Abstract

The general election is an essential manifestation of constitutional democracy practised in many countries, including Indonesia. Democracy, originating from the Greek term “rule by the people,” is understood in modern thought as a representative system in which representatives are chosen through free, competitive elections. A democratic election must adhere to universally accepted principles, such as being direct, universal, free, secret, honest, and fair. The electoral justice system, a key instrument of the rule of law, ensures the proper enforcement of these principles by resolving disputes fairly and promptly. Its design is integral to the legitimacy and credibility of elections, reflecting the socio-cultural and political context in which it operates. The system must be guided by values and norms, ensuring the independence and impartiality of election administration, transparency, accessibility, inclusivity, and the right to an effective remedy for violations. Election law enforcement is crucial for maintaining the credibility of elections, providing legal certainty, and fostering trust in the election process. This research explores the Election Supervisory Board’s role in resolving electoral disputes through quasi-judicial mechanisms. It examines the legal framework for resolving election-related disputes, emphasising the importance of an effective electoral justice system in maintaining free and fair elections. The research method involves doctrinal legal analysis, focusing on laws and regulations, particularly Law No. 7 of 2017 on General Elections. By examining adjudication processes and administrative efforts in electoral disputes, the study highlights the evolving role of the Election Supervisory Board in strengthening Indonesia's democratic processes. It concludes that a well-designed electoral justice system is fundamental to ensuring democratic integrity and public trust in election outcomes.

Abstract

Penelitian ini menggunakan metode yuridis normatif dengan tujuan untuk melakukan analisis terhadap peran fungsi yang melekat pada Otoritas Jasa Keuangan (OJK) sesuai dengan peraturan perundang-undangan sebagai dasar pembentukannya. Berdasarkan penelitian yang telah dilakukan, diperoleh hasil bahwa OJK memiliki tugas dan wewenang untuk melakukan pengaturan dan pengawasan terhadap kegiatan jasa keuangan di sektor perbankan, pasar modal, perasuransian, dana pensiun, lembaga pembiayaan, dan lembaga jasa keuangan lainnya. Merujuk pada wewenang yang terdapat pada OJK, peran dan fungsinya meliputi pengatur dan pengawas lembaga keuangan baik dalam kategori bank maupun lembaga keuangan non bank.

Abstract

The establishment of the Individual Limited Liability Company in Indonesia presents several fundamental issues related to the validity of incorporation documents, ambiguity regarding the pre-approval period, and conceptual inconsistencies between Government Regulation No. 8 of 2021 and the Limited Liability Company Law. One of the main issues is the absence of a notarial deed, which is often the legal basis for establishing a legal entity in Indonesia, creating legal uncertainty for third parties. Additionally, the misalignment in the use of the terms “registration” and “approval” in this regulation contributes to confusion about when the legal entity status of the Individual Limited Liability Company can be obtained. Another issue is the organizational structure of the Individual Limited Liability Company, which combines the functions of shareholder and director in a single individual, eliminating the basic principles of power separation and fiduciary duty that underpin good governance. This also hinders the application of the Piercing the Corporate Veil doctrine and blurs the boundary between the owner and the company itself. The absence of a Supervisory Board in this structure further exacerbates the situation as there is no adequate oversight mechanism. Therefore, an update to Government Regulation No. 8 of 2021 is needed, which includes the obligation for a declaration of establishment before a notary, clarity on the personal responsibility of the founder before approval, and the regulation of a periodic reporting mechanism. In the long term, legislative reforms are necessary to create a new legal entity distinct from the Limited Liability Company Law, considering lessons from other jurisdictions and the values of Pancasila.

Abstract

Political parties are central to the democratic system in Indonesia, acting as the intermediary between citizens and the government. However, one of the most significant challenges facing political parties today is the issue of moral hazard, which occurs when party members prioritize personal or group interests over the public good. This study explores the impact of moral hazard within political parties and its detrimental effects on democracy in Indonesia. Using doctrinal legal research with a conceptual and descriptive analysis of secondary data, the study finds that moral hazard leads to a decline in public trust, diminished political participation, and weakened social control. The consequences also extend to the quality of public policies, which suffer due to misaligned priorities, lack of expertise, and insufficient evaluation. Moreover, moral hazard erodes accountability, which fuels corruption, nepotism, and a lack of oversight, ultimately compromising the quality of democracy. To address these challenges, the study proposes a multi-pronged strategy, including strengthening internal oversight within political parties, improving transparency, and reforming the party system. Key reforms include ensuring ethical conduct through codes of ethics, establishing independent oversight committees, and protecting whistleblowers. The study also advocates for stricter legal enforcement, increased public participation, and the role of media in holding parties accountable. Finally, global cooperation is crucial in tackling cross-border corruption and unethical practices. By implementing these reforms, Indonesia can reduce moral hazard within political parties, strengthening the democratic process and ensuring that the political system serves the public interest effectively and transparently.

