Abstract

AbstractLegal protection for every citizen is a mandatory thing that must be fulfilled in accordance with the mandate of the highest law of the Indonesian nation. One of the most basic things in fulfilling legal protection for citizens is a legality related to status and population data that will guarantee the rights of all citizens. The official residence identity as a form of legal protection for citizens aged 17 years is embodied in the Electronic Identity Card. In its development, official identity as an acknowledgment for citizens under 17 years of age began to be promoted with the Regulation of the Minister of Home Affairs Number 2 of 2016. Ages categorized as children by population were considered to have received the same treatment in terms of giving an identity card as a form of protection. and the realization of the fulfillment of the rights of children and adults. Legal protection and fulfillment of children's rights related to the Child Identity Card procurement program based on the Minister of Home Affairs Regulation Number 2 of 2016 in East Lombok Regency is a concrete step in an effort to realize aspects of public services for children, especially in accessing several government strategic programs with relevant stakeholders.Keywords: Child Identity Card; fulfillment of rights; legal protectionAbstrakPerlindungan hukum bagi setiap warga negara merupakan hal wajib yang harus dipenuhi sesuai amanat Undang-undang tertinggi bangsa Indonesia.  Salah satu hal yang paling mendasar dalam pemenuhan perlindungan hukum bagi warga negara adalah sebuah legalitas terkait status dan data kependudukan yang akan menjamin hak-hak semua warga negara. Identitas kependudukan resmi sebagai wujud perlindungan hukum bagi warga Negara yang berusia 17 tahun terwujud dalam Kartu Tandap Penduduk Elektronik. Dalam perkembangannya identitas resmi sebagai pengakuan untuk warga Negara yang berusia di bawah 17 tahun mulai digalakkan dengan Peraturan Menteri Dalam Negeri Nomor 2 Tahun 2016. Usia yang dikategorikan sebagai anak-anak secara kependudukan dinilai harus mendapatkan perlakuan yang sama dalam hal pemberian kartu identitas sebagai wujud perlindungan dan perwujudan pemenuhan hak anak dan orang dewasa. Perlindungan hukum dan pemenuhan hak anak terkait program pengadaan Kartu Identitas Anak berdasarkan Peraturan Menteri Dalam Negeri Nomor 2 Tahun 2016di Kabupaten Lombok Timur merupakan sebuah langkah konkret dalam upaya mewujudkan aspek pelayanan publik bagi anak terutama dalam mengakses beberapa program strategi pemerintah dengan stakeholder terkait.

Abstract

AbstractThe purpose of the study was to determine the impact of PP No. 40-2021 on the Indonesian economy and the form of a Digital-Based Economy in PP no. 40-2021. This research was conducted through a normative juridical method with an analytical approach and a statutory approach. The existence of PP No. 40-2021 as well as the simplification of permits and regulations at the central and regional levels must continue to be carried out to support the increase in rank in the Ease of Doing Business (EoDB). The impact of the PP No. The new 40-2021 regarding special economic zones actually makes it easier to achieve Indonesia's ideals as a technology-based economy by 2025 to provide convenience for foreigners to invest in Indonesia, especially the development of digital-based technology. With this new provision, the government's ambition in technology development is to create an e-life-based Indonesian state. This is also the positive impact of digital being able to reduce the gap with the establishment of a digital-based economic ecosystem arrangement in Indonesia as a developing country. The form of the digital economy through Special Economic Zones will be formed in an ecosystem which is to form a strong forum for the development of a digital-based economy systemically. The form of a digital-based economy in Indonesia will be shaped like a digital ecosystem such as the silicon valley in the United States.Keywords: digital; economic ecosystem; technology developmentAbstrakTujuan penelitian  untuk mengetahui dampak dari PP No. 40-2021 terhadap perekonomian Indonesia dan bentuk Ekonomi Berbasis Digital pada PP No. 40-2021. Penelitian ini dilakukan melalui metode yuridis normatif dengan pendekatan analisis  dan pendekatan perundang-undangan. Keberadaaan PP No. 40-2021 sebagaimana untuk proses penyederhanaan izin dan regulasi di tingkat pusat dan daerah harus terus dilakukan untuk mendukung kenaikan peringkat dalam Ease of Doing Business (EoDB). Dampak dari adanya PP No. 40-2021 yang baru tentang kawasan ekonomi khusus justru memberikan kemudahan untuk mencapai cita-cita Indonesia sebagai negara perekonomian berbasis teknologi pada tahun 2025 hingga memberikan kemudahan asing dalam melakukan penanaman modal di Indonesia khususnya pengembangan teknologi berbasis digital. Dengan adanya ketentuan baru ini, justru ambisi pemerintah dalam pengembangan teknologi menciptakan negara Indonesia berbasis e-life. Hal ini juga dampak positif dari digital mampu mengubah kesenjangan menjadi berkurang dengan dibentuknya pengaturan ekosistem perekonomian berbasis digital di Indonesia sebagai negara berkembang. Bentuk dari ekonomi digital melalui Kawasan Ekonomi Khusus akan dibentuk secara ekosistem yang dimana untuk membentuk suatu wadah yang kuat dalam pengembangan perekonomian berbasis digital secara sistemik. Bentuk dari ekonomi berbasis digital di Indonesia akan dibentuk seperti ekosistem digital seperti silicon valley di Amerika Serikat.

