitative test results showed that the papaya fruit in the papaya fruit obtained by cultivation and growing wild with each variable half-ripe, ripe, and not fresh papaya identified the presence of β-carotene. The results of quantitative analysis of β-carotene levels in cultivated papaya fruit were 1.76 μL, half-ripe 1.32 μL, and cultivated young papaya 1.22 μL. In wild ripe papaya 1.75 μL, wild half-ripe papaya 1.3 μL and wild young papaya 1.21 μL. There is an effect of each test parameter starting from the parameters of planting method, fruitage, and fruit condition on β-carotene content in papaya fruit.

Abstract

Legal certainty for pharmaceutical staff is needed for legal protection, fulfillment of the rights of pharmaceutical workers and the fulfillment of patient rights in obtaining maximum pharmaceutical services. The purpose of this study was to determine the position and legal certainty of pharmacists in pharmaceutical services. This research is normative legal research with astatute approach with a qualitative research design. The results of the study indicate that pharmaceutical personnel have a position. The regulation of pharmaceutical services to date has not been in accordance with the principle of legal certainty. This is due to the finding of statutory provisions that allow health workers other than pharmaceutical personnel to provide pharmaceutical services, including: Article 35 paragraph (1) of Law no. 29 of 2004 concerning Medical Practice, Article 30 paragraph (1) letter j of Law no. 38 of 2014 concerning Nursing, Article 21 paragraph (1) PMK No. 9 of 2014 concerning Clinics and Article 1 of PMK No. 26 of 2020 concerning Amendments to the Regulation of the Minister of Health Number 74 of 2016 concerning Standards for Pharmaceutical Services at Health Centers.

Abstract

Standard method to determine some metal and metalloid elements using atomic absorption spectrometry (AAS) instrument has been widely applied based on the absorption of radiation by free atoms. Thus, this study applied the standard AAS method to determine calcium (Ca) levels by varying wet and dry milkfish (Chanos chanos) in order to observe high Ca content categorized for healthy food. The preparation of milkfish were done by varying the condition of wet and dry meat. Fish meat was washed, crushed, dried, and extracted then filtered to get the filtrate from milkfish. It was analyzed based on qualitative observation that the [(NH4)2CO3] and [(NH4)2C2O4] reagents have reacted with the Ca element to form precipitates as CaC2O3 and CaC2O4. Furthermore, quantitative data using the AAS instrument to observe the Ca content of wet and dry meat shows that the wet milkfish has Ca content at an average of 0.0152 mg.g-1, whereas in dry meat conditions it shows an increase in Ca level to 0.0192 mg.g-1. This work has provided an overview of dietary requirements for the determination of Ca content in milkfish under dried meat which is very suitable for developing healthy food.

Abstract

Di awal tahun 2020, Pemerinta Indonesia melalui Keppres RI Nomor 12 Tahun 2020 tentang Penetapan Bencana Non-Alam Penyebaran Corona Virus Disease 2019 (Covid-19) Sebagai Bencana Nasional, menyebabkan hadirnya tatanan kehidupan normal yang baru (new normal life), sehingga masyarakat dalam melaksanakan aktivitas sehari-hari, wajib  mematuhi  protokol  kesehatan  yang  sangat  ketat seperti 3M (Mencuci tangan, Memakai Masker dan Menjaga Jarak. Dengan  kata  lain, new  normal  life yaitu perubahan  atas  perilaku  masyarakat untuk  tetap menjalankan aktivitas tapi dengan protokol kesehatan ketat guna mencegah menularnya Covid-19. Metode kegiatan ini menggunakan pendekatan Partisipatory Action Research (PAR) melalui partisipatif masyarakat di Kelurahan Sterio, Kabupaten Banyuasin. Kegiatan ini di ikuti oleh 30 orang masyarakat. Hasil Pre-test menunjukan bahwa hanya  30% peserta menyatakan tahu tentang pengertian covid-19, 10% masyarakat memahami penyebab covid-19, hanya 40 % yang mengetahui tanda serta gejala covid-19 dan sebanyak 19% yang mengetahui  pencegahan covid-19, namun lebih dari separuhnya memahami tanda dan gejala serta pencegahanya. Hasil post-tes mengalami peningkatan pengetahuan yang cukup signifikan setelah pemberian informasi. Hasil Pre-test tentang safety culture sebagian kecil masyarakat tidak memahami pengertian safety culture (43,3%) berbanding dengan safety dirumah dan diruang publik menunjukan tingkat pengetahuan yang cukup tinggi masing-masing lebih dari separuh. The early of 2020, the Indonesian Government through Presidential Decree No. 12 of 2020 concerning the Determination of Non-Natural Disasters for the Spread of Corona Virus Disease 2019 (Covid-19) as a National outbreak, led to the presence of a new normal life order, so that people in carry out daily activities, must comply with very strict health protocols such as 3M (Washing hands, Wearing Masks and social distancing). In other words, new normal life is a change in people's behavior the daily activities but with strict health protocols to prevent the spread of Covid -19 virus. This programe uses a Participatory Action Research (PAR) approach through community participation in Sterio Village, Banyuasin Regency. This activity was attended by 30 people. Pre-test results showed that only 30% of participants stated that they have a good knowledge of covid-19,  10% of people understand the cause of covid-19, about  40% know signs and symptoms of covid-19 and as 19% know the prevention of covid-19, but more than half understand the signs and symptoms and prevention. The results of the post-test experienced a significant increase in knowledge after the provision of information. The results of the pre-test on safety culture, a small part of the community does not understand the meaning of safety culture (43.3%) compared to safety at home and in public spaces, showing a fairly high level of knowledge, each more than half.

Abstract

Abstract: Medicine is an essential product for health because it can affect the degree of someone’s health consuming it. Therefore, supervision to medicine distribution is needed as an effort to ensure that the medicine is safe, qualified, and efficacious. This is to provide protection for the consumers’ health rights. This study aimed to find out a description of medicine distribution regulation, implementation of medicine distribution supervision, protection to consumers’ health rights and the factors influncing the implementation of the medicine distribution supervision and the protection to the consumers’ health rights. This study applied a socio-legal approach having a descriptive analytic specification. The research data consists of primary and secondary and the data gathering technique was through field and literature studies. The samples taken were based on non random sampling technique by applying purposive sampling. The data presentation was in the forms of narration, images and tables whereas the data were qualitatively analyzed. The results and discussion showed that the regulation medicine distribution supervision has already existed for in general, specifically and the form of supervision arrangements. Medicine distribution supervision in fulfilling the protection to consumers’ rights had not been optimally carried out although the supervision of the medicine distribution was already based on statutory provisions covering the general and special types of medicine distribution arrangements. This was caused by several factors covering juridical, social, and technical factors. The juridical factor influencing was is the provision of the Minister of Health and BPOM that still allowed Puskesmas (Health Center) not to have a pharmacist as the main beneficiary in the pharmaceutical unit. The social factors were about less understanding on health rights and unappropriate checking of the medicine condition beside to TTK directly submit the medicine to the drug consumer. The technical factors were about the limited number of supervisors at the Semarang City’s Health Office and Semarang’s BB POM beside lack of pharmacists in pharmaceutical facilities.Keywords: supervision, medicine distribution, protection of health rights, consumer