Abstract

Penelitian ini bertujuan untuk mendeskripsikan program pemerintah terkait pencegahan kejahatan Narkotika di Indonesia; untuk mengetahui tindakan pemerintah terhadap oknum pejabat yang terlibat di dalam perkara pidana narkotika di Indonesia serta untuk mengetahui upaya pemerintah untuk merehabilitasi korban narkotika di Indonesia. Penelitian ini merupakan penelitian kualitatif dengan mengumpulkan data sekunder. Di Indonesia permasalahan kejahatan tindak pidana narkotika telah menjadi permasalahan bangsa dan juga menjadi permasalahan bangsa-bangsa di dunia. Penyalahgunaan narkotika tentunya dapat mengakibatkan kerusakan secara fisik, kesehatan mental, emosi dan sikap dalam masyarakat. Permasalahan penyalahgunaan narkotika telah mengancam kehidupan masyarakat dan bangsa dapat dikatakan kejahatan tindak pidana narkotika merupakan suatu kejahatan yang terorganisasi dalam lingkup Nasional maupun bagi dunia Internasional.

Abstract

Regional autonomy reform in Indonesia is a key initiative aimed at enhancing governance by ensuring greater transparency, accountability, and efficiency in local government operations. By decentralizing authority, local governments gain the freedom to manage regional affairs and develop policies that are more closely aligned with their communities' needs. The ultimate goal of regional autonomy is to improve community welfare by enabling regions to design and implement targeted solutions. However, the process faces several challenges, including disparities in regional development, ineffective resource management, and insufficient coordination between the central and local governments. Addressing these issues requires a transformation in community attitudes, improved government capacity, and enhanced public participation in decision-making. The successful implementation of regional autonomy depends on effective policy reform and better management practices, alongside active involvement from the community. Local wisdom should be integrated into development strategies, ensuring that policies respect and preserve cultural diversity while promoting sustainable growth. Additionally, strengthening oversight mechanisms, improving transparency in budget management, and fostering intergovernmental cooperation are crucial for achieving equitable development outcomes. Regional autonomy reform holds significant potential for creating a more responsive government that better serves its people. However, to unlock this potential, it is essential to build the capacities of local governments, ensure effective supervision, and encourage inclusive decision-making processes. This approach will contribute to the realization of sustainable development goals, fostering a more just, accountable, and efficient governance system.

Abstract

Penyidik dalam menjalankan tugasnya ternyata mengalami ancaman bahkan kekerasan, sedangkan dari aspek perlindungan belum memiliki aturan. Metode penelitian yang digunakan yaitu yuridis normatif dengan pendekatan perundang-undangan dan kasus. Pentingnya penyidik diberikan perlindungan fisik yaitu aspek sosiologis ditemukan penyidik mengalami ancaman dan penganiayaan oleh pihak yang memiliki kepentingan perkara yang sedang ditangani. Aspek yuridis: konstitusi Indonesia telah menjamin setiap warga untuk menjamin perlindungan hal ini berdasarkan Pasal 28G ayat (1) UUD NRI 1945 bahwa “jaminan perlindungan dari berbagai ancaman”, selain itu membandingkan dengan Pasal 33 UU Pemberantasan Tindak Pidana Terorisme mengatur perlindungan terhadap penyidik. Perlu langkah proaktif dari pemerintah untuk melakukan preventif dengan memberikan perlindungan terhadap penyidik. Sehingga seharusnya penyidik tindak pidana korupsi diatur perlindungan fisik.