Abstract

AbstractThe legal purpose of this study is to analyze the acceleration of agrarian reform implemented by the government so that it has an impact on equitable land management. The impact on land ownership inequality is the occurrence of inequality in land ownership that is not balanced. The acceleration of the agrarian reform program is expected to answer the problem of inequality in assets and access, especially to the object of agrarian reform. This research was conducted through a normative juridical method with a statutory approach and a conceptual approach. The agrarian reform journey through accelerating agrarian reform in structuring assets and compliance with access to produce justice for people who need land for prosperity in life. The state constitution's mandate towards agrarian resources is that the state economy is structured and aimed at the greatest prosperity of the people by developing forms of populist economy. The benchmark for the success of agrarian reform will be the creation of equal distribution of land ownership for prosperity and justice.Keywords: agrarian reform; asset management; justice; provision of accessAbstrakTujuan hukum penelitian ini untuk menganalisa percepatan reforma agraria yang dilaksanakan oleh pemerintah sehingga berdampak terhadap penataan tanah berkeadilan. Dampak terhadap ketimpangan kepemilikan tanah yaitu terjadinya kesenjangan terhadap kepemilikan tanah yang tidak seimbang. Perceaptan program reforma agraria diharapkan mampu menjawab permasalahan atas ketimpangan terhadap asset dan akses terutama pada objek reforma agraria. Penelitian ini dilakukan melalui metode yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konsep. Perjalanan reforma agraria melalui percepatan reforma agraria dalam penataan aset dan penaatan akses sebagai upaya untuk menghasilkan keadilan terhadap masyarakat yang membutuhkan tanah untuk kesejahteraan dalam kehidupan. Amanah konstitusi negara terhadap sumber agraria bahwa perekonomian negara disusun dan ditujukan untuk sebesar-besarnya kemakmuran rakyat dengan mengembangkan bentuk-bentuk ekonomi kerakyatan. Tolak ukur terhadap keberhasilan reforma agraria akan terciptanya pemerataan terhadap kepemilikan tanah untuk kesejahteraan dan keadilan.

Abstract

AbstractThe purpose of this research is to determine what interests underlie debtors in proposing debt settlement through PKPU institutions and to analyze the legal position of separatist creditors in the PKPU process. This study uses a juridical normative research method by utilizing the statutory regulatory approach. An alternative way to settle debt payment obligations for debtors is by submitting a suspension of debt payment obligations. The essence of using this institution is to direct the parties in carrying out debt restructuring. In theory, the use of the suspension of debt payment obligation (PKPU) will protect the interests of the parties effectively and fairly. But in practice, this PKPU institution became ineffective and was only used by one party to achieve its own interests. Including the interests of separatist creditors which are limited through SKMA 3/KMA/SK/I/2020, it is implied that there is an injustice for the separatist creditors in submitting PKPU submissions, then the Supreme Court issued SKMA 3/KMA/SK/IV/2020 which revoked the previous regulation while providing legal protection for separatist creditors in the PKPU process. The result of this research is that the debtor's interest in PKPU submission is 1. That debtor wants to restructure its debt 2. Debtor is no longer able to compete with the market. It was also found that the settlement of PKPU cases could be faster than the time period provided by Law 34/2007. Separatist creditors must be included in the PKPU settlement process, because their voting rights will determine the outcome of the agreement and the interests of creditors in a fair and balanced manner, in addition to debt settlement through PKPU institutions based on article 222 Law 34/2007 there is no difference in criteria for creditors.Keywords: creditors; debtors; suspension of debt paymentAbstrakTujuan dari penelitian ini adalah untuk menentukan kepentingan apa saja yang mendasari debitor dalam mengajukan pemberesan utang melalui lembaga PKPU dan menganalisa kedudukan hukum kreditur separatis dalam proses PKPU. Penelitian ini menggunakan metode penelitian normatif yuridis dengan memanfaatkan metode pendekatan peraturan perundang-undangan. Jalan alternatif dalam penyelesaian pembayaran kewajiban utang bagi debitor adalah dengan cara mengajukan penundaan kewajiban pembayaran utang. Inti dari penggunaan lembaga ini untuk mengarahkan para pihak dalam melakukan restrukturisasi utang.  Secara teori penggunaan lembaga penundaan kewajban pembayaran utang(PKPU) akan melindungi kepentingan para pihak secara efektif dan adil. Tapi pada praktiknya, lembaga PKPU ini menjadi tidak efektif dan hanya dimanfaatkan oleh salah satu pihak untuk mencapai kepentinganya sendiri. Termasuk kepentingan kreditur separatis yang dibatasi melalui SKMA 3/KMA/SK/I/2020, tersirat bahwa terjadi ketidakadilan bagi kreditur separatis dalam melakukan pengajuan PKPU, kemudian Mahkamah Agung mengeluarkan SKMA 3/KMA/SK/IV/2020 yang mencabut aturan sebelumnya sekaligus memberikan perlindungan hukum bagi kreditur separatis dalam proses PKPU. Hasil dari penelitian ini adalah bahwa kepentingan debitor dalam pengajuan PKPU adalah 1. Bahwa dirinya ingin melakukan restrukturisasi utang 2. Sudah tidak mampu lagi bersaing dengan pasar. Ditemukan pula dalam penyelesaian perkara PKPU bisa lebih cepat dibandingkan periode waktu yang diberikan oleh UU 34/2007.  Kreditur separatis harus diikutsertakan dalam proses penyelesaian PKPU, karena hak suaranya akan menentukan hasil kesepakatan dan kepentingan para kreditur secara adil dan seimbang, selain itu dalam pemberesan utang melalui lembaga PKPU berdasarkan pasal 222 UU 34/2007 tidak ada perbedaan kriteria pada kreditur.