Abstract

Since 2017, military operations in Myanmar, justified as responses to attacks by Rohingya insurgent groups, have resulted in large-scale ethnic cleansing, forcing over 700,000 Rohingya to flee to neighboring countries, including Indonesia. Aceh, in particular, has become a significant destination due to its historical role as a refuge for displaced populations. The influx of refugees presents substantial challenges for local authorities and humanitarian organizations in meeting essential needs such as food, healthcare, and education. The United Nations High Commissioner for Refugees (UNHCR) has played a central role in responding to this humanitarian crisis by providing assistance and protection to Rohingya refugees in Aceh. Working closely with the Government of Indonesia and local non-governmental organizations (NGOs), UNHCR strives to uphold refugees’ fundamental rights and to mobilize international support effectively. Its interventions include the provision of basic necessities, access to healthcare services, educational programs, and efforts to facilitate integration into the local community where feasible. Despite these comprehensive efforts, significant challenges persist. Coordination among various actors—including government agencies, NGOs, and international donors—is often complex, resulting in gaps or overlaps in service delivery. Additionally, the sustainability of support remains a critical concern, as protracted displacement requires long-term planning, continuous funding, and consistent monitoring. This study focuses on two main issues: the role of UNHCR in delivering assistance and protection to Rohingya refugees in Aceh, and the challenges the agency faces in fulfilling its protection mandate. Employing doctrinal legal research, the study emphasizes international legal frameworks governing refugee protection and state responsibility. The findings indicate that while UNHCR has made substantial efforts to address immediate humanitarian needs, persistent challenges in coordination and sustainability must be addressed. Strengthening these areas is essential to ensure that the protection, welfare, and rights of Rohingya refugees are maintained effectively and sustainably over the long term.

Abstract

The digital era has significantly transformed the dynamics of law enforcement in Indonesia, particularly through the widespread use of social media. The phenomenon of “No Viral, No Justice” illustrates a growing trend where public pressure via social media accelerates legal processes, whereas cases lacking online attention often face delays or neglect. This study examines how social media virality influences criminal case handling, highlighting both normative and empirical dimensions of justice. Drawing on doctrinal legal research, statutory analysis, and case studies, the research identifies the paradox inherent in digital oversight: while virality can enhance transparency and accountability, it may also compromise the principles of due process, presumption of innocence, and equality before the law. The study reveals that the spread of information on digital platforms can shape public opinion, sometimes creating trial by media, misinformation, and populist pressure, which can distort substantive justice. Furthermore, virality often favors emotionally charged or dramatic cases, producing a hierarchy of attention that undermines equitable access to justice. To address these challenges, the study recommends integrated digital reporting systems, objective case prioritization based on urgency and impact, ethical guidelines for communication, and strengthening the professionalism of law enforcement. By balancing public participation with procedural integrity, the legal system can leverage social media as a tool for oversight without sacrificing fairness or judicial independence. This research contributes to legal scholarship by providing an operational analysis of the interaction between digital social control and criminal justice, emphasizing the need for adaptive policies that preserve fundamental legal principles while accommodating the realities of the digital public sphere. Ultimately, the findings underscore that justice should remain a guaranteed right for every citizen, independent of the popularity of cases in the digital space, ensuring fairness, transparency, and accountability in law enforcement.

Abstract

This study critically examines the integration of Balinese customary criminal law, specifically the delict of Lokika Sanggraha, within Indonesia’s formal criminal justice system under the recent National Criminal Code (Law Number 1 of 2023). Lokika Sanggraha, codified in Article 359 of the Adhigama Code, addresses cases in which a man engages in sexual relations under a promise of marriage but subsequently abandons the pregnant woman. Historically, the colonial-era Criminal Code lacked provisions for such scenarios, necessitating the judicial incorporation of living law (customary law) to fill normative gaps. The Denpasar District Court Decision Number 997/Pid.Sus/2019/PN Dps exemplifies judicial engagement with customary law, where the court applied the Adhigama Code in conjunction with Emergency Law Number 1 of 1951, resulting in a custodial sentence for the perpetrator. This case illustrates the tension between formal legal codification and living law, highlighting both progressive impulses and limitations in sentencing, notably in addressing the multidimensional harm to victims. Using a combined methodological approach—including statutory, case, and conceptual analyses—this research evaluates the decision through Pancasila justice dimensions, progressive legal theory, restorative justice, and legal pluralism frameworks. It further introduces an Integrative Sentencing Model that operationalizes the principles of proportional punishment, customary obligation fulfillment, victim compensation, and child protection under the National Criminal Code. Comparative analysis with Supreme Court Decision No. 1644 K/Pid/1988 and the codified Sharia-based system of Aceh demonstrates the spectrum of judicial approaches to customary law, informing a hybrid framework that balances formal adjudication with culturally embedded restorative mechanisms. The study concludes that while recognition of living law has advanced constitutionally, effective operationalization requires judicial capacity building, coordination with customary institutions, and robust procedural safeguards to ensure substantive justice. The proposed Integrative Sentencing Model provides a practical roadmap for aligning customary practices with formal legal standards, advancing human rights, gender justice, and restorative outcomes within Indonesia’s pluralistic legal landscape.