Abstract

AbstractThe Covid-19 pandemic has become a problem for children who are studying distance learning. The existence of distance learning makes children closer and more in touch with digital technology. Information and communication technology is one of their learning tools. But without realizing it, these minors are trapped in a virtual world that they do not know the dangers of. Because not all children have the correct knowledge about the digital world. Therefore, parents who do not provide supervision to their children are prone to new problems. Many children spend this distance learning period also with entertainment using social media and online games. It is unnoticed by children that personal data such as email address, first name, last name, hobbies, photos, videos are not protected. Personal data protection needs to be considered for children, especially during the Covid-19 pandemic.Keywords: child; e-commerce; personal dataAbstrakMasa pandemi Covid-19 menjadi masalah tersendiri bagi anak-anak yang menempuh pendidikan dengan pembelajaran jarak jauh. Adanya pembelajaran jarak jauh membuat anak-anak untuk lebih dekat dan banyak bersentuhan dengan teknologi digital. Teknologi informasi dan komunikasi yang menjadi salah satu alat pembelajaran mereka.  Namun tanpa disadari, anak-anak dibawah umur tersebut terjebak dalam dunia maya yang mereka tidak tahu bahaya di dalamnya. Sebab tidak semua anak mempunyai pengetahuan yang benar mengenai dunia digital tersebut. Oleh karena itu bagi orang tua yang tidak memberikan pengawasan terhadap anak-anaknya rawan bermunculan permasalahan baru. Banyak anak-anak yang menghabiskan masa pembelajaran jarak jauh ini juga dengan hiburan menggunakan sosial media dan game online. Hal ini tanpa disadari oleh anak-anak data pribadi seperti alamat email, nama depan, nama belakang, hobi, foto, video tidak terlindungi. Perlindungan data pribadi perlu diperhatikan bagi anak khususnya di masa pandemi Covid-19.

Abstract

AbstractThe purpose of the study is to see how the influence of Sidoarjo District Regulation No. 4 of 2011 on Non-Smoking Areas and Smoking Restricted Areas on the behavior of people who smoke while driving. Using empirical research with quantitative research methods. Sampling technique is simple random sampling. The location of the research is in the Waru sub-district. In this study offers a novelty that is observing about the knowledge of the people of Waru Subdistrict with the flow of urbanization and mobility of the active population as an industrial area and buffer Surabaya City regarding local government policies governing the protection of public health. The results of the study were dominated by non-smokers as much as 78.2% and active as motorcycle users as many as 51.2% always encountered motorists who smoked while driving. This shows that Sidoarjo District Regulation No. 4 of 2011 concerning No Smoking Areas and Smoking Restricted Areas cannot affect lowering the number of violations of drivers who smoke while driving considering this policy has been in place since 2011. The behavior is caused by a lack of public knowledge about the policy of Non-Smoking Area, so massive socialization is needed. Strict enforcement of the law to violators is also one of the factors in the behavior of people who smoke while driving still occur.Keywords: driving; perda; smokingAbstrakTujuan penelitian yaitu untuk melihat bagaimana pengaruh Peraturan Daerah Kabupaten Sidoarjo Nomor 4 Tahun 2011 Tentang Kawasan Tanpa Rokok dan Kawasan Terbatas Merokok terhadap perilaku masyarakat yang merokok saat berkendara. Menggunakan penelitian empiris dengan metode penelitian kuantitatif. Teknik pengambilan sampling adalah simple random sampling. Lokasi penelitian adalah di wilayah Kecamatan Waru. Dalam penelitian ini menawarkan kebaruan yaitu mengamati tentang pengetahuan masyarakat Kecamatan Waru dengan arus urbanisasi serta mobilitas penduduk yang aktif sebagai wilayah industri dan penyangga Kota Surabaya mengenai kebijakan pemerintah daerah yang mengatur tentang perlindungan kesehatan masyarakat. Hasil penelitian yang didominasi oleh responden Bukan Perokok sebanyak 78,2% serta aktif sebagai pengguna kendaraan bermotor sebanyak 51,2% selalu menemui pengendara yang merokok saat berkendara. Hal ini menunjukkan bahwa Peraturan Daerah Kabupaten Sidoarjo Nomor 4 Tahun 2011 tentang Kawasan Tanpa Rokok dan Kawasan Terbatas Merokok tidak dapat memepengaruhi menurunkan angka pelanggaran pengemudi yang merokok saat berkendara mengingat kebijakan ini telah diberlakukan sejak 2011. Perilaku tersebut disebabkan oleh kurangnya pengetahuan masyarakat tentang kebijakan Kawasan Tanpa Rokok, sehingga diperlukan sosialisasi secara masif. Penegakan hukum yang tidak tegas kepada pelanggar juga merupakan salah satu faktor perilaku masyarakat yang merokok saat berkendara masih terjadi.

Abstract

Minority shareholders are part of an important element of a company. The continuity of work practices that occur often do not run according to expectations, the legal certainty received by minority shareholders is not the same as the majority shareholders who have enormous power in the company. Therefore, legal protection is needed to protect the rights of minority shareholders. In this study, the author uses a normative juridical research method with a statutory approach and also a conceptual approach. The author also uses legal materials or data obtained by the Library study method, with primary material in the form of laws and regulations, and also for secondary materials using research results with the same or related themes. The results of the research that the authors get are that legal protection for minority shareholders is still not guaranteed for sure, but there are various ways or actions that can be taken by minority shareholders in earning their rights in the company, one of which is asking for the rights to have their shares purchased at a reasonable price.

Abstract

The purpose of this study was to examine and analyze the implementation of Sasi Laut in Pasinalo Village, West Seram Regency and the Role of Kewang Laut in the Implementation of Sea Sasi in Pasinalo Village, West Seram Regency. Sasi is a tradition of the people of the land in Maluku, to maintain certain potential results. When sasi is implemented, the community is prohibited from picking certain plants on land and taking certain products from the sea for a period of time determined by the village government. In the implementation of Sasi Laut in Pasinalo Village, Taniwel District, West Seram Regency, the Kewang Laut institution has a very important function and role as the guardian and implementer of this Laut Sasi. The role of the Kewang Institution basically cannot be separated from the implementation of Sasi. The Kewang Institution has a very large function and role in various things that occur with the management and protection of the environment in land and sea areas that are in the area of ​​customary rights (petuanan) of a country. The role and function of the Kewang Laut still exists in Pasinalo Village which is a customary institution that always oversees every decision issued by Customary Institutions in the task of overseeing the management and utilization of natural resources in the village, but from the results of village regulations issued by the BPD, Village Heads and other customary institutions there are still some shortcomings in the village regulations, namely related to the absence of articles that regulate the role and function of the kewang both sea and land kewang in guarding and controlling the implementation of Sasi.

Statement of Validity and Truth Documents issued by PPAT can be said to be valid as an underhand deed and can be used as evidence in court, the statement issued by the Land Deed Making Official must be examined carefully and the Land Deed Making Officer must truly apply the principle of prudence. -be careful. The type of research that will be used in this research is normative legal research, using library materials or secondary data, and this research is descriptive. As a result, about the validity of the statement letter and the truth of this document, it can be said that the statement issued by the PPAT is valid, regulated by legislation in which the existence of a statement of validity and correctness of this document must exist before registration of mortgage rights electronically is carried out by provisions of origin 10 paragraph (4) of the Government Regulation of Agrarian and Spatial Planning or the National Land Agency Number 5 of 2020, which explains that the cover letter on the validity and correctness of documents issued by PPAT is mandatory and becomes the responsibility of PPAT.
